One major impediment to my mediation with my ex was our family court judge. For 2 years during proceedings, the judge kept rubber stamping the mother for custody while ignoring the facts of the case and ignoring the best interest factors for the child. During mediation, the mother would not even settle for 50 custody because she kept saying that the judge was only going to rule in her favor. The judge gave the mother all the negotiating leverage she needed. I refused to settle because it was not in the best interests of our child for the mother to have custody. We went through the trial and after more than 3 years I got primary custody. I am glad I did not settle because it would have been in the worst interests of our son for the mother to have custody.

I had zero visits for 18 months, followed by zoom for 3 months, moved to therapeutic supervised for 2 more months, now I’m at unsupervised every other weekend with the plan to move to overnights in the near future. It’s been awful. 8 attorneys, 3 judges, a GAL, a therapeutic supervised visitation therapist, three individual therapists for the kids, a parenting coach for my ex, two cps investigations, criminal allegations, etc. Don’t give up ever, even if it’s crazy to keep going because you’ll always regret it.

My soon to be ex is not budging when it comes to trying to come up with a parenting plan. We even had court ordered mediation and he told the mediator he refuses to compromise and just wants to get sole custody

How did things turn out? I'm going through something similar and getting ready to go into mediation with a man who wanted nothing to do with our child for the first several years of his life and has only been in his life 50% of the time for the last two and a half years and he is lying his butt off about the custody he's actually had and he's trying to get sole custody. He had threatened me on two occasions to take me into court if I wouldn't give him more time than what he already has which is 50/50 and I actually ended up filing on him. The thing that's going for me is that I've got all the proof to back up why I brought the case in the first place so and plus he has lied several times including light on an affidavit under oath and I'm going to bring that to the attention of the Court. But I really really hope that things worked out for you and your child

I'm going through this myself at the moment. With my narcissist ex fiancé for 11 years, engaged for 3 and a 8 month old daughter. I called out her Narcissistic behaviour towards my mother. I've offered mediation, supervised child contact, I pay CS and I'm on the birth certificate. Now I look forward to spend thousands in defending myself from her lies. I march on

If I knew how evil my bipolar ex and his helicopter parents were going to be when I amicably separated and then divorced my ex. . .I would probably not have done it. He promised me the custody and the house, staying out of court. So I agreed to no alimony and no court mandated child support. Within a week my house, owner financed by his parents, was threatened to be foreclosed, and the CPS was being called for bogus things! 9 unfounded cases, 2 preliminary protective orders and $25,000 later I am still trying to get my kids back. . .because I settled. I considered all these things mentioned, and I was as nice as could be, playing into their hands with talking to the CPS, taking the parenting classes, doing the counseling, psych evaluations, guarded visitations, etc. I gave up my custody so I could see my kids, and not have 6 months pass with no custody or visits. I had no "review",and when I was cleared, as I always was, the judge said "too bad". You already gave up custody. There was no way out without a change of circumstances. I already knew I was screwed without alimony, and barely scraping by, but my ex did everything possible to hurt my business and make it impossible to even go back to court. So looking back. . .there is no way I would have sacrificed the months of no visitation for 8 years of no chance of custody!! NEVER give up on your kids!! I was given terrible counsel by the GAL, and my lawyer! There is no potential of getting custody back easily when you give it away under duress and they knew it I suspect, but they were just trying to get out of work. Yeah, I had no money, but knowing what I know now, I would have done something before giving up my rights!! My children feel betrayed and the system betrayed me. There is no justice in the justice system I have found!!

I have a similar situation with the first question, i placed my son in another school district 30 min away where I work but planing to move there. Our order say that the child will go to the school where the mother resides. We both live 30 min away from each other. Court is in less than 2 weeks. What do you think I need to provide ? We split the week right now and he has been late 8 times already

The day before our custody hearing we were sitting in our attorneys office doing last minute prep and his secretary came in and said the Judge had an emergency and had to push it off. That was September 12 and it was pushed back to December 13th.

