The plaintiff is suing his neighbor after the neighbor falsely accused the plaintiff’s dog of biting him. When the neighbor took the plaintiff to court, the defendant never showed up. Now he is suing for lost wages. The defendant claims the plaintiff’s dog did bite him, and he owes him nothing.

@BobBlumenfeld

I've seen several litigants who firmly believed the video exonerated them when it completely convicted them - even after the judge showed it to them. I think there was a case year or so back where the defendant claimed the plaintiff ran into her car as she was backing out when the video clearly showed her backing up into his after he had already stopped (and, I presume, was laying on his horn.) There are none so blind ...

"Florida has a stand-your-ground law. You can't just walk up on us." That almost sounds like a threat, and I don't think being "walked up on" hardly rises to the level of justifying "standing your ground," that is, defending yourself with a weapon.

@@JeremiahLOsbornebecause avoiding killing or hurting people is a good idea, perhaps? Because people often see or perceive a threat where there isn't one? @JeremiahLOsborne

@@michelehemlokhexwhite4310 Don't get me wrong, I agree with you. I am all about peaceful solutions, first. But when the threat is immediate, and there is justification for it, this danger ground law needs to be there for people to defend themselves. I shouldn't have to escape my house from an intruder. But that's what duty to retreat laws would require. That's not fair to me. It's certainly not all or nothing, where any little threat justifies lethal response. It's a case-by-case basis, but the law must be there. It is a foundational principle of American liberty.

Oh, I remember one or two way back in the 2000s or early 2010s that might match it. One case involved a plaintiff who wanted the defendant to refund her the full amount of the service contract even though she had paid him only a deposit. Looked to me like she thought it was like a poker game, where the winner, whoever it is, takes the whole pot. I don't remember exactly why she was suing in the first place. And there was another couple who sued a repair man for the full price of a new washer AND drier because he didn't replace the door seal on their old drier promptly enough. The corker: the part was on back order. They justified it by saying taking their laundry to a laundromat was becoming too expensive. A more recent one (but still back there) involved a landlady who made life so miserable for her tenants that they literally fled and she could keep their deposit for breaking the lease. Not to just one set of tenants, but to several. Unfortunately for her they brought in as their witness one of the lambs she had fleeced and, I think, affidavits from several others. At first, she claimed she had never met the other woman, but then, grudgingly admitted she had. Judge Milian had a few choice words for her.

Later as I did my loop I was fortunate to see where the ladies lived as they were returning to their home. Also fortunate that the house the incident happened in front of had security cameras. I went over there and they emailed me the footage. I called animal control and sent them the video and the address where the ladies lived. Animal control called me back after viewing the video to say they were glad I reported it as many people don't when there is no bite. They said I could have the people be given a warning OR a $750 FINE! I chose the warning even though the woman was rude when I attempted to speak to her as they were returning home. She's blessed I'm empathetic. I like to give people the benefit of the doubt and treat them as I would want to be treated. I'd hate to get a $750 fine for a first offense.

Another a-hole weaponizing stand your ground. Statements like the one the plaintiff made more closely resemble premeditation than self-defense.

You can’t judge a book by its cover. Mr. Nutter seemed out together and well spoken and the defendant seemed sloppy but Mr. Nutter ended up being a total whack job.
