You read her well...perfect observation....she had an attitude of superiority. That poor woman is from another country...must be made to feel welcome when they are far from their homes and loved ones...and she was seriously working on her art. Yes, but the plaintiff SHOULD HAVE TOLD THE DEFENDANT THAT SHE WAS AN OPERA SINGER in the beginning. That way she could have had a choice whether to rent to her or not, or come to some kind of agreement ahead of time. It was completely dubious of the plaintiff to withhold that information and then expect that it wouldn't be a problem.

She likely assumed that the plaintiff would not sue. Depending on the state laws, she could have doubled her damages.

@@melosidhe779 Listen .. that help. I lived near a band practicing daily for hours ... and I used noise cancelling headphones .. I finished 2 research degrees living there for 6 years. it worked .. the only downside is when I needed to take them off to sleep .. because some nights they'll play after midnight .. I don't think they were worse .. my worse was the old factory siren that would go off every heavy rain because it is how it works .. it took me 2 years of complaining to council for them to figure out who own that abandon factory and how to get that alarm to stop. that was horrifying .. it is very loud old siren .. and it would go for an hour if the rain is heavy .. horrible thing.

I had roommates and it was a complete disaster. I got rid of them all and got a young couple to move in. They paid rent on time, gave me gifts, bought groceries and cooked. It was great until the fighting started. I sold that place, moved 70 miles south and bought a doublewide to live in while I looked for a better place. I'm still in that doublewide. There's alot of space and the lot rent is $600/mo. The neighbors are nice, and I'm in for the long haul. No roommates required.

I once rented a room in a house and the landlord’s sister who was also living in the house and was the unofficial caretaker kept making remarks about me taking phone calls in the house. That the walls were thin and she could hear me from across the hall. She insinuated I should make or take calls outside. One time i was on the phone in my room basically whispering like a child sneaking a phone call and she passes my room on way to hers slams her door and says for goodness sakes loud enough for me to hear. The next day i gave my notice till end of the month and left. Day i was leaving she shamefacedly asked me she hoped I wasn’t leaving because of her 🙄. Some people just can’t live with other people but should not be renting out their home

Just took another day off, which is becoming a bad habit for me, I am considered a STAR employee. But maybe just a WORK HORSE, capable of being USED. Not to generalize, but most Americans have a lack of appreciation for opera. Even Judge Milian's "gun finger in the head" zany reaction is typical, though may have been taken as offensive, along with the "belting" reference to which the plaintiff objected.

Singing opera and practicies and warming up is two different things! 4 notes of "A" would drive me crazy. But I can hear she has a good voice. And the judges told her twice she had a beautiful voice.. Its Just the warm up and practecy every day that can be desturbing.

The judge was referencing the repeated over and over practice of just notes. That could be monotonous and annoying. It wasn't opera singing. But, if course, the tenant had the right to practice an hour a day!

Just use earplugs, people. I live in a 17 story tower in concrete. I don't have one specific neighbor that is noisy, but there's always going to be someone using a drill. So I sleep with earplugs. When even that isn't enough, I put my earlplugs and my headphones with my music above that. Someone could be drilling in my living room, I'd be sleeping in my room.

Is that guy outside an idiot? "noise ordinance" WOW! Yes, she has a right to sing as a tenant she appeared reasonable and considerate and was not afforded the same. The defendant appeared to be rude; her own statement shows that! She also was hesitant in her responses which tells me she thinking her responses over. However, when you're telling the truth one should be able to recall without hesitation for the most part. Moreover, the plaintiff has no obligation to say hello to her! The defendant was being a bully as she wanted to exercise her own liberties (playing her music, yoga, working from home in common spaces etc.) but didn't afford the plaintiff the same civil liberties! She also wanted courtesy extended to her from the plaintiff but didn't give her the courtesy of letting her know that there was someone else who was going to be moving in.

No. There are no rights at play here. She does not have a right to indulge in disturbing the peace of the house. However there could have been a peaceful arrangement made. I love singing but practicing those scales every morning would have been annoying.

Also, defendant definitely said what plaintiff claims because “sublet” is not the term used in the UK. Highly doubt plaintiff would have come up with that phrasing if she were lying.

From what I know, here in Canada, anytime you do more than chill in the house (run a home based business, have a dog, practice singing/playing an instrument, etc) you should mention your requirements while applying for the place, as you are asking someone to limit their freedoms to accomodate your choises. It sounds aweful put that way, but it is about managing expectations... What if the plaintiff had tenitis? Should she have to suffer for 60 days because the defendant did not mention her singing needs?

Canada does not have one set of laws governing tenant rights. It varies by province/territory.

@@brendenvarty3266 true, but I have yet to find a tennant legality that allows "entering a contract under false pretenses" which is the legal action a landlord can claim such acts under. Learned that due to owning a dog. Basically, the concept I was stating is that one should explain their uncommon or jargon based needs while applying for housing.

The dog is not the issue, but the issues your particular dog is causing, such as the yapping causing your neighbour to fear passing your door in the hallway to get to their appartment.

All they had to do was agree on what hours she could practice. I'm sure the plaintiff would have accommodated her. The problem people have with sharing their hoimes/appartments is that they think being the owner makes them the ultimate authority. It doesn't. When someone is paying you to live in your home they have the same rights as any other tenant.

My wife can get all the high notes, and sometimes she shows off, one day we were going down the road and listening to CDs and all of a sudden I hear this high shrill, and I slammed on the brakes and swerved off to the side of the road and I thought something had happened to her, and I get stopped and looked over and she was alright, and kind of smirking, then I told her not to do that when I'm driving, we'll have an accident! 🤣