They use the excuse of backlogs of petitions and work (which is true) yet the higher ups have the power to conduct weekend court and various methods to speed up cases. Some (including myself) assume this is strategically done to drag the process specifically for non custodial parents whom temp support orders are made out to.

Heard that a priority is leveraging a Parent Coordinator, especially with a Narc. Lots of authority in their credibility, including a MH Eval of the Narc to level the playing field? If refused, they can exert Parental Rights Termination? Accurate?

From my personal experience, do not continue to reach out. That becomes harassment in the eyes of the law. Retain, screenshot, copy all text and calls that were made (specifically text that has time stamps). Save them on your desktop or laptop and also a email if damaged. Turn all evidence over to your attorney or submit to the court via discovery process. This will help prove that parental alienation has been taking place. *Not legal advice just based on experience and what I would do.

Everyone saying I shouldn't be angry about my child and I definitely shouldn't be angry in front of the judge or I'll be in contempt how much sense does that make???? That I could get contempt of court by being angry and saying some words out of anger, and pissing the judge off doing that giving him a temper just over words.... So it's okay for the judge to get mad and have a temper over something simple as words but it's not okay for me to have a temper about you taking my kid away 🤯 I'm mad because you took my kid away so I need anger management but you get pissed over just words nothing else and don't need anger management hmmm

This is not true, courts examine both parents and decide the best from there. They do prefer younger children to have more time with one parent, for sake of routine.

Rights are realized that I to afford a lawyer now if I go with you sir will you tell me what I need to file and what I need to file as far as exhibits and evidence and what not. I know that I can do everything through a website. I know that I will save a ton of money filing the stuff electronic played rather than having a lawyer do it. I have a lawyer, but still bought the course, bc I'm in an extremely hostile high-conflict divorce. I could NOT handle my situation without an attorney, but I can tell you that I don't think I'd ever be able to do it alone without the help this course provides. It is a wealth of knowledge and simplifies everything so that you don't have to be an attorney to understand it. Idk what your situation is or if the other side has representation, but I'd highly recommend this course. I just recommended it to one of my best friends last night actually. If the other parent has an attorney, I would say you would DEFINITELY benefit from getting it. I cannot imagine going through this against someone with a lawyer without one myself... and I'm only at the VERY beginning of it all. Good luck!

Again.. i cannot attest to if it will do EVERYTHING u need or want to represent yourself, but I'd be terrified to do it without it if you are looking at a potentially challenging situation with the other parent. If you two are amicable and can work together and what not.. u might not need it.. idk.. but it certainly won't hurt!!!

I think they'd take it all the way to trial. They don't want to work with you or do what's best for the child. They want to win and for you to submit to them. They make everything difficult even if they suggested something and you agree to it. They'll change their mind to make it difficult.

Majority of Narcs will take it to trial. Settling is not a option for them because they feel like they’re submitting to your demands or wishes. With that being said sometimes the court (mediator, support magistrate or judicial judge) gets a whiff of this and acts accordingly. If the court doesn’t catch on quickly enough, then your attorney and your job is to gather all supporting evidence that helps your case while maintaining whatever temporary support or orders are in place.

accusations for drinking excessive alcohol are very cheap and meaningless. what is "excessive"? This is usually pretty subjective. If they are truly "alcoholics" imo even that isn't enough for losing custody unless there is proven domestic violence. But then the issue isn't really alcohol per se, it's the domestic violence. Alcohol is legal. The fact that a parent drinks doesn't say anything about their fitness.

Custody should automatically go to the fathers and then go from there. Mothers purposely keep the father from the children’s lives. Super bad for the children. Most fathers would never do that. They understand the children need mom and dad

Jen’s. The problem is the kids usually go to the parent who’s less fit to raise the children. If the father is a great dad and has his finances in order and has a nice home for the kids that will all be used against him to give to the parent who hasn’t made good choices
