The trial of Nicolae Miu, the man accused of the fatal 2022 stabbing on the Apple River, began on April 1.
Karl Anderson and Brian Smestad are prosecuting the case. Anderson is the St. Croix County, Wisconsin, District Attorney. Their opening statement was presented with screenshots from the now infamous video of the incident on the Apple River.

I want to know why he had a knife in his swimming shorts. I grew up swimming in the river at our home. A knife is not something I would take. It’s obvious that he didn’t stab them. He stuck them and ripped them open! Unbelievable. He should rot in jail.

The kids were basic kids in a group. Nicolai, the SUPPOSED adult, should haved walked away back to his group. The rest were telling him to leave . They were all in inner tubes. It was a lot easier for Nicolai to just go back to his group. It was flat-out murder-1: a) He kept patting the pocket the knife was in and smirking. b) He never stopped stabbing people at any point. c) He did NOT try to help any of the people and at no point did he call 911. d) He then escaped with his friends and got rid of his knife somewhere he thought the police wouldn't find it. e) He lied about having a knife. f) He continuously lied to police about what happened. At no point did he act like an innocent person who was stabbing in self-defense. And I should know because I've done it. I was brutally attacked and used s knife in self defence. He does not act like a man who used a knife in self-defense. He acts like a man who murdered and attempted to murder multiple people and is trying to hide it.

​@@johnmathis1754- That's simply NOT true. This man flat-out murdered a 17-year-old kid and attempted to murder others as well. And they WERE innocent. Just because a couple of people in one of the groups (the teenage group) initially made some comments (typical boisterous kid shit you notmally ignore), doesn't mean they and the victims were not innocent. Only the 17 year old murder victim came from that group. The rest of the victims were from the older group of 20-somethings who I don't believe made any comments. But instead you damn all the kids/adults in 2 groups for the comments a couple of kids make???? Besides, I don't care what the Hell they said. He had a responsibility to walk away. He came up to THEM. He attacked THEM. It was NEVER self defense!! They didn't deserve to be murdered and severely injured. It blows my mind that you think some innocent kid who just happened to be in a group where some other kids made comments, that he should be responsible for their statements. But we don't even know who made those comments. They told him repeatedly to leave and he kept patting his pocket and smirking, and coming back. He certainly can't claim self-defense because nobody touched him and nobody menaced him, plus he ALWAYS had an escape. They just kept telling him to leave. If you think there are no innocent people here, then you are blind. I have had to use a knife in self-defense. So I know what that looks like. That is not this. This was a man who murdered a 17-year-old kid with forethought and attempted to murder others as well and they WERE innocent. He never tried to help them and he never called 911. Then he hid the murder weapon like any murderer would do. It's extremely easy to see who the innocent people are here: His victims who didn't approach Nikolai. His victims who never touched Nikolai or menaced him until he was attacking them (THAT is self defense). His lawyer lied just like he was lying to police. They never menaced him. They never pushed him UNTIL he started attacking them, at which point wouldn't you defend yourself??? The only time they got up to him, was to tell him to leave!!! And his lawyer saying that he fell and hurt his head . . . in the WATER is laughable. I'll have to try that one. His lawyer seems to forget that they never started pushing him until he was starting to attack and murder them. I also know what it's like to have the person who attacked me turned it around and actually blame me. Because a police officer didn't bother doing his job, and who may have had a previous maliciousness towards me because of my half brother... I was arrested for defending my own life in my own home against an unwelcome intruder who was high as a kite. The charges were dropped but not before it ruined my life.

Yes. I hope he doesn't blow it. It's MURDER ONE. The defense is good with no morals at all. That 3-part picture where they CLAIMED it proves that the murder victim tried to strangle Nikolai (in their opening statement), is actually the exact moment in time when Nikolai was stabbing him to death!!!!! That's why it is oddly cropped off, so you can't see the murder victim's body and you can't see Nicholas hands. I initially noticed the bizarre cropping and thought they were trying to hide something so I looked closer at the picture. And I noticed that the girl behind Nicholai was the first person he stabbed. And you can tell by the expression on her face and the way her body is oddly positioned, plus where she's standing, that that is the moment when she was looking at her side and realizing that she was bleeding and her face expressed shock. He was then immediately stabbing the murder victim (sorry, I forgot his name). To use that moment in time and cherry crop the portion of the picture they want, to say something was happening that wasn't happening, is really quite disgusting!

