Not in my jurisdiction. 30 days after a judgement is issued, the landlord can demand the court enforce the judgement, send us out to supervise a locksmith locking the doors and Constable and or Sheriff will go to the home on a designated date and time and "sheriff sale" (judicial auction) EVERYTHING for yard sale prices up to the point the judgement is satisfied, even brand new cars are sold at yard sale prices. The ONLY thing that is NOT available for sale is wedding rings. Other then that 30 days after the judgment is issued, if the tenant has not satisfied the judgement, everything they own goes to satisfy the judgement, if the tenant owns a new bass boat, it will be sold for the highest bidder standing in the yard the day of the sale, if the high bid is 50.00, its sold for 50.00. EVERY ONE SHOULD LEARN THEIR LOCAL LAWS.

@@captainr.8882 - have fun if you buy any of those items that involve a title, the tenants almost certainly don't own them clear and the banks that hold the loans will fight to release their own liens. you may be able to buy for $50, but don't hold hope you will be able to use it until playing the legal games with the lender (ie: 2+ years in courts and legal fees you won't recoup).

This shit happens all the time. I am so glad I asked tenants to leave 6 months before virus. I became disabled had no job and had to live with a friend. My tenant actually had his girl friend move in with out me knowing it and she wanted to fight to stay there. Luckily they left pretty easily but their first reaction was to sue me. I was selling the place because I could no longer afford it. People can be super selfish. All I can say is make sure everyone is on a lease that is using the rental. People will be nice until they are not.

We had the same problem with a serial deadbeat tenant. She knew the system, I didn’t. 2 years of court battle after she bankrupted twice and paid an extra 25 a month towards back rent. She didn’t follow through with the 2nd bankruptcy and I was finally allowed to begin eviction. $10,000 later and a trashed house I finally got her out. We laugh about “thank God Rhonda wasn’t still our tenant during pandemic”. Live and learn. I had to mentally let it go because it was eating me up and told my husband that we are blessed and she will always be looking over her shoulder.

If you feel that human beings are trash, you lack the necessary compassion to be trusted as a professional provider of any survival resource like shelter, water, or food. This country has a homelessness crisis. Once you end up on the street it's harder to get off than it is to stay out of that position in the first place, so of course desperate people are going to squat homes. Do you want them to be homeless or to cost you some returns on your investment property?

I’m amazed that this happened at all. Every landlord in my area of California- not a nice area by any means, does a background check- no evictions, judgements or felonies. They also want proof that you make 3x the rent amount and have a 650 credit score. It’s almost impossible to rent a place if you are not a prime candidate, and at that point you might as well apply for a mortgage since you qualify and it’ll be cheaper than paying 1700 for a 2 bedroom

Been renting homes for well over 30 years. Would never rent to anyone with a prior eviction - never! You must always do a background check. Most people are decent, you just need to weed out the bad ones.

Normally I'd agree with this, but that is going to cause some serious problems whenever all these eviction bans are lifted. There's clearly plenty of people abusing the system, but that isn't the majority. Most people are behind a couple months, or have been making partial payments because they lost work at no fault of their own. When those potentially millions of people get evicted because landlords want all of the backrent paid overnight instead of working out an arrangement, there are going to be ripples. Perhaps waves. It's not going to be good.

@@sawyer4981 A wise landlord will try to work out an arrangement if the tenant wasn't one of those taking advantage. The expression; "You can't get blood from a turnip" applies. I can show you plenty of court judgements in my favor and very few that have ever been collected. However, those that did try to take advantage I will start eviction proceedings, win the judgement and have satisfaction that other potential landlords will be on notice as to the character of the tenant.

Currently renting from my first owner and he doesn't seem much better. It's a shame that a judgment against someone is, more often than not, entirely useless. The only guaranteed reward is knowing it will follow then for 10 years every time they have a background or credit check ran. It should be easier to collect in a judgment, but that's a story for another day.

