Yes vinyl, tapes, CD's DVD's are making a comback in part because of this issue but lot's of TV shows, movies, music and games just can't be found on these media, either they never got made or no one is still making them.

Even physical products are not immune to this. Take for example physical products such as TVs, speakers, or other "smart" appliances, you may own the physical product but use of the product requires a "End User License Agreement" to the digital component and that is under the very same kind of license that permits companies(like Sony) to remove your access to your digital library. Any smart device that requires an internet connection to function can and will be disabled by the manufacturer eventually.

I lost over 5k songs on Google that I have purchased. I was told there is nothing I could do about it. This is why I barely purchase anything anymore. Why should I if they are telling me I don't own it. Same for Steam games, I slow down A LOT from purchasing any games. I no longer spend $60 or more on games. I wait several years for them to drop to $15. This is why people don't see any brand-new games on my streams. I refuse to pay $60 for games, only to know that I don't own it.

If a company "sells" something to a consumer but does not secure the right to actually "re-sell" a copy of that item from the producer, then the company is misleading consumers. If you "sell" something to a consumer, it means that the consumer should own the rights to use that product for the rest of their life. If Sony "sold" something that they were only licensing from another company, then Sony didn't have the right to actually "sell " that item. That should be fraud unless Sony said up front, at the time of purchase, that the item will not be owned by the consumer, just temporarily licensed to them. (And not just have this buried in the Terms of Service.) The law needs to rigidly define the terms, "rent," "lease," "license" and "purchase" in this new, digital age.

Sell the rights, such that the purchaser's rights transfer. If you bought something, and you die, the rights to the object must be transferable to the estate/any recipients. Sony shouldn't be able to revoke ownership rights.

Like, seriously. If I cannot get someone to agree to something by speaking in another language, that they don't understand, while they're in a rush, then why is this any different? No one actually has the time or legal knowledge/means to hire a lawyer every single time they want to watch a show.

To be fair, many big games now cost hundreds of millions of dollars to make. The average cost of making a game, particularly a AAA game, is increasing each year. The real problem is that so many games don't seem like they are worth what we pay. Even $10 for a piece of junk game is too much, and some piece of junk games are being sold as AAA games with AAA prices.

NEVER, EVER, EVER buy digital multimedia. ALWAYS get the physical CD/DVD/Media. You can rip it, and put it on any device you own, no DRM. Apple iTunes/Music has ripping built in. You bought it, you control, and own it. Paying money for something that doesn't exist is stupid. Even though they "promise" you will own the license forever, this shows that you do not, and they are too big to fight. Also, you can sell or trade it later. There's a massive used market for music, movies, and games. If you don't own it, you can't sell it later. It's a scam, and they charge the same price, and in many cases more, for something that's vapor.

We as consumers need to move back torwards physical media, they are trying to eradicate the secondhand market. Because anytime anybody buys used the primary company loses out on another sale. If you buy a digital copy, you can’t resell, if your console breaks, those games are gone forever. With physical media, you truly own it and it has a resale value.

The company can also go out of business, leaving you stranded without your purchased library. Amazon has already been caught digitally modifying and deleting people's purchased media. When you own the DVD/Blu-ray (for example), they cant take those from you. Of course, there are disadvantages to this too. They can be damaged, or lost in a fire, for example, but I'll take that risk.

From a non-gamer stand point and I know not enough people will stand up to it, one simple move would put an end to it. Stop buying online only games that do not provide a stand alone hard copy that can be played offline. There is power in numbers and if only a million or so gamers/credit cards stop falling for it, they will be forced into change. Until then, all the complaining is for not and they will continue to take the money of those who hold no real conviction to make the change. I dropped my Amazon account for their stand on censorship about 4 years ago and have not been back. Yeah, maybe it didn't have an affect on them but that doesn't change my convictions and maybe one day others will stand up too. I unplugged from television "programming" 8 years ago and haven't been back. No antenna, no cable, no streaming services. Amazingly enough, the world has just caught up with me on the television programming boycott recently and a few of them are crashing and burning today. It can be done if you take actual part instead of just complaining about it but still give them your money and or eyes.

On gog you also dont technicaly own the game. The diffrence here is that gog gives you offline installers for most of the games ( some just plainly dont have one fue to the massive f u from publishers ). So if game dissapears due to license issue you can still install it if you kept the file.