Yes, he could walk away, just like he walked up to them. In fact, the defense attorney at one point asked one of the kids, "You would agree that [the defendant] doesn't have any more responsibility to move away than the kids. Is that right?" The kid agreed with him because he didn't really think about it, but I don't agree with him. He had more responsibility to leave because, a) he was the one who came up to them. And, b) he's the adult in the situation. He's guilty of MURDER. The only real question is 1st degree or 2nd degree. I say 1st degree. I HOPE he doesn't get manslaughter, because he kept patting the knife and smirking. And he kept stabbing people after he stabbed the first one. He also kept the knife down with the edge up so they wouldn't see. And then he never tried to help any of them. He also never called 911. Then he left and discarded the knife. Not the actions of a man who believes he didn't just break the law. The boys only touched him in self defense, and defense of a woman, not the other way around.

The prosecution broke it down that way because those are all the things one must do to legally claim self defense. You have to actually take a defensive posture, announce or display that you're brandishing a weapon, and try to step away from the "aggressor." This fucking psycho just pulled out his knife like a katana and started hacking. He literally walked over to Khylie and shanked her in the gut after she had already stepped away. He murdered Isaac for trying to breakup a perceived fist fight. I hope this monster rots in prison.

@@user-db2kl8bj1jthose teens got the “wrong one”……after listening to the testimony specifically the oldest carlson (father) those kids picked a fight an lost….the girls were self admitted to being extremely drunk as in blackout drunk AND high on marijuana….. they screamed at him that he was a “pedophile and predator” without any justification and pushed him and surrounded him while taunting Mui……now I don’t agree with stabbing them…..he did some devastating damage to multiple people….but…THIS should be a cautionary tale…..don’t assume that because your young or in a group…..that you all will win the fight….and in fact you may just lose your life….

The fact that he pulled his knife out BEFORE punching that woman, genuinely makes me think he knew exactly what he was doing. I personally believe he was so fragile, his ego was so bruised, he couldn't take being bullied a group of rowdy, drunk boys, that he pulled his knife out, punched a woman, knowing that it would illicit a response, so that he would have an excuse to start stabbing people. That's just my take on the situation. In the video he touches his knife and smirks a couple times, it's actually really uncomfortable to watch. I'm all for self defense, I teach my kids to defend themselves, but the man threw hands first, and he had his knife drawn and ready to go before he threw the first punch. Then he held his knife low at his side, never brandishing it, never holding it up or making a threat, he just stabbed kids who thought they were in a pushing match/fist fight. Guilty.

WOW! The defendant acting like he was clueless about the situation being a horrific situation as HE KNEW what he’d done, he tried to get away by a disguise and played it off as I guess I look loud the guy who did it. I’m raging inside hearing that during interrogation he LIED his butt off and created a situation that was a bald faced lie. Trying to take his pants off and he acted in self defense? When I heard when he was told that there were injured kids he acted baffled and responded by asking if they did it to each other, my mouth was wide open. This man was told many many times to LEAVE just GO AWAY by at least one girl but I think the second girl with her was also telling him that. He’s a grown adult who’s very large and I’ve seen the videos of him and he was provoking the continued altercation. He is so cold and from the smirk and smile on his face as he’s standing holding his knife shows why he didn’t leave, he was ensuring an escalated fight so he could put that knife to use. He knew he had a knife and that snorkel he claims they took HE put it under their rafts to initiate further contact. Why wouldn’t he leave when told to? He hit one of the girls and she fell in the water with that’s when the kids started to confront the guy and he stabbed them killing one instantly. Putting things into perspective is how it’s proven this man is a criminal and a ticking time bomb! Why would he have felt compelled to react to a group of teens he like the other ADULTS who were adult enough to not be fazed over them? Were the teens obnoxious, drinking and being teens YES, were they armed? NO! Did they tell the guy to leave? YES! Did the guy leave? NO. Did the guy have a knife? DEFINITELY! Did he leave the scene? YES! Did he try to disguise himself? YES! Well my point is he wasn’t being assaulted by the teens as they weren’t pulling his pants down, they didn’t have 2 knives on them, he was the only one who was armed with a knife as he proudly smirked at them as he held it at his side and stabbed 5 people. He was proud of himself as his face was all that needed to be seen to know he was an evil 😈 monster. Only a person who’s guilty would walk away, disguise himself and deny being the person police sought out and telling bold lies that video footage proves are indeed LIES! Disgusting as he plays innocent asking if they were stabbed fighting each other GRRRRR.

