No doubt he was bullied, no doubt he was harassed, no doubt of pack mentality behaviour that put the accused in a position of self-defense and there is no doubt that bullying/harassment caused the escalation of this crime. The accused is not guilty of murder he did not go out there with an intent to kill anyone. This case will come down to self defense and whether the jury believes the actions of the accused were reasonable/not excessive or unreasonable and excessive after reviewing all of the evidence. In considering a self defense plea what will be most scrutinised here is the accused's actions after the fact and the jurys decision will come down to how they view that. They may consider a lesser charge of manslaughter based on the evidence. Laws are certainly flawed and right or wrong it will all come down to this. The best that can come from this case is that it is used in schools to highlight the dangers of bullying/harassment. Further awareness of these toxic behaviours needs to be taught in schools and at home.

Just curious how consistent you are and what you think the implications of your claims are, or should be. This "innocent" man started striking people he was having a verbal altercation with. When someone hit him in response to his unprovoked attack and started stabbing people. Alcohol may have been part of the equation, but the KNIFE and intention to use it was the crucial element. Without the knife this would likely have played out like thousands of verbal -- even physical -- altercations play out in America and elsewhere every year: people get insulted, even bruised, but they all walk away alive at the end of it.

And if I heard everything correctly, it sounds like a heart health-stricken Nicolae didn't resort to a bladed-weapon until after Maddison both became physically aggressive AND was waving her fellow companions over (who at least some of which turned out to have a similar demeanor as her). And it certainly didn't help being trapped from some other direction by the teenagers. Lastly, although lying was counterproductive, perhaps that could be a whole seperate charge. Regardless, being so well outnumbered by people whose judgement is questionable...(both opposing parties of the defendant's), it still seems just to grant him something of leniency here too...less than his seeking of a knife, but still something of significance.

They were being verbally disrespectful, but there's zero evidence that they issued any verbal threats of violence, and the violence done to him was not life threatening and was in response to his physical violence. Even after he started stabbing people, nothing they did threatned his life. He could have walked away at any point (and did, eventually) but chose to escalate, eventually to a deadly degree. It doesn't seem like anyone is being their "best self" in the video evidence, but the idea that you would allow a person to get away with a stabbing spree because they'd been insulted by people who posed no clear physical threat is not compatible with a civilised society.

At no point was deadly force implied or explicitly attempted against him, so the claim that deadly force being used by the defendant was necessary for "self defense" is not credible. The defendant was the person who started assaulting people, and the only person to attack anyone in a life threatening manner. I don't know if what he did meets the criteria of the specific charge, but it's insane that anyone would be allowed to get away with stabbing 5 people -- killing one -- in a verbal altercation where they were not trapped, or pursued and their life wasn't threatened.

The prosecution is good. He should not have testified. I am leaning towards guilty. He lied multiple times. Even at 1:25:20, he insinuates that knows he stumbled because he has seen the video now, then at 1:32:30 he claims to have remembered stumbling. The police video is damning, he looks completely calm in it. The teens may be been loud and rude, however, they did not approach him. Did not make any attempt to move towards him. Did not throw anything at him. Showed no aggression initially. He willingly entered their zone. He did not communicate at all while being in close proximity to them. Then pulled out the knife and made contact with the woman, at which point he was pushed. I would even go as far as to say that the teens did not treat him that badly. Just pushed him and gave him a slap, not even a punch. There are way worse street fights being posted daily online (Remember Rihanna's face when Chris Brown beat her up). If he had not had the knife, he would have left with just a bruised ego. Instead he stabbed multiple people and killed one person. Then he left the scene, continued the activities, lied to the policeman when questioned, and made up stories to cover up what really happened. I think he got embarrassed when the kids surrounded him and started pointing at him and shouting. Some people react badly to losing face. And this may have been the first time in his life he got put in any escalated situation. Maybe it can be argued that he panicked, honestly, he acted oddly from the very beginning (If somebody ran up on me like he did at the beginning I would immediately be put on defence). At all times he had the option of leaving. He chose to escalate. Stabbed people, killing one person and went about his business like nothing had happened. I don't believe he was panicked, I believe he got embarrassed which quickly turned into agitation, anger, and clouded his judgement. A person who is panicked and convinced that they are in danger and are defending themselves would be trying to reach the police first. If he had attempted to leave and had been pursued, and if he had called the police and told them what had happened and not made up stories, he would have had a case. The kids seem like douche bags (or simply teens), and he seems like a nice quiet man, but don't let appearances distract you from facts.

