It is not specifically illegal , but some motorcyclists use the term as a licence to embark on dangerous overtaking manoeuvres which cannot be classified as filtering . To my mind , filtering means making slow but safe progress past stationary or slow moving traffic , usually at little more than walking pace , and absolutely always at such a pace that you can react to the unexpected such as a child stepping out from between two stationary vehicles , or a vehicle emerging from an entrance at the side of the road . if you cannot stop safely for any of these foreseeable hazards , then you ar going too fast ; it is not filtering but overtaking when unsafe to do so and by extension , dangerous driving .

He probably didn't see you until it was too late because the junction was blurred out, that's probably why you failed to see and anticipate.

I've played that video multiple times including at 0.25 speed. I think the biker seemed to be going too fast, whether or not he was actually speeding is of no significance if you're dead or injured. I gave up my motorbike 3 years ago, having ridden since I was 16 in 1963. So what do I know?

Well said . I never did advanced M/C but had already done IAM car and towing tests , plus League of Safe Drivers ( later ROSPA ) , and advanced police training , so just applied all the same principles to my riding . Always a worthwhile thing to do .

I had a similar spill almost 40 years ago , in fact the one and only time I ever came off my bike , on a road over the hills between Stirling and Kilsyth . There were warning signs for loose chipping , so i was going carefully , and on this downhill section with a sharp right hand bend at the bottom I could see all the chipping had been swept to the bottom of the hill and lying on the bend . I slowed right down to walking pace , but even so it was almost like ice ; my back wheel slid out from under me and I just let the bike go and stepped off it . Because I was going , at most , 5 mph , I lost my balance when I stepped off the bike and put my hand out to break my fall - that was a mistake and gravel went up the inside of my leather jacket , over my glove , and gave me some scratches on my arm . Broke my front brake lever and RH indicator but nothing more serious and easily fixed ; still enough of the brake lever to get two fingers onto and get safely home . I count myself lucky that was the only spill I ever had in seven years and over 100,000 miles of motorcycling . Only other incident was going straight ahead in the LH lane at Roseburn St Traffic Lights in Edinburgh , and this girl in a mini , waiting in the right turn lane , decided she was going straight ahead and pulled into my lane just as I was passing , clipping my RH exhaust can - I stayed on the bike and stopped safely just beyond the lights . the young girl was clearly upset and no damage to speak of - she had a tiny scratch on her front wing as did i on my exhaust . I told her not to worry about it and just to watch out in future - all very amicable and we parted on good terms .

That is why you should NEVER overtake at a junction ; that is entirely the fault of the motorcyclist ; the video does not show conclusively whether signalling was or was not done , but it was simply NOT an appropriate place to overtake .

The motorcyclist was not stationary ; however the camera car ( presumably the taxi ) cut across the corner and struck the motorcyclist , so entirely the fault of the driver . The rider certainly did nothing wrong and had no chance to avoid the collision . The camera car also appeared to be going quite quickly , although wide angle dash cam footage can be deceptive . I hope the motorcyclist recovered .

That was not filtering ; that was overtaking when unsafe to do so and dangerous driving . Filtering is careful progress past queuing traffic at no more than walking pace . Those two riders were flying past at excessive speed and had no chance of avoiding if a child had stepped out from between any two queuing vehicles . Motorcycles do not have any special privilege to overtake where it is unsafe to do so . Nor do pedal cycles .

it is great that none of this very positive story was about blame , but all about the fantastic recovery Konrad has made thanks to our NHS emergency response and to the modern prosthetic technology that is now available . I wish Konrad every success in the future , and this is in no small part due to his positive outlook and optimism for the future . I wonder whether transplant technology will ever reach the stage where severed limbs can be transplanted with donor ones ? I know that in some cases severed digits etc can sometimes be reattached , but entire limbs from a donor ?

@@TheKrimzonGuard How do you know that ? The video does not show the car until the rider is on top of it , and from the angle , the bike was probably hidden behind the nearside B pillar - something the biker should have been just as aware of as the blind spots on a large lorry .

Bikers can , however , take it for granted that they are more vulnerable , and will almost certainly come off worst in a RTC . I have had to deal with some quite unpleasant things in attending incidents over the years , including picking up what appeared to be a helmet and finding a decapitated head still inside it !