Why are all these comments saying self defense? I am a very conservative person and full-heartedly believe in self-defense, even in the Rittenhouse case.. this? This is awful. He should have walked away. He is a man yearning for violence. If people are taunting you, the normal reaction is to walk away and deescalate the situation. Not him. He whipped out that knife with a smile, punched a woman. Disemboweled a man, stabbed a woman walking away, stabbed 2 others and killed a boy. Obviously everyone in this case was intoxicated. Intoxication doesn’t make stabbing 4 and killing 1 okay at all. He ran up on them, accused them of stealing his snorkel (faking a reason to start an altercation) and then proceeded to stab away after getting the validation after punching the woman, who her group were trying to protect.. awful situation. He definitely deserves to be locked up. I don’t know about premeditated.. but it sure isn’t looking too good for him. Praying for the victims..

4 yrs ago I was in my car at Walmart, windows rolled up minding my own business. Attacked by a group of kids, when I simply asked them nicely not to hit my car. 16,000 worth of medical. They did 3400 worth of damage to my car. I never raised my voice, or layed a hand on any of them. There was one 18, two 17, and one sixteen. I was 52 years old, and liscense to carry. After they jumped me upon exiting my car. I took a pretty good beaten for 54 seconds on the walmart camera. I finally got my pistol out of my pocket, and they all ran like cowards. Today's children have no respect for people's property or life. Watching this trial reminded me of the how these senseless kids attacked me. Then they got on social media and bragged about it. My whole county got on social media and came to back me. I never once was offensive to any of these kids. Only one kid walked away and didn't get involved. When the police showed up, the one that walked away, came to my defense and told the police the truth. They pulled the cameras at walmart and i did not even have to go to the trial. They all got 6 months in county. And have never paid a dime of my expenses. I pray justice is served for this man. You play stupid games, you win stupid prizes..

@paullllehtx first off justice for someone could be prison. Second as a former alcoholic, alcohol was involved, and they all lied on the stand. Everyone of them, the kids and the man. Problem is none of them were thinking rationally, they were all intoxicated, according to the medical records. I do believe the man was sentenced, and justice was served. The kids were not blameless, and acted like animals. When you put six young poodles on a grown Rottweiler. There is going to be some poodles hurt or possibly killed. I respect your take on it. I think the man got justice, but I don't think the kids that participated in it, were justified in there actions. I think the sentencing brought justice. Like I said earlier play stupid games win stupid prizes. Drinking brought a lot of hardship in my life. Thankfully it's been a stumbling block which I've gotten out of my life back in my early thirties.

I believe that the teens had found the phone Nick was looking for or were letting him believe they had it. That explains why in the video they took (which seems to be missing earlier footage) Nick is seen beelining to one of their inner tubes and then searching intently as they taunt him in the same way bullies play “keep away” on the playground. There is evidence that they had similar looking dry bags, but since every one has lied on the stand and been deceptive and evasive, I think it’s likely there is more to the missing phone angle. Before anyone gets their knickers twisted, them having his phone or him believing they do does not justify him stabbing them. However, it definitely would explain why he was focused on them, why they were taunting him, why the camera Guy focused inside a hidden part on the tube, and why he was not just walking away. Them knocking him into the water and surrounding him was what Nick claimed made him in fear for his life

Why do you believe the teens had found his phone or were letting him believe they had it ? I haven’t seen anyone testify to that. He was in that area looking for the phone because that’s where it had fell in, the current carried them downstream until they stopped and Nicolia walked back towards where the kids were now and started snorkeling. They asked him what he was doing and he said, “looking for little girls” that’s what prompted them to call him a pedophile ….if he would have said, “hey we lost a phone” they kids would have kept going or stopped to help him look. The secret focus of the phone video you speak of is because the kid is sitting in a tube and his phone is in a bag on a lanyard around his neck. The kids were in their tubes when he rushed up on them !

