According to my understanding, the law clearly states a 40-60 ownership. 40% to foreigners & 60% to Filipino in partnership. Thus, if you 2 are of marital partnership, what's the problem. I think nobody can send you away, but for whatever reason problem occur, I believe you can contest your right by then.

40:60 That's for a Condominium. You can not own land in the Philippines as a foreigner!

You can own a condo as a foreigner but not a piece of land under your name.
