this case was dismissed and the guy filed a lawsuit. the judge said he had no obligation to let them search and they had no legal right to because they ended the stop when they gave him the ticket. Lackluster did a video on this. edit: I made this comment like 15 sec into the video. glad we the people reported that.

This is an older story. The judge dismissed all the charges and said that everything after they handed him back his paperwork was a violation of his 4A rights. He’s suing.

“Furtive movements” sounds a lot like 4th amendment circumvention. They’re going to check only those areas where they saw the movement as if they have a 360 degree view inside your vehicle from outside your vehicle.

Honestly, if you do not have a criminal record, the police, judges and prosecutors try very hard to get you a criminal record, as once they get charges on you, besides them making way more money off you than most people realize ( do to the bonds issued on your charges ) after you get charges on your record then the next time cops make up charges on you its now easier to convict you do to you already look like a bad criminal with all your previous charges, this is how it works.

It’s scary how body cams saved this man from 33 years behind bars. Can you imagine back when this technology was not available and how many peoples lives we’re ruined based of police testimony. The man still lost a year of his life for no reason and if they turned off their cameras he would have been screwed.

@@CKills72 It just goes to show how smart the cops are in who they bully. They can railroad the poor into prison. There was a story a couple years ago about a judge feeding kids into a prison system because he got kickbacks. It was only exposed when they tried to do it to a white girl.

Before body cams these sort of cases got thrown out too. It all can come out in Court unless police all have their story together perfectly. A lot of times they don't even know they're breaking the law and will tell on themselves

The problem with that is that in a state like Texas you can be arrested for almost all traffic infractions. And your car towed to impound and there is nothing you can do about it but pay money. And police can make you get out the car. You have rights but you can be punished severely for using them. So in reality you don't have any rights at all. Except maybe the 5th but I have seen police arrest people for that too. Illegally of course.

They will approach your vehicle with the intent to remove you with violence, handed to them from the so called Supreme Courts. @@markmixon1121 we should only stop for the police in order to hear if a traffic infraction was committed, or if they suspect that you are someone they are looking for. when they cops answers no or refuses to answer the public should simply start driving off. If we all do this, they will have no recourse.

To that I say "it depends." Very often, I have talked my way out of tickets simply by being friendly and having all my paperwork in order. I'm sure I have saved myself many thousands of dollars using this method. However, there are situations that I would do what you're saying. If I were carrying a machine gun or a pound of mushrooms. Something that can't be found by dogs. In that situation the risk of paying a ticket(s) is far outweighed by the risk of being arrested for serious felonies. In that situation I would lock the doors and crack the windows and refuse to answer questions. But if I'm just driving down the street and have no contraband and have no risk of being arrested then I think it's stupid to break bad on cops because they just write every ticket they can. If you are carrying contraband that CAN be found by dogs, then I still believe that being nice and smiling and having your paperwork in order is the best method. Always remember the universal rule- ACT LIKE A DUMBSHIT, AND THEY'LL TREAT YOU AS AN EQUAL.

That’s what’s so ridiculous when people always say to comply and fight it in court. If it gets to court and it’s the cops word against yours, who do you think they’re gonna believe? That’s why body cams should be required nationwide and shouldn’t be able to be switched off or muted during or after any interaction.

He did. Even after everything his charges were all dropped because the cops the ended the stop and he was free to go, but then tried to search his car. You saw how they jumped him from both sides. He was actually in possession of drugs and stuff. LOL! IF they had been doing their jobs correctly and procedurally, they likely would have caught him without the results they got. Then again, he might have tried to run anyway. But the way the cops did it, he got off free.

@@raymondamoroso2049 illegally beginning a new investigation at the closure for the reason of the stop. “Here’s your ticket. Wait a minute, i smell weed, we gonna get a dog out here now. We gonna search your car”. It resets the timer on the stop. One state specifically got slammed for this illegal move recently. Dont remember which state.

Well that's strange I have not once had a bad experience with any police not one and I have dealt with alot. It's the dumb idiots who resist and be clowns. I also no alot of officers who have saved many lives.

You know about "Miranda". "Anything you say may be used against you in a court of law". You are best advised to say nothing without a lawyer. Cops are taught more about how to trick you into saying something that gets you detained or arrested than they are taught the US Constitution or their oath of office. It benefits them more to trap you. The constitution is to protect you. Also Qualified immunity was dreamed up by our Supreme Court to protect cops. There is nothing in any legal US document about QI. QI is unconstitutional.

As soon as the officer started to question him, he should have said "Officer, I'll be happy to answer any questions in the presence of my attorney. I do not consent to a search of either my person, or my vehicle. I am now invoking my 6th amendment right to counsel, as well as my 5th amendment right to remain silent.". Then...say NOTHING further.

Legally you’re right but for your safety resisting is likely not a good idea unless under threat of severe bodily harm or death from the officer. Fight the battles in court, protests and ballot.

@@ky1ebetts That sounds great! But cops are not in this for transparency. That cop would review the video and use it to cover for any mistakes the cop made. They always do that now. Even with cameras they habitually lie on reports. Any citizen is described as “yelling” or some other totally disorderly thing, when in reality they were not.

This happened to me in Georgia.. the officer pulled me over for he said following too closely, although we never wrote me a ticket.. he immediately wanted to search the car, when I refused he held me for at least 20 minutes longer until a canine arrived.. and I was arrested and charged with possession of liquid THC in an e-pen.. 2 days in jail.. $1,500 and 9 month later.. I have heard nothing and was never given one piece of paper that tells me my charges or a court date

Get a lawyer to check it if a court date has been issued or they may issue a warrant for your arrest for failure to appear to court. Good luck.

The first movement excuse to search the vehicle falls on its face once you remove the person from the vehicle. Anything that might pose a danger to the officers is nullified by taking the guy out of the car. They can't claim that he might have been doing something that poses a danger to the officers and that's the reason they have to search the vehicle but once he's removed from the vehicle he can't do anything with whatever furtive movements he was doing cuz he's not in the vehicle any.

I was the victim of a speed trap. I was on a business trip and limit changed from 75 to 45 with no reduced speed up ahead warning. I slammed on my brakes as soon as I saw suddenly reduced sign, throwing both my self and my passenger forward but couscous not slow down in time. I unbuckled my seat belt to reach for my purse and almost ended up in jail. The fine was just under the reportable amount for my clearance.
