Emotional distress is a secondary claim on civil suits, you're never suing with emotional distress as a primary cause of action, your primary cause of action will be the harm that generates the emotional distress. "Invasion of privacy" isn't a cause of action, or even technically a crime. For instance, in Destiny's example of photographing the inside of a house, the crime is trespassing, as you'd have to be trespassing to be able to actually photograph the inside of someone's house through their windows. Zooming in with a camera could potentially constitute harassment or stalking, or would possibly fall under some kind of civil infraction relating to recording in private areas. In any case, though, the invasion of privacy was the thing that contextualized the action such that it fits a crime, it was not the crime itself. Even in civil lawsuits, you're almost always pointing to a criminal offense of some kind, you're just aiming to recoup losses caused by the offense instead of pursuing criminal penalties. Defamation is probably the only non-criminal offense that you'd be claiming doxxing on in a civil lawsuit. You also need to expand "generally not illegal" to include all private information. It's completely not illegal to share publicly available information; it's generally not illegal for private citizens to share restricted information, including SSN, DOB, medical diagnoses, and more. Some states might have laws that restrict the release of this kind of information, and some states might expand the definition of covered persons with regard to federal definitions, but that will depend entirely on the state. (However, restricted information will almost always carry with it some degree of harmful intent, so that form of doxxing is probably already covered by an existing criminal statute.)

It really just all depends on the information and how its shared. If the owner of the information never put it online themselves I Believe theres a case that can be made, especially based on the level of maliciousness used for said thing. Theres always a way to access anyones information through government records but I believe theres limitations put in place that prevent that from being consider publicly free information for sharing/personal usage. Its supposed to be for business and private usage iirc. IE: you commit a crime and its put in a news article for record, thats now public record, and anyone can access it, not considered doxing at that point.

To add to Destiny's point about people dismantling structures only to then rediscover why they existed in the first place, I think one common effect of weakening the more formal enforcement structures such TOS and mods is an increase in cancel culture-type behavior. Norms are always going to need to be enforced, and dismantling one venue of enforcement tends to lead to growth in other venues.

Regarding legality of doxxing, i wrote a long paper about this exact topic in university. Destiny is correct, doxxing is not a legal term and there are virtually no laws on the books in any jurisdiction that would make posting someone's personal information online illegal. It would be especially difficult to write an effective law against that considering many, MANY instances of doxxing only involve the gathering freely publicly available information that the individual simply doesn't want linked back to their online pseudonym (information like peoples full name and address, while sensitive, is not considered legally private). To make that illegal you'd have to do major overhauls of many public records systems in the country, and even if that was done you'd then run in to 1st amendment issues galore. Doxxing in a vacuum is not illegal, it's always some other crime associated with it that gets people in trouble with the law