They then pushed him again and when he got up, Madison slapped him. Those kids were reckless bullies, and while nobody deserved to die over that, this man was frightened and overwhelmed. He’s not blameless by any stretch but he’s certainly not a murderer either. These kids own plenty of accountability, yet were held to none. “Plain and simple”.

I know a lot of people think he isn't guilty, but I think there are key things to consider. First of all, he had multiple opportunities to leave the situation that was escalating. Secondly, when the two women are confronting him and trying to physically direct him away from the group while yelling, these women are unarmed. To pull out a knife and stab one of them, instead of backing up and saying he had a knife, is absolutely assault with a deadly weapon. The point about him holding the knife with the blade up is proven by the fact that he sliced the one boy's torso from bottom to top. He was clearly aware of which way the blade was pointed. This proves some degree of intention. The main issue here is that he was the first one to become violent. He is the only one with a weapon. He violated the personal space of the boys first by grabbing their innertubes and legs. He is smiling when he is holding the knife. So, it is clear that he felt emboldened to lash out with his knife. He killed a boy. He stabbed multiple people. This is an unstable man.

1) He was leaving the situation, until the "adults" came and made it worse. The teens testified they could have left, but didn't because they wanted to "see how it would play out". Instead of walking away, they continued to escalate. 2) These women willingly integrated themselves right into the heart of strangers drama without any context and blindly took the side of the people their age, all while berating and shoving Miu. 3) No one was stabbed until he was knocked down and assaulted. 4) Walking backwards is dangerous in a situation like this, if you trip and fall, the attackers can pounce. Also, considering the volume level from the drunk young men, he couldn't simply yell over them. Also, if they were not so inebriated, it would have been very obvious he had a knife. Everyone was too stoned, drunk, and belligerent to notice. 5) How do you know he was "clearly aware"? Considering the intensity of this situation, and how fast it all happened, I am not going to buy that. 6) Being the only one with a weapon does not mean that you're the first one to become violent. The "adult" women willingly made physical contact with him by shoving him. When he pushed her off of him, the drunk young men pounced. I think that he is clearly not guilty. Unfortunately, there are also people like you on the jury. So this will end up being a hung jury.

He walked away and came back to confront the teens. His “lost cel phone” is bull, and I do not doubt that he was using his snorkel gear to look at the youngsters underwater. If he was or wasn’t, he should have left as soon as his creepy behavior was called out. He stuck around and clearly wanted a confrontation with the teens. The slightly older 2 ladies were protecting Miu from what might have happened by his escalation. He attacked the ladies. Whether the teens were bullying or not, he chose to stay and confront them. You'll notice that after the first 2-3 times the judge would sustain an objection against the defense or overrule one of their objections, any time the defense or prosecution would ask to approach (which is where you're supposed to present your argument as to why you think his ruling was incorrect, NOT in front of the jury and cameras) the judge would almost immediately grant it. It's obvious that he just wants people to be respectful of the process and wants to make sure everyone is playing within the bounds of the law, he's done a very good job IMO. Also just to be clear, I personally think this guy innocent of murder and that this was a case of self defense

People will make any jump in logic to not feel responsible for their actions. The way those kids were acting was stupid af and they earned his response. Raise your kids better. Everyone needs to learn how to de-escalate. All they had to do was say they hadn't seen his friend's phone, and if he was still there and it made them uncomfortable, they could leave. If they thought he was trying to make them move, and that was annoying, they could have just called the cops themselves. They knew he wasn't creeping around. At most, he was being obstructive to their activities. That didn't merit the hollering or the mobbing, much less the physical altercations which the girls 100% started. Miu had the right to look for that phone. Miu didnt scream back or threaten them, nothing he did merited the physical altercation.

Sounds like you're hypocritically making any jump in logic to make Nic not responsible for his actions. There are all sorts of things Nic could have said to de-escalate things with the kids. He didn't have any sort of obligation to look for a phone that wasn't even his, in fact, it sounded like it was an excuse to get in the middle of the kids.

