I’m an ex paralegal who worked in litigation in the UK, the system in the US is very similar. Even if you do it yourself, there is always a filing fee (mostly depends on the size of the claim), if you go through a firm it’s even more expensive. Also it’s important to note that generally speaking, the losing party (in civil suits) will have to pay for ALL legal costs, including the winning side.

For those who don't know what the cheating scandal was. After his DK record was surpassed he quickly took his record back when he submitted footage of him taking the record back. However everyone pointed out that the gameplay he submitted loaded in a werid way. For the record to be official on Twin Galaxies it has to be on the original Arcade version of the game because if you use an emulator you can reload at points where you mess up untill you eventually get the high score. The way the game loaded was how it loads on an emulator. Billy and his friends who were the only witnesses to him getting this record insisted it was the arcade cabinet version. Apparently he used the only arcade version of DK in history that loaded like an emulator and the only people who could confirm it wasn't an emulator was his friends......seems liget. But he had a fan base and had friends in twin galaxies so he was able to hold the record and keep the lie going for years. But a few years ago the moment against him grew and the lawsuits he threw around didn't help. And eventually Twin Galaxies removed the record

I saw Billy Mitchell at Free Play Florida a few weeks ago. Had no idea who the guy was, just took my kids to the convention because it seemed like a good time for them. I had to use the restroom, and as I went to wash my hands, Billy Mitchell was at a sink, looking at himself intensely in the mirror. He was fixing his shirt cuffs, adjusting stray hairs, and checking his jacket for lint. As he walked away from the mirror, he turned back one last time, about 5 feet from the counter and shot double guns to his own reflection. I have never seen a more douchey gesture in my life. Again, I had no idea who this was. I told my friends back in the main conference hall about this encounter immediately. They knew who I was describing but had no idea about any of this lawsuit stuff or alleged cheating. We stumbled across this video and are all having a good laugh now.

Mitchell can be countersued for attorney fees of the opposing party, as well as damages for the opposing party. I’d strongly recommend countersuing him, and from the looks of it, he has a good case and would probably win it against Mitchell.