@@sawyer4981 Don't get me started on Property Managers! I agree with your assessment from my landlord perspective. A tip for you in your dealings with your landlord. Make sure rent is paid and received the first day it is due. Do all your own minor repairs such as leaking toilets, clogged drain, etc. Be "out of sight - out of mind". The less he worries about you the better, and can rely on the rent check coming in. Tenants like these I rarely raise the rent except when my costs such as HOA, Insurance and property taxes increase. A landlord doesn't want a good and reliable tenant to leave.

Pretty easy to do, it's a shame some people have so many problems doing it. I've already replaced a good bit of stuff here and eliminated cigarette odor, but I've been waiting on the landlord to replace a broken window, screen & GFI outlet since I moved in about 5 months ago. Market's tough here right now, but he's definitely going to be losing me as a tennant if he can't at least fix those things by the end of the lease 😂

Your security deposit has NOTHING to do with other tenants not paying rent. Your deposit should have been held in a separate account and then disbursed once your tenancy ends ( minus any deductions for wear and tear). If your landlord gives you the excuse that they can’t return your security deposit due to other tenants not paying that means he SPENT IT ALREADY which is ILLEGAL. Take him to court.

Hey news 3 can u take my story. I'm in Naugatuck CT and not only did my tenant not pay for all of last year. She water hoards the property from the 2nd floor. And the house should be condemned. But she files appeals and somehow gets them granted. Even after a stipulated order. It's so bad that even CPS grants her the right & won't get involved for the health if her children. The mayor "Pete Hess"won't even act in my behalf. But yet I received a notice from him basically saying that I would be fined for not removing her trash. From the trash containers, even though it's public & I don't even live on the premises. And yes I'm what was considered a front line worker, that is being slapped in the face by Ned Lamonts pro criminal laws

how is she water hoarding? How many units, is water included in the lease as provided by landlord? Have they altered the plumbing? For the trash, is the tenant getting the trash to the curb for pickup? I mean there are hygiene standards you can announce a visit for pest control or whatever giving proper notice and film when you go in. If trash is all over the interior, look into the lease and report to child protective services. Cover yourself but there is nothing in the law stating you are supposed to visit their kitchen and empty their trash for them. If you find this is not happening, you pursue eviction. There is a difference between rent moratorium and living in filth.

I agree to an extent, I used to be a landlord - it is an investment that needs strict attention. Outside of that you are wrong. Nobody owes you free housing. It's not a "human right", houses don't just naturally happen and appear out of nowhere. It requires labor and investment of resources (ie. The results of your past labor). Other people aren't entitled to that. As a landlord I always required first month, last month and security deposit up front, no exceptions. If you can't come up with that then you can't afford my rental unit. Of course you do a proper background check, credit check, and employment check as well. When showing the apartment units I also was always there early and met the prospective renters at their vehicle with handshake greeting... But that wasn't why I was there. I wanted to see inside their car. Garbage everywhere, etc. in it = I won't rent to you. If you don't keep your own car cleanly then you won't take care of my rental unit. Yeah I'd show you the apartment but after you left I'd note not to rent to you for that reason. I did other thing as well but those are some of the big ones. Never had many problems in the 8 years I was a landlord.

In a lot of states the courts were closed for months. There was No one to go to. Some people believe when the Govt fails to enforce it's own laws/rules, You are free to use any means available.

That doesn't work in Illinois and some other states. Landlord would be a criminal and can be sued by tenants. Some states and cities are Pro-Tenants. It's a hard pill to swallow but tenants have the upper hand. 😔

Don't do a long term lease. Just do a month to month, it's better for everyone and you can get them out at the end of the lease if they are not paying - which is only a month. It's the year long lease that allows them to stay there.

Here in Waterbury ct, people call this, the Waterbury shuffle. They can literally only pay rent once every five months, because they move in, then stop paying rent, eviction takes three to four months, then they move and start all over again.