The cross examination is getting me so riled up, particularly when he keeps mentioning the females and the 115lb weight as if that makes her untouchable. I'm 5ft6, 114lb, and I'm strong. I've never been in a fight but I've witnessed plenty of girl-fights over the years, of shorter teenage female vs female, and woman vs woman... they can be vicious and pound the hell out of someone. Add booze and I wouldn't want to even be a 6 foot male up against a physically threatening female. This whole situation is messed up but considering many factors raised and seeing the footage, I'm not siding with the teenagers, and I don't blame this guy for defending himself when things turned violent towards him. This all happened so quickly, so chaotically, so unpredictably - were there other choices they all could've made, yes. Nicolae could've walked away earlier but he wasn't doing anything wrong. They had no right telling him where to go and what to do. They were all laughing while Nicolae seemed stunned and in freeze mode at first. If he yelled back at them at any point, good for him. It's not like he could've run away as it got more heated... try running in even knee deep water, knowing you've just had a quadruple heart bypass.

He's uber aware of the questions meant to establish elements of self defense (or rather, to eliminate that as a potential defense if he answers incorrectly). He only makes these responses at the right moments too and does not overuse them. "I was in fear for my life" "I had no reasonable means of escape" ... His lawyers prepared him well for this and that is why he is testifying

The two women touched him and were in his space. He did the same with the high schoolers. He says he is weaker than teen boys, however, he is stronger than the two young women. This defense is awful. He got into a public altercation with strangers and killed one and stabbed the others. He has no injuries. The teens and the two women carried no weapons. He did. He has consistently lied about everything - including he and his pals not drinking. You can't kill people who swear, drink, do weed or call you names. You tell aggressive men or women to stop touching you and you take the nearest exit to get away from them - especially if they are telling you to leave. I'm shocked at all the people agreeing with this killer. The judge needs to eventually tell us all the self-defense law and rule clearly.

No weapons other than the 54-year-old who killed a teen who would be about his son or grandson's age - and same with the young women. He's in his 50s and killed and mutilated young people. What kind of example is he? He didn't let the boy live till he gets to 50 and he couldn't ignore a couple of women telling him to leave the scene. He should have listened to them and gone back to his wife and not end up a killer on trial. Be an example as an older member of society and stop condoning unnecessary violence.

He now calls himself a dad to a dog. He said he stood his ground and refused to retreat and he had the opportunity to walk away. He is a killer and on trial for it. He could not be drowned in ankle deep water, and he admitted he just slashed at anyone around him whether they actually attacked him because he was scared. Legally, I can't see him going home and not serving time. Morally, he is in the wrong. You don't leave that kind of wreckage behind you, lie about it, and you could have walked away, and be called the innocent victim. He was healthy enough to swim and snorkel, and to attack a group of people and walk away.

In law it’s about proportionality. He didn’t even try to run away. In his eyes you can see the pure aggression boiling the whole time. He stayed in the situation because he was hurt by the things those teens said and searched for a reason to give it back to them. Why would you have a knife with you in the first place. If getting pushed in the water and receiving a slap justifies stabbing multiple people we have much more of those „self defense“ cases.

Oh they are all internal embarrassed and no they are just as guilty for the death of their friend and near death of the others they called over. They will have to live with the guilt and hopefully when this trial is over they can be scolded by both their parents and the judge in closing of this case. Hopefully they can also be sued in a civil trial by Mr Miu to again put them on the spot and prove that their lies and actions caused this event.

When I first heard about this fiasco. Thought bunch of kids harassing the old man. Now hearing about throwing away the knife, putting on hat, sunglasses, and shirt. Then tubing past where the incident took place and going to the exit passing the sheriff. Now I think he thought he was going to get away with it. Now that I see interviews where he said the boys pulled a knife and he turned it on the boy and another boy had a knife. He needs to be found guilty. Now finding out he was the only one with a deadly weapon. Yes he is guilty.

Meh. Don't really care what he did because he was afraid of tyrannical cops and America's busted-ass legal system. The attack happened before all the stuff you mentioned. Some people (as in literally millions) expect misjustice and corruption from American courts, so they try to hide instead. Not saying they're entirely correct, but you'll always fail to understand important perspective when assuming everyone should just immediately and calmly go to the police and explain everything honestly because they will always help and do what's best for you.

Self preservation! Trauma can cause a multitude of symptoms/reactions. For example there’s a video a a woman who somehow survived a horrific car wreck. The car was unrecognisable, her partner driving decapitated. In the video she’s still sitting in the car applying makeup.
