So if I’m brand new broker what factoring company will do business with me? I have reached out to 5 different ones and they all have crazy requirements for a brand new broker like 50k monthly cash flow and some want you to have at least 10 customers to set them up is there a specific factoring company that works with brand new brokers and is haul pay requiring you to do a certain amount of loads per month do they have a yearly contract you have to sign?

Excellent info! We were just scammed 2 weeks ago by an imposter that posed as a carrier, booked the load and then sold it to another carrier as a broker. It was EXACTLY what you said! He asked for 1/2 upfront or else he wasn't going to deliver. LSS, We lost nearly a $1k... sucks!

Even with strenuous due diligence, the fraudsters still get ahold of load info. The shippers are the only true line of defense. All shippers need to take one simple step....any driver who checks in for a pick up must be required to sign in with the brokers company name who tendered the order. If it's a scam, the driver will have the wrong name. My shippers have made this standard policy. Also, and this can be difficult for some... do not offer fuel advances or quick pay until carriers have developed an ongoing relationship of multiple loads completed.

I'm dealing with a situation where the carrier I hired to handle a load subcontracted it without authorization to a truck that wasn't listed on their insurance and had a different company name. On top of this, the load was delivered late with poor communication. Now, their factoring company is billing me for it. I don't want to pay, but I also don't want to damage my credit. What are my options?

Late load and poor communication unfortunately isn’t a good excuse to not pay…but an illegal contract with a carrier and no official load tender from you is. If the first carriers factor is billing you tell them that they double brokered the load and you are denying the bill for further investigation and litigation. If the second carrier is billing you request to see email communication with you and an official rate con. With some persistence you will be able to avoid paying either of them. A carrier that accepts a contract from a carrier illegally doesn’t deserve to be paid any more than the first carrier who double brokered it deserves to be paid.