But it is getting to be too expensive now because of the house flippers driving up prices and the local governments raising taxes right along with the price increases. Us little people are caught in the middle and it looks like we are soon to be forced to sell out to the mega-property buying corporations. We are getting their offers to buy 3 times per week. We are considering selling to get this moratorium noose from around our necks.

I kept paying my rent up to the point when my Lease was up and then I left for Toronto Canada. It's a moratorium not forgiveness. I do feel for people who lost their job and couldn't pay whom the moratorium was for but these yoyo's who didn't lose their job and just took advantage of a bad situation should be criminally charged.

Indeed, landlord should have done due diligence! How careless. OR make your home a VACATION RENTAL, and be supported by the police to get someone out! Because tenants who are angry at landlords can do horrible damage and there is no recourse. Try to use the effective “vacation rental” protections if you are zoned for a vacation rental. In my property, the tenant laughed at me and said, “Just try to get me out. I will be here for years, then I’ll fill your toilets with cement.” I simply went to the police station, showed them my “vacation rental license”, police officers then met me at the property, knocked on the door and told the tenant they would stand there until he left!

This is disgusting because there are a lot of good people that actually lost there jobs and stressed everyday for over a year now keeping up on rent as much as they could. I'm a single dad that had to leave work when schools decided that it would only be two days a week, and all daycare closed or raised prices. It is going to take a very long time to come back from this.

It's going to happen, it's part of the business....Just as having squatter tenants is part of the rental business. I know it's frustrating, but those are the rules we must play by. You can kick them out, it just takes a few months.

I moved to a new 55 and older complex last year. Besides the normal information for a background check, my neighbors and myself had to provide current proof of income and 6 months of recent bank statements. I thought that was extreme, but it proved that I had been paying rent where I was living even with the eviction moratorium in place. Not sure what the law is and it may actually be illegal for them to have done this or illegal in some states. I had nothing to hide, so no problem. The neighbors are all great, we all get along and it was a wonderful move on my part.

@@nohopeequalsnofear3242 if landlords had no rights they wouldn't be able to evict a tenant for other reasons such as Engaging in criminal activity on the premises, Threatening the health and safety of other residents, Damaging or posing an immediate and significant risk of damage to property, Violating a health and safety code or regulation, Violating a term of the lease, other than non-payment of rent or fees such as late fees. I mean at this point most original leases would have expired and landlords are under no obligation to renew if rent isn't paid. If landlording didn't put money in landlords' pockets, they wouldn't be doing this anymore than investing in stocks after the times they've lost money in the market.

A tenant just doesn't stop paying rent and all is fine, can't be touched. There are steps that must be met to qualify for the moratorium protection, including signed paperwork. If there are landlords out there who don't even think of background checks before renting you can be sure they are also lost when a tenant stops paying, LL gets desperate and try stupid crap like turning off utilities or changing locks which is going to screw the landlord in court.

Not necessarily. Those tenant-checking places actually compare the reference's name with the name listed on the county tax rolls. If it's a mom-and-pop situation the names should match. Don't know what they do if it's a big corporation, though.

As a small landlord, I am very glad to be in Arizona. If a tenant is past due, I can give notice by posting it on the door of the unit. The tenant then has five calendar days to pay up. If he does not, it will take about ten days --- at most -- to get him out.

Landlord of 30 plus years here: you must assume the worst with all tenants no matter the due diligence you performed; keep your expectations very low. They will stick it to you with few qualms if backed into a corner or, as is the case here, the law allows it. You must stay on top of that game at all times, and you must be very proactive.

This is where I fault the federal and state governments. During COVID relief, there should have been an easily accessible and fast track to qualify for a payment system for those people that truly needed help, similar to Section 8 to pay the landlords for those tenants affected by the pandemic, and if the tenants didn't qualify (ie they really weren't affected), then evictions should have proceeded as normal. I'm fortunate that none of my tenants did that to me.
