Sorry, for clarification, this expert is lacking on her knowledge. * NRA was started to ensure that the populace remained skilled in shooting because the skills were lacking for a lot of people joining the military for the Civil War. * The 1934 NFA act does not stop all interstate commerce of machine guns, it only registered them. You can still buy a legal machine gun today. * All states require background checks when purchasing from a licensed dealer. Some states require that private sales go through a dealer and have a background check done. * The National Gun Control Act was passed 1968 after the RFK assassination not JFK. Provisions in it were discussed after JFK but not passed until later. It did not ban or register anything. all the GCA did was create a paper trail of purchases made through licensed dealers and limit interstate commerce forcing sales across state lines to go through a licensed dealer. * It is almost always a crime to possess a firearm while under the influence of alcohol or any controlled substance. *The federal assault weapon ban went into effect in 1994 not during Reagan. It was not 'repealed' under Bush, it expired. *Canada has 1/4 of the gun ownership per capita of the US. 34/100 Canada 120/100 USA *There are not any federal laws against a person shooting a gun based on age. Some States restrict possession by minors if not accompanied by an adult. *From Wikipedia: United States v. Cruikshank, 92 U.S. 542 (1876), was an important United States Supreme Court case[1] in which the Court held that the Bill of Rights did not apply to private actors or to state governments despite the adoption of the Fourteenth Amendment

This lady said Canada has per capita gun ownership similar to the United States. I think she's wrong because I looked it up several times and I'm pretty sure the number of guns in Canada is less than a third of its population, while the United States has more guns than people. The United States has 9-10 times as many people as Canada, but around 40 times as many guns .
@garettjames6349
@garettjames6349 3 жыл бұрын
Ya, she definately dropped the ball on that one. She should have clarified a bit. The amount of people who own guns in Canada is lower, but not too dissimilar to the amount of people in America that own guns, but the average Canadian owns a rifle or a shotgun, maybe 2 or 3 if they're really into hunting. In America about 30% of people own a gun, but they tend to own a lot of guns per person. In fact surveys show that 3% of Americans collectively own over 130 million guns. There are people with massive stockpiles which skews the statistics of gun ownership. You don't have that in Canada. Also, when she said she doesn't know why gun violence is lower in Canada, that was a missed opportunity as well. It's fairly clear why. Handguns are not illegal, but it's very hard to qualify to own one. You need to apply to the police, take many hours of safety courses, and importantly, often times you have to prove a threat / a need to have one, or you need some professional reason like like Olympic training etc. Handguns are what are used in most gun murders, not ARs or shotguns, so clamping down on them is one key reason. If one country os full of hunting rifles and shot guns and one is full of handguns, it's fairly obvious the one with handguns is going to have the bigger problem. Beyond that, in Canada mental health is a factor in gun ownership. If you are diagnosed with clinical depression or a list of other psychological issues, your guns are held by the police until your mental health diagnosis improves and they give them back. And this is possible because all guns need to be registered. So there's a lot of things going on to ensure that the most dangerous guns and people are tracked and restricted. Lastly, there's no second ammendment, and so there's not the kind of cultural entrenchment that America has where people feel it's a right and necessary to the survival of their country or a mentality of equating guns to self defense. Can't quantify that, but I think it matter. Lastly she missed a good opportunity about who actually does have the second and third highest per capita gun ownership after the US - Yemen and then Serbia. Could have made a joke about how guns = freedom lol.

@@garettjames6349 Somewhere I've read that Canada's society is not anywhere near that stratified as in US. The bulk of the crime comes from a lot of people having very different lifestyles. When everybody are more or less on the same level, it's a calmer society. For sure the harsh environment plays a role too. People tend to be nicer to each other the worse the nature is. I'm sure gun laws there plays some part too. But not a strong part.
@garettjames6349
@garettjames6349 3 жыл бұрын
@@kylestephens9593 The laws are the key part. Stratification matters and Canada is very middle class, but the UK is very stratified, so is China, but the same gun issues don't exist there. Anyway, it's pretty easy stuff. If you allow just anyone with no controls to have handguns, you're going to have gun violence problems. It's not rocket science.

"I've lived in countries where we don't have guns" You've lived in countries that aren't *completely saturated* with guns, Australia has guns/gunowners and hunting/sport shooting. You've lived in countries where gun ownership must be justified, ie citing self defense isn't enough to own a gun, the gun has to serve some real, practical purpose (hunting, managing pests on a ranch/farm, etc). You've probably also lived in countries where ppl aren't spoiled brats who treat guns like toys.

Also they are currently trying to seize over 2,000,000 guns through an I democratic method. Only the law abiding citizens will be punished because adding a mandatory 8 years sentence to a criminal who is already getting a 10-15 year sentence means nothing because both sentences will be served simultaneously. Further criminals don’t have licenses or property to seize so again only otherwise law abiding citizens will be punished more then the actual gang bangers. Spend the $2,000,000 on crime, not making new criminals.

