Isn't that unconstitutional? Charging money to access due process is essentially a denial of that right! It's no longer equal protection under the law! The Institute for Justice should take charging fines for innocence up as a case!

A privately owned company should have control of the body cams. When a cop starts his/her shift, the body cam should turn on and then off at the end of the shift.. The officer should not have any control of the body cam. Everything said and done by the officer on duty should be recorded. Also, make it a felony for the office to cover or try to stop sound recording. When you get body cams for your defense, it should have a complete record of what was said with a clear picture and sound. When you get the body cam footage, some things are blurred out with no sound. Would that not be the definition of tampering with evidence? Who knows what could be important facts that are needed in court. A supreme court justice couldn't make that determination on the spot.

Because courts charge defendants for their services. So do jails and prisons. Being tried and/or convicted is not a free ride. And if the defendant is guilty, it works - the problem is that it's a punishment for no good reason when the defendant is innocent.

​@@kevinsmith4814It happens, but it's not guaranteed. Cops often arrest people out of anger. This usually leads to a book and release. If you sue for wrongful arrest, the lawsuit is taxpayer funded and it doesn't help if your car was impounded. Qualified immunity shouldn't exist at all., 👍

No Lawsuit will happen. No Lawyer will take the case because this is how the Court will find... *Officers got a call from a citizen as a 911 call. *The Officer's arrived on scene to a possible burglary in progress. *Officers found a suspect who matched the callers description. *They approached and tried to detain suspect to question about the criminal activity reported by another Citizen who has the authority to manage with a limited reach of power over, the property with the consent of the original property owners. *The job of Law Enforcement/Peace Officers is to uphold the Law, capture criminals to be processed by the Court of Law and to uphold the Public's Peace. As long as whatever they are doing falls into that scope of that mandate then they are protected by Sovereign Immunity in the Courts not to be held responsible for the wake of a situation because they were doing their job with that in mind to UPHOLD the Law and KEEP the PEACE. So they are forgiven for any mistakes or damages that happen during the course of their duties. And the Court will find in favor of the State and they will be granted Qualified Immunity and therefore protected from litigation. A corrupt Judge will never find for the victim because if you hold Government Responsible for their actions that means that Judges and Politicians will one day be held accountable for their actions and can be held to US Code 18. They will NEVER EVER get rid of the King's 👑 Divine Protection to be held Publicly Responsible and be held civilly & criminally responsible for their actions.

If the security guard knows who he is, sees him getting into his own car, barefoot, holding a cup of coffee, with no tools for breaking into or stealing cars, and already has some kind of beef with him then it seems to me that he called the cops only to harass the kid. That's really what swatting is. The use of law enforcement as a means of harassment.

It also makes me wonder how the cop asked the security guard the questions. The guy said he looked in two cars that belonged to him then when the cop came back after questioning the guard, he said the guard said it was 3 or 4 cars. Did the cop ask a neutral question to get to the bottom of it or tell the guard the two cars belonged to the guy giving the guard a chance to make it 3 or 4 cars?

14:34 - This was my VERY first thought on the start of the video. He's barefoot, with a cup of coffee, phone in his hand and in a T-Shirt! he stopped and held up his hands IMMEDIATELY upon being challenged, and this was not mentioned by ANY of these officers because they KNEW it absolutely dispelled the narrative that they wanted for a wrongful arrest. Terrible policing and terrible supervision.

The victim should be reimbursed for his time, his missed work hours, his trauma, and for being roughhoused by "peace officers". Being arrested for doing nothing wrong is a nasty experience that will sit with the victim for many years. He was walking around, mentally preparing for work and was followed by someone who he knows has it in for him. The next thing he knows he is chased by thugs in uniforms who handcuff and kidnap him, holding him against his will. He is concerned about missing his work shift but is continually held against his will for absolutely no valid reason. What a complete nightmare for that man.

No proof but they can argue that with a description from a witness they at least had probably cause to detain, which doesn't on its own necessitate restraining. Remember, this is supposed to be an investigation but the first question they asked was "do you have any id?" Which was a minute and a half after he was tackled and put in cuffs. The kid asking why he's being detained did a better job of "investigating" than they did.

@@jerronmoone8243 that's irrelevant because at the time of restraining him, they had neither ID'ed him, nor run the plates. The side I'm coming from is what the courts have repeatedly upheld, in that police can detain if they have reasonable suspicion, and reasonable suspicion can be initiated by a vague description and complaint from a phone call. Dont get me wrong, that doesn't mean they can tackle and put him in cuffs (which is why that one cop said he turned a certain way, so they could justify that as an intent to run...in sandals yeah i know, just leave it because its mot important). Keep in mind he didn't have id on him, nor was he obligated to identify himself either, so that creates a bit of a problem, a sort of Mexican standoff. You don't have to identify yourself, but for the cops one of the quickest ways to determine your intent and standing is to know who you are. So at that point from the cops perspective they only have a guy with no id, and a complaint about a guy looking into cars. We haven't even gotten past the first 15 seconds of the video yet at this point of the "investigation," and there's cars, a guy, a complaint, and no attempt to make sense of the situation yet.

I was out walking last year in the early hours of the morning and the police stopped. The conversation went something like this: Policeman: morning. Me: morning. Policeman: out for a walk? Me: yeah, can't sleep. Policeman: well, I hope you get some sleep when you go back to bed. Me: thanks, cya. In my opinion, he stopped and had a brief chat so that he could recognise me if something actually DID happen.

I’m glad the judge dropped the charges but there should be no Court Cost!!! File a Federal Lawsuit against the cops and the judge!

The biggest problem I have with these situations is the fact that, even If the charges are dropped, the victim still has to deal with jail time or bail, costs, court, fees, and lawyer fees, even when they admit that they were wrong. It’s ridiculous that the judge dropped the charges but then made the victim pay the court costs. Every single situation like this, the person should be reimbursed for there, bail and court fees, and anything else associated with this. They shouldn’t have to file a lawsuit for those costs to be covered. Especially if they lose their job because of it.

He wasn't on the he was walking through the yards of his neighbors. He's a thief. I have no sympathy for thieves. play stupid games and win stupid prizes. But the police were still in the wrong. They didn't investigate a burglary. they didn't treat The suspect with respect. They just threw him to the ground. Everyone's in the wrong here.n

My wife works nights so we don't wake up till 3:00 pm. I don't get around to checking the mail box till 1:00 AM. I'm more afraid of seeing a cop at that time than meeting a criminal.

The way American cops behave, makes me think twice about taking a holiday there. There are far too many of these instances where people are basically kidnapped, threatened, tortured or worse for no reason. Sadly, it seems to be getting worse not better.

I have lived briefly at some apartment complexes and the like that do have rules against being out late and the like but I've never heard of them enforced in any way. I always thought of that part of the lease as a "Don't party and wake people up" rule