Valve/Steam does the same 30% with a clause for developer that they are not allowed to post their game on other marketplaces for a lower price. That's worse than Sony - Sony monopolizes the playstation, but the developers have no clause that ties the price elsewhere. Man I just want games to have an offline/solo mode again. I don't expect a company to keep servers running for dead games, but give the few of us who genuinely still enjoy these games a way to still enjoy them after the community has moved on. I understand this doesn't apply to things like MMO or FPS games, games that require a community to play. But shutting things down like SSX 2012 was bullshit. I really enjoyed the SSX franchise, and the 2012 version was incredible, especially with the wing suit addition. It played flawlessly. There was absolutely no reason for them to not include offline play. Even when you wanted to play solo you had to be connected to Sony's servers.

You're wrong, it DOES apply to MMOs and FPS games. If such a game doesn't allow you to play it after servers shut down, it's by design, not necessity. It's technically perfectly possible for the end user to host his own server regardless of the type of game. Also for SSX 2012 the culprit is EA, not Sony.

There's a lot of anti-consumer practices in the AAA industry that need to be corrected. Unfortunately these greedy corporations will NEVER willingly fix them. The only solution would be starve the industry of money until it goes under, and the AA studios and indie studios can work their way up, while making games like the golden age of gaming, instead of the lazy, unfinished, overpriced slop we get today.

While technically possible, the only way to keep an online only game like an fps working after the servers are shut down is to make players the hosts which comes with a wide array of issues, for example the host could simply cheat and nobody could do anything about it, if the host leaves the lobby goes down, and many more, there is also the security concern of the host having to open a port to his pc to complete strangers, which becomes a very big problem if a vulnerability is ever found withing the code. There is also the hardware problem since hosting takes way more resources than just playing, also the host needs perfect internet connection or the game becomes unplayable and he constantly has an advantage over other players since he has zero ping.

I started buying digital content because it was much cheaper than a physical copy, and in my country that can be expensive. 30% commission was not a problem because it was still a more affordable solution. Also, discounts are more often and higher on digital content. One thing is not being able to play old Windows games, but the second is losing the content which sucks. If they want to remove us from content they should give us a refund or an option to download the content and burn it to discs.

This would be difficult for some with how much bigger the games have gotten over the years. Plenty of games won’t fit in a disk. Even on an external hard drive, you are likely to fill it up with 10 large games. An option to refund would definitely be nice.

In terms of users purchasing their content, things have not been licensed forever. There was just a distinction between buying and owning copy and owning the copyright of a work. It just used to be that licensing was more limited to things like public performances, usage of one work in another, or other uses that would normally only be allowed by the copyright owner.

The Sony store is often times more expensive than games on disc in discount (Syberia The World Before is €40 PS store and €30 on disc). The idea behind download was that it was convenient and cheaper (no disc and packaging and the difference in savings split between two sides). Some games aren't even available online (Hitman).

At the very least, (in most cases on consoles) ownership of that disc, whether the full game is on it or not, is what grants access to the game, even if much of it needs to be downloaded. I can sell or lend that disc, and whoever has it will be able to play the game. I know Microsoft came close to changing this, and console manufacturers could start locking copies to consoles, but at least that hasn't happened yet.

There definitely needs to be players to protect the paying customer. If they pay for something, they should be able to own it without worry of it being deleted or expiring. In fact, I believe there should be an option for the customer to have a one-time download of a digital copy for games and movies on an approved hard drive or disc. Once downloaded, it cannot be redone or used for online purposes, which also means no updates if you buy something new. But at the very least you can have a hard copy of some kind that will prevent companies from trying to take away what you already bought.

They passed new laws (including the dmca for one) so that mere possesion of a 'pirated' copy or the tools to bypass copyprotection are a potential offense. Mentioning Steam in comparison makes 0 sense when Steam has multiple competitors, it will be thrown out and is just a waste of taxpayer money. If Steam charging 30% for game listing while devs and publishers push the cost onto the consumers was a problem, people would have flocked to EGS or GOG years ago. You don't need Steam to play PC games, there's tons of alternative ways to get games because PC is not a closed environment. Being better isn't their fault when they've been in the space for 2 decades. Sony on the other hand created their own system and forced people to only use that shop, there are no competitors inside their system so you are forced to pay ridiculous pricing. Them doing away physical discs, the only way anyone can argue it ensures cheap games, meant they are abusing the position to ensure their shop is the only place you can get games. That is lawsuit worthy.