@@SammySlamma92 yup, that solves everything. 600,000-2,000,000 guns that were previously unregistered like the M305, Beretta Storm, many semi-auto shotguns, 20 or so different modern sporting rifle brands, (very similar to AR15’s except unregistered) are not illegal to own, use and sell. So if you have several thousand dollars worth of this property you are expected to hand it in to be destroyed without compensation. OR, there are quite a few criminals who will gladly pay you 3x what you paid so they can murder each other. This will definitely get more guns off the streets. The Great Australian Gun Ban got almost 22% of the guns in Australia. The remaining 78% are now in the hands of criminals.

Her explanation of cruikshank is so simplistic that its way off the mark. Cruiksank never said their isnt an individual right to arms. I dont even know what a “federal individual right” is. It said that the 1A and 2A does not create a right but that it bans the federal government from violating those rights that had already existed before the US constitution. That court also choose to not include the bill of rights under the 14th amendment. That exclusion allows States to write laws not just on the right to arms but all of the bill of rights even free speech. So its not that the right to arms has changed over time but actually that the 14th amendment has been expanded to include the bill of rights banning states from also violating those rights.

29:30 - A significant factor in all this recent seditious sentiment stems from allowing, for far too long, gun advocates to disseminate the seditious lie that the 2A gives them 'a Right to overthrow the government" - which is nowhere in the Constitution, neither enumerated or implied; or 'intended'. - There was certainly sentiment and ancillary writing about a 'natural' right to oppose tyranny (but the Declaration of Independence has zero legal authority [*]). There was also strong sentiment against standing armies (which is no longer the case, btw). The 2A is about providing 'security of a free State' via "A well regulated militia" of "the People" in lieu of the ubiquitously despised idea of standing armies. Had the intent been as often suggested, they could have included that intent in the language that was proposed, debated, and codified.They did not. "Rising up against the govt" did not carry the 55 delegates. Having a militia instead of a standing army for the protection of (not 'from') the state did (according to parameters defined in Article 1 Section 8 Clauses 15 -16). “A well-regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.” Again, there is definitely a 'natural' right to oppose tyranny. But 'natural' rights are not always the same as 'legal' and/or 'constitutional' rights. IF there is a constitutional right to overthrow the government, from whence do we have laws against insurrection, rebellion, and domestic violence? [**] - NOWHERE in our legal codes or Constitution does the government give you permission to shoot at it. If the Govt. becomes tyrannical then people must look to their 'natural' rights. The armaments needed would have to be 'obtained' (there is no right to stockpile and prepare for insurrection either) and the people can't possibly win an arms race against the USA anyway. Nor can "shall not be infringed" be literally true since an absolute right constitutes an absurdity, since it would inevitably conflict with other supposed absolute rights. Much like the 1A's, "shall make no law" doesn't mean there can be no laws against slander or creating false panics. "shall make no law" is every bit as stringent as "shall not be infringed" - but, again, no right is absolute, regardless of language [***]. (An absolute right also absurdly implies that Rights do not come with responsibilities) [*] - The Declaration of Independence was a revolutionary document throwing off the chains of monarchy. The Constitution is an anti-revolutionary document establishing a government by, and of, the people. To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions; ...To provide for organizing, arming, and disciplining, the Militia, and for governing such Part of them as may be employed in the Service of the United States, reserving to the States respectively, the Appointment of the Officers, and the Authority of training the Militia according to the discipline prescribed by Congress; Article 3 Section 3 - Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court. Article 4 Section 4 - The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence. 14th Amendment Section 3 - No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.

Where is she getting statistics about Canada? Canada has very strict regulations relating to guns. To get a gun(non hunting) you need to jump through so many hoops. And then there are regulations for owners. The way guns has to be stored/transported. I bet anyone in US knows at least one person who has gun. Isnt same for Canada.

@@A92_ The irony is that between the two of us you are the one who is willfully ignorant. The second amendment included machine guns and cannons. Famously there was a merchant that wanted to put cannons on a trade vessel because of pirates from the ottomans and moors. So he wrote a letter to the founding fathers to ask permission. The reply he got was "what part of the right to bear arms did you not comprehend?" The militia and the people are separated for a reason. it was to include the able bodied men who are the militia *(" , ')* and the PEOPLE meaning everyone else. There was no restriction based on type of weapon or on convicts. The restriction based on criminality came from the reduction on executable offenses. The reduction of capital punishment actually came from it being cheaper to keep them in a cage for the rest of their life instead of dealing with repeated appeals to not get executed. Well, that is a main reason.
