It’s not siding, prosecution have the burden of proving case and they are using prior cases to get things in. Just because defence says they don’t want it in doesn’t mean it doesn’t come in. They don’t want anything in that will hurt their clients.

A mistrial needs to be declared because of a procedural error by the prosecution or the judge, the defendant needs to be retried, because the prosecutor and judge acted in bad faith. In fact, if the prosecutor’s and judge’s actions were intended to goad the defendant into asking for a mistrial himself, double jeopardy may apply, this protects the defendant from a second trial.
