Tractor collides with motorcyclist at junction

A tractor and trailer fail to indicate and turn right into the path of an overtaking motorcyclist at a junction.

Someone was very lucky 🍀 there’s Video footage. But though it’s great you won the case I see faults on both sides first of all yes the Tractor drive didn’t indicate his intentions but he should have also checked in his mirror if they were clean on what was coming up from behind. But not sure about other rides I wouldn’t have over taken there simply because of the junction just glad no one was killed

Indeed. However, tractor was not indicating at all. We were able to win this case.

@@MotorcyclelawscotlandCoUk Indication or not is not culpability ; a bulb could have been out ; if biker was not sighted to driver then no need for a signal , as taught in advanced driving , applies . It is absolutely wrong to overtake across any junction for precisely this reason and biker was 100% in the wrong . He is lucky he seemed to step off without injury . What warning did he give of his approach - if none he failed on that as well .

That is why you should NEVER overtake at a junction ; that is entirely the fault of the motorcyclist ; the video does not show conclusively whether signalling was or was not done , but it was simply NOT an appropriate place to overtake .