This happens all the time, 50% caused by the bike speeding. The other 50% you'd think the bike would ease off the gas and prepare to stop...sometimes they do. Remember if you're speeding it's your fault the car didn't see you. Simple but many riders oblivious to this

@@TheKrimzonGuard Rider probably wasn't speeding - it's a 60 zone. In any situation where the speed limit is 50 or 60, all junctions and side roads should be treated with caution - they're all an opportunity for a bad accident due to someone in a car not seeing you

“If you’re speeding it’s your fault” except in 99% of cases where it’s not. Even where someone’s speed is “grossly excessive”, it’s still not 100% their fault.

@@TheKrimzonGuard the camera only shows the car when the rider is virtually on top of him ; if the rider did see the car earlier then he ought to have exercised caution or slowed down until he had positive confirmation that he had been seen ( eye contact ) ; with the angle of the car , it is quite probable that the bike was hidden behind the B pillar ; bikers should be aware of blind spots and react accordingly - it is their own lives which are at risk .

Despite replaying that video several times , neither the car nor the junction can be seen until the car is halfway out across the road and the bike is bearing down on it at high speed . Rain on the camera lens does not help , but the junction is hidden and drivers are not , nor should they be expected to be , looking for people arriving at inappropriate speed . All the same , I'd expect the rider to be able to see more than the camera did and not to leave braking to the last moment , at which point it has to be applied hard - not good in wet weather conditions . I am an advanced driver , former instructor and former motorcyclist , also still a current emergency response driver . When I do see drivers sitting at junctions , and these include motorcyclists , I am always looking for eye contact , and if not forthcoming , I am already slowing until I know for sure they have seen me ; this has saved me on multiple occasions from situations like the one depicted in this video . The built up area and speed limit signs were visible long before the emerging vehicle was ; I'd have already been slowing down to enter the speed limit without needing to brake . There was fault on both sides in this incident .

I think the car was visible from much earlier than it appears on the video - there appears to be a blur effect over where the car is up to the point you mentioned, when the car is halfway across the road. Possibly the blur used for the registration plate? I don't know why it would be present so early in the video though

There was no fault on the motorcyclist. It’s a national speed limit road and the biker was going at a speed from which they could stop in the distance they could see to be clear. There’s no evidence that the biker was speeding, but even if they were, that doesn’t excuse the car driver pulling out. The car driver didn’t look properly or they would have seen the biker. We can see the junction for at least 4 seconds. I say this with over 5 years of experience of deciding liability in motor claims.

I'm not sure if my perception is skewed, or maybe it's lack of detail, but it seems at first glance that this is a much bigger problem on UK roads than it is in much of Western Europe? If that is the case, surely there are lessons to be learned?

Haven't looked at the data. However, if the data is incorrect at point of input or analysis, then everything else from that point is flawed. I think there are also cultural differences across Western Europe. FEMA would be able to comment better than us.

There is certainly a much more cavalier attitude to driving in this country than , for example , in Germany ; but i suspect that is a cultural thing since Germans are in some ways more disciplined and regimented than we are .

Remember Lynn and Me having that stationary spill at the junction of Tweedsmuir and the A701? That road was in a shocking state with loose gravel and no road markings due to the timber lorries constantly scrubbing the tarmac with their tyres. Hope Bryan is okay. Good work all at MCL Scotland. 👏🏻

People can , and do , suffer horrendous injuries in every mode of transport that has ever been invented : I have attended fatal RTCs involving bicycles , motorcycles , cars , vans , buses , as well as trains and aircraft incidents . You can die or suffer serious consequences no matter what you do .

Never too old to learn. I'd recommend carrying a small piece of of "Magic Eraser" foam, wet in a ziplock bag for visor/screen cleaning, works incredibly well for removing road grease in the winter and dead flies in the summer, without scratching.

Watching the video there is no reason they shouldn’t have seen the rider but if they had taken the junction probably we wouldn’t be having this conversation. But so many of us cut junctions,corners and roundabouts and the majority of the time we get away with it. I hope the rider has recovered but having MLS in his corner will have definitely helped. But having a accident where you get hurt and it’s no fault of yours definitely stays with you

Someone was very lucky 🍀 there’s Video footage. But though it’s great you won the case I see faults on both sides first of all yes the Tractor drive didn’t indicate his intentions but he should have also checked in his mirror if they were clean on what was coming up from behind. But not sure about other rides I wouldn’t have over taken there simply because of the junction just glad no one was killed
