@legrandsommers8854 police only have qualified immunity on municipal and state level, not on a federal level. If the federal government decides to prosecute that immunity goes out the window. That's also the reason corrupt police who are prosecuted only go to federal prison. Alot of people aren't aware of this and that's done intentionally so the general public doesn't know to report corrupt law enforcement to federal agencies to actually be held accountable.

A policy is not unlawful in itself. The law that is typically relevant is trespassing. Policies that standup to constitutional scrutiny required for the type of public forum in question can legally be enforced via trespassing laws.

It's perfectly legal to enforce a policy that stands up to constitutional scrutiny and isn't plainly illegal due to local law. Sean's own preliminary injunction win against the NYPD highlights this quite well. His first amendment arguments being rejected, whilst he was granted the injunction because it was against NY state law.

If and when he arrests @LIA for the same exact charges. In the same exact situation. The judge/judges deciding whether that qualified immunity protects his house or not. WILL care what the reason for two prior dismissals were. Especially given he's now on video admitting he is aware of the fact twice the court has said. The State cannot persecute a citizen for that. 😂

There's a bit more to this one from memory. The previously dismissed charges were for a more serious trespass statute. Really they went for a higher charge than what the evidence provided for and hence it was facially insufficient.

You joke but until people defend themselves with force the cops don't care, they get paid whether they are arresting you legally or illegally. They don't pay anything for the lawsuits. Whether you can legally defend yourself from an unlawful arrest varies by state/circuit so do so at your own risk.
