@legrandsommers8854 police only have qualified immunity on municipal and state level, not on a federal level. If the federal government decides to prosecute that immunity goes out the window. That's also the reason corrupt police who are prosecuted only go to federal prison. Alot of people aren't aware of this and that's done intentionally so the general public doesn't know to report corrupt law enforcement to federal agencies to actually be held accountable.

A policy is not unlawful in itself. The law that is typically relevant is trespassing. Policies that standup to constitutional scrutiny required for the type of public forum in question can legally be enforced via trespassing laws.

@@9767shane I agree that they should be. But my concern is that people seem to be regularly of the opinion that policies can't be and argue that enforcing policies is unlawful. It's perfectly legal to enforce a policy that stands up to constitutional scrutiny and isn't plainly illegal due to local law. Sean's own preliminary injunction win against the NYPD highlights this quite well. His first amendment arguments being rejected, whilst he was granted the injunction because it was against NY state law.

The law they would be enforcing would be trespassing. You can legally be trespassed from public property for failing to abide by policy that stands up to the constitutional scrutiny required for the type of public forum in question.

If and when he arrests @LIA for the same exact charges. In the same exact situation. The judge/judges deciding whether that qualified immunity protects his house or not. WILL care what the reason for two prior dismissals were. Especially given he's now on video admitting he is aware of the fact twice the court has said. The State cannot persecute a citizen for that. 😂

There's a bit more to this one from memory. The previously dismissed charges were for a more serious trespass statute. Really they went for a higher charge than what the evidence provided for and hence it was facially insufficient.

Unfortunately because a "dismissal" doesn't hurt their pocket books like a prosecution lawsuit against them (most likely it would come out of the public's money) but without that pressure and the attention that gives, they feel they have the moral right to act against the Constitution. Until public pressure is applied, they'll continue to flex their stupid, because they think that's "winning". :(

I've seen several people say that you and others who do what you do have less than savory motives and that you shouldn't do this stuff any more, but I've always seen audits as a way to make the changes necessary so the general public doesn't have to suffer thru the interactions you have. Like the video I've seen circling social media of the guy from Independence, Missouri (of all places) being arrested and roughed up when he was just trying to pay his taxes. He knew better than they did that he didn't need to present his ID to pay his taxes and they tried to trespass him because he didn't want to surrender his 4A right.