I had typed out a point by point analysis of that video and why I thought what I did, but KZbin deleted it somehow. Anyway, at the beginning, he shows up with us mask and snorkel and you see him looking at the innertube, a girl is sitting on at something, and he rushes toward it, and, then he hears a lot of cat calling by the group. They sound, meaning the tone of what they’re saying sounds almost taunting. Somewhat like you would hear on a playground with kids playing keep away. He continues, looking around in the water and around presumably for the phone in the dry case. The kids continue Yelling at him, and the person who is filming, pans down and zooms into a cubby inside the innertube, almost as if to show the viewer that there is something in there… They are yelling at him to leave, but he is still apparently under the belief that the phone is still there, and besides, he has at this point, lost his mask and snorkel. he works his way around and motions to his group not once but twice to help him. I also noticed that the kid who was cut open lied on the stand. His hair was not wet and his vision was not obstructed, he saw everything but lied multiple times. What surprise me about the whole video was how quickly it happened. Like many, I was bothered by the fact that he had stabbed five people, but in the video it happens so quickly that he is just lashing out at whoever is in his way as he Fights back. It’s over in seconds. Also, there has been much discussion about him “smiling “but in the video he is smiling before the event happens, but it is a very uncomfortable, nervous, uncertain smile, that you see all around the world. It is not a happy smile, and I can’t believe people do not recognize this , and if they do, I can’t believe they are lying about it. As far as the “pedophile“ comment they were calling him that because, presumably, he gave a smart answer when they asked what he was looking for, and he said “young girls“ or something like that. There were zero young girls around there, and they knew better. They were just effing with him. All of this merely goes to whether or not at the time of the stabbing, he had good cause to feel in danger. In my opinion, I think he did because I would have felt severely threatened as well. He was unwilling at first to walk away because he was looking for his friends dry bag, phone, and then, at the end, he was unable to walk away, because they were all on top of him, punching, pushing, and yelling. While underwater, he reached in his pant pocket and pulled out the knife that was clipped there, and opened it with the blade up, as all knives do. Watch the video yourself, with and without sound, and ask yourself objectively if you were in that situation, would you feel threatened? Especially if you had just had a quadruple heart bypass surgery less than two years before.

The defendant walked passed by an officer and didn't speak to him or said anything. Knowingly what he had just done, smells guilty to me. You don't act that way, or pretent to act surprised when officers tell him his under arrest. Do you even understand how trials work or are you just commenting out of your ass? What was he defending himself from? Laughter? The boys weren't being physical at all. Yeah, the kids were being dicks. So what?! The group of adults that came over were trying to break them up (again, using words only) and he punched one of them in the face. He was the one who made things physical. Aside from the one 17 year old that he killed, everyone that he stabbed or punched was in the adult group. You're right, he could have drowned. He should have thought about that before punching a woman in the face while she was telling him to walk away. It is a river that is about 3 feet deep for a long way. People pay to go down the river and pay to use an innertube or more for the trip. It might take an hour or 2 to go down the river. My opinion as a practicing legal counsel: 1. This is a standard textbook definition of excessive use of force in self defense and he will most likely be charged for this; 2. Miu could have resorted to many less violent acts like, slapping/punching back, screaming for help, simply just waving with his knife instead of using it or just running away; 3. This is definitely not a violent ‘mob’ like most people here like to state. They had no guns or any other weapons, didn’t use excessive force and were not particularly threatening. He could’ve most likely walked away with very minor injuries but instead restored to murder and injuring people and continued even after he already scared the group away. People have lost their minds for thinking that this monsters actions are justified. I wonder if they would think the same about this man’s actions if it was their son who was killed. RIP Isaac and condolences to his family. I don’t feel like it’s being said enough here..

Ok, fair enough but 1. You are not thinking clearly being attacked. 2. The prosecution added lesser charges at the end, which is completely unfair. 3. They did not prove it beyond a reasonable doubt because the jury did not look at it from Nick's perspective. He was clearly scared enough to get the knife out earlier.

The physical contact was made by someone other than Mr. Miu first. I'm not saying Mr Miu is a saint, but neither are the kids, or the lady who touched him. She had no right putting her hands on him, and I would of been pissed off too if someone touched me. The kids were drinking and smoking weed in public, and obviously running their mouth harassing Mr. Mui. I don't have a problem at all that Mui was carrying a knife, these days it's understandable, and I carry mine every time I go out. The kid with curly hair and glasses that got stabbed, straight out lied in his testimony, saying he didn't even remember touching Miu at first, then saying he only put his hand on his shoulder, while the video proves he shoved him to the ground, and went in a second time to push him is when he got stabbed. In my opinion from everything I've seen so far, I would say it was definitely not first degree murder. I think Mui was probably scared, and was defending himself. I don't know if he should get off without repercussions, but definitely not murder. Horrible situation for everyone involved!