Except Steam has nearly monopoly on the PC market EGS & GOG market share is tiny compared to Steam. Also, Steam prevents publishers and game devs from selling their games at cheaper price on their own store fronts or competing store fronts (EGS or GOG). Also, Steam take a 30% commission.

@@underworld3449 30% was standard, xbox in particular only changed their commission because they wanted to back epic games without looking like a hypocrite. steam being the biggest player in the industry and being a monopoly are two different things. technically correct, but they are consistent in their sales tactics and regulations of the platform, when gog isn't, and epic employs significantly more monopolistic tactics then valve. and if valve preventing a publisher from selling a game on a competing platform for a lower price is bad, then epic buying exclusivity so that there is zero option to sell the game on another platform should be considered a nightmare practice, without accounting for the existence of console exclusivity. your argument has been dismantled time and again.

I saw teenagers at the mall buying vinyls the other day. Physical media is definitely making a comeback. I've been blowing the horn on that since 2002. The moment Microsoft started using the Xbox and Xbox Gold to kill local multiplayer, I knew something like this would happen. There is nothing in there legal that says that games bought on sale with game pass will only be available with gamepass. Maybe there was a bug, did you ever reach out to Microsoft? Did you buy a physical copy of The Crew? The problem isn't digital vs physical, it's DRM vs no DRM. Granted, if you want to resell or if you're a collector, you'll always want the physical copy. But if you just want to have access to your content "forever", then DRM free is the way to go. Even if you buy a digital copy, download it and put it on physical media and then you have both.

The problem with "physical" copies of games anymore is that more often they're just an authentication key and you still end up downloading the game. IF they provide a disc, then the only real advantage you have is that you can sell it later (provided the servers haven't gone offline).

I started being more and more selective with my money, which is also a form of voting with my wallet. I stopped trusting and buying from sony, ubisoft and EA to name some of the bigger well-known companies. They keep getting greedier and keep imposing anti-consummer practices. At this point, investing time and money in these sorts of companies is just wasting money and burning neurones when they bend their clients over later down the line.

Bring back Demos. Allow users to download or buy physical copies for keeps. Get rid of pre orders. Everything in the game should be obtainalble through gameplay without taking years of your life. We would all be happier with just these few changes.

It's important to remember that the lawsuit against Sony (and the nearly identical lawsuit against Valve) isn't about any of the horrible practices they've undertaken against their customers, its just an argument that their 30% commission on the Playstation store (the standard market rate) is too high. They're not suing over digital ownership, this lawsuit has literally nothing to do with that at all. The crux of their argument seems to be that Sony "doesn't provide customers enough value" to justify a 30% cut of all PSN sales revenue. This argument falls apart the instant you examine the data hosting and bandwith costs associated with a service like the Playstation store alone, and that's before you factor in R&D and any other features that have been implemented into PSN as a whole. (hint: they're expensive to make and maintain, so not taking a reasonable revenue cut means you'll lose money off running the storefront). Additionally, even if these lawsuits win, it won't actually benefit consumers. Publishers set the retail price for games, so this lawsuit will only shift a percentage of the 30% cut that Sony/Valve takes into the pockets of game publishers like EA and Ubisoft instead of lowering prices for consumers. Overall, Sony definitely deserves to be sued, but this lawsuit is worthless. It's extremely likely to fail alongside the nearly identical lawsuit served to Valve (which makes the exact same allegations plus a few other even worse ones). I recommend just purchasing the game and rip it to emulate it, I recommend ripping a old game honestly because honestly, most of the new games are just corporate slop, if you'll want to get good games I recommend going indie stuff. They are fun. Or get retroarch. So you could gain your old titles of games or even emulate stuff you didn't play before like the dreamcast games (they are fun you should emulate em)

To be fair, I've know for years, that digital purchases are just licenses. Its nothing new. I'm surprised so many people are shocked. I mean, its one of the main argument points for digital vs physical media. I understand being angry about it, but surprised and shocked? Thats you're own fault.
