Agreed. I wonder whether Phillips has the vision to see this through. He should follow the B12 path and not the PAC 12. B12 lost their biggest brands and are still going. I think the court reduces the exit fees and grant of right fees as unenforceable penalties.

I paid attention to Phillips comments and he made me think Hotel California. “You can check out any time you like, but you can never leave” Basically the ACC, ESPN and all the schools will be happy together until 2036. He is living in a fantasy land if he thinks ESPN, Clemson, Florida State, and perhaps most important Judge Cooper in Leon County agree with that.

The easiest way to settle this would be to open up both the ESecPN contract and the ACC GOR and just see what they say. The ACC has a reputation of not speaking the truth when it reflects badly on them. They could settle this now without costing either side a lot of money for attorneys and without a possible payout to Clemson (and possibly FSU) but they want to hunker down and hope it passes. Commissioner Phillips is ineffective as a commissioner and should be fired. He would rather burn the house down than settle with FSU and Clemson. He is not looking out for the ACC as he claims, but instead is looking out for himself and his reputation. Although I can't think of any conference that would want to hire him after his performance. As an aside, what is Happy Trees University and where is it? It sounds like someplace I would like to go. And yes, the rules are different in Florida. And we like it!

How exactly do you propose that a conference with TV ratings half that of the Power 2 conferences is going to negotiate a media contract that is near equal to the contracts of the P2. Explain that to me.

@elliottcrews4997 | Glad you asked, it's called: 1. Don't extend an outdated media rights deal in 2021. This is plan idiocy. The rates are from 2016. That basically ensured that the ACC would have 2016 rates in 2026. 3. Don't join an "Alliance" that doesn't serve your conference members. Jim Phillips willing places his teams behind the 8 ballv with this ignoramus decision. 3. Be proactive.. not reactive with regard to conference realignment. When tht PAC was having issues securing a media rights deal, JPhillips could scooped up the top 4-6 brands and made a west coast wing. Instead he pussy footed n picked up 2 of the worst football brands on tht west coast. I would rather have Oregon UW instead of SMU. 4. Create a tier system that rewards ACC teams based on tv viewership, program investment $$$ and on field performance. The issue with half of the league is, they don't invest dollars into football but receive way more from tht tv deal. They are not incentivized to be competitive in football. Instead you have programs like Syracuse Duke & UVA who redirect tv dollars to their basketball programs. 5. Listen to your money making programs, FSU & Clemson. Nothing moves or shakes in the B10 without OSUs or Michigan's blessings. That's the same things for the SEC and Bama UGA n UF. FSU and Clemson has earned the right to have the same privileges in thy ACC. Because JPhillips didn't listen, now he ain't have a conference. Easy... for your slow 1s in the back. I hope u are taking notes.

Hope it’s not that McKenzie law guy as special guest. He is a smart and successful lawyer and yet, completely ignores the major points of the case and just tows the line of “you signed it”. I feel he does this on purpose and doesn’t actually believe the cases are that narrow in scope.

@@elliottcrews4997 Judge cooper agrees it is an IP case and Bledsoe is treating it as a contract law case. I never mean to challenge McKenzie’s intelligence, but absolutely question why he ignores the entire case that Clemson is making that the actual media contract has an out that should be explored and ruled upon by a judge. No one serious is disputing that the contracts were signed. There are questions if the ACC had misrepresented or misinterpreted the media document explicitly tied to and referenced in the GOR. Who is right? I don’t know, but a judge should make that decision. He refuses to acknowledge this

The contracts have existed for many years and accepted as what they were presented to be until a few schools start a desperate search for a free or cheap pass out. Sure if they magically find that the commissioner outright lied to the member schools that could turn things on their head. But this isn't an episode of Perry Mason. That type of thing seldom happens.

My only caveat would be if the exact statement that Clemson’s believes to be present in the media document turns out to be true, the exit gets a whole lot cheaper. Problem is that no casual fan knows what is true and what isn’t yet. Just have to wait for the judge to rule on it. It is absolutely looking for a cheap pass out, but it is also the basis of their entire lawsuit and not just a side allegation like the Swofford stuff in the FSU case.

Phillips comments sounded like commish speak. Maybe it’s a true opt out clause. Maybe the look-in is working on numbers for various conference alignments. UNC had an open and closed session board meeting today. It’s expected the closed session would include talk to move the ball about leaving. The interim chancellor showed support for Cunningham after he took some arrows this week. More people have said this week that they need to move to get more money. There was no audit talk during the open session today. The board chair made a comment in the last meeting about talking about the audit in a closed session. Someone filed a complaint in Orange County yesterday saying that would violate the open meeting rules and the board chair started the meeting today to “clarify a misunderstanding” and that campus security and legal counsel type stuff are the only things that can be discussed in closed session.

Thanks for another good presentation. I think it's important that Phillips reinforced what the various member schools have quietly been saying for months, that they are confident that the ESPN media deal is going to run through 36. The details they were working out internally with ESPN during the look in might well be about the tier 3 content, TV scheduling, benchmarks, a 9 game conference schedule or something else that has nothing to do with an opt out.

I like your take although it is from the perspective of those schools that "they are confident that the ESPN media deal is going to run through 36". Those schools are the ones who have been sucking on the FSU and Clemson teats and contributing absolutely nothing to the conference. They are the reason the ACC is viewed as a lesser conference. We shall see what happens in the near future with UNC and the FSU refiled case.

Phillips is just doing his job. If what FSU is saying is true, ESPN is not renewing their deal with the ACC without knowing what is happening to FSU and Clemson. ESPN can't risk extending now knowing for certain. ACC is playing chicken
