You're already judging the truck driver as "bad" when everything indicates he acted in self-defense. Stand your ground laws are not restricted to what the person can use to defend him or herself. The rafter guy had even been in jail for being drunk and hitting one person with, surprise, surprise, a paddle. And several witnesses had seen the "tourists" littering along the way. The truck driver is a hero.

Clearly the tourist rafting company did supply those people with helmets. The question is, why didn't they go the extra mile for the kevlar vests? Sure life vests are fine, they can keep you afloat if you fall off the raft, but they provide no protection for falling trucks and the like.
