Very informative Atty. Raymund. May question lang ako for the commercial subdivision. What is the critiria para malaman. Example residential lot ang area. Di namna nagbebenta but the owner is using the area as bodega for his products like mga softdrink and beer cases. Kami bang mga neighbors ay may rights magreklamo or not? Tnx po

Nagbabasakali lang po ako baka mapayuhan nyo po kami sa farm land po nang lolo po namin under Agricultural Free Patent issued in 1973 under name sa lolo po namin na matagal na rin po pumanaw.. but as checked po namin sa lupa may deed of absolute sale ang Philippine Industrial Authority dated in year 1976.. at ni insist nila na sa kanila daw po yung lupa.. totoo na po ba to atty na sa kanila na daw po eto? Pagka alam kasi namin di cya pwede e transfer kasi may restriction naman yan at that time na di pwede e sale or transfer under CT 141.. hopefully may mapayo po kayo atty. Thanks po and GodBless

land title, I'm not too sure pero residential patent (may homestead, at iba't ibang klase ng patent po kasi depende sa sitwasyon) po kayo kung more than 10-30 years na po nakatira sa lupa, as long as hindi titulado, pwede nyo po sya mapa tituluhan in your name. pumunta lang po kayo sa nearest regional trial court/municipal trial court at mag ask po ano ang requirements. As far as I remember po, magse secure po muna kayo ng papeles na walang nagmamay ari sa lupa at pwede siyang i dispose ng gobyerno (nalimutan ko po kung CENRO or sa DENR/LMB or ano, pasensya po), at two letters of disinterested person (neighbors po sa said lot na hindi interesadong angkinin yung lupa, with signature) or kung anong proof po na nagpapatunay na nakatira nga po kayo sa said lot for more than 10 years. DISCLAIMER po, not 100 percent accurate po kasi Geodetic Engineering student lang po ako na nagrereview for board exam po. So the owner of the land offer to sell the property to us given power of attorney to her brother sealed overseas as well. Now my question atty. is they provide a TCT # and LOT #. Can we just go to land of registration and get a copy of certificate of deeds? My mom tried to get one but they said it needs an approval of the owner is that how it works?

Atty. abo po ibig sabihin kung ang nakalagay sa Memorandum of encumbrances "The Government Reserves the right to administer and protect the timber found thereon for a term of Five years from the date of this patent provided however that the grantee or his heirs may cut and utilize such timber as may be needed for his and their personal use. sana po masagot ito nlng po kasi ang di ko maintindihan sa TCT ko po.

That particular land iha have existing timber when a patent title was issued to the original patentee. However, i believe that the 5 years already passed, therefore that annotation is no longer applicable. You can have that annotation removed by filing a petition in court if it is annoying to you 😀✌️ or leave it be since it has no more efficacy

Sir, deed of sale lng ang nasa aking ina bilang isa sa mga buyer ng land na ibenibenta. The original title is with the other buyer who bought the other part of the land being sold. Paano namin ito mapa register or mapa title as kami ang nag aari.

Good day po Atty Tanong ko Lang Po Naka bili NG lote ang asawa ko ngayun at pinagawaan na nmin NG bahay kahit hindi pa tapos Yung pag lipat sa pangalan niya Yung name NG title.. Napa survey na namin ni Lagyan na NG muhon.. Nag bayad na kami lahat... Sa pag kakaalam ko ngayun na ipasa na nila sa ROD.. Ngayun itong katabing lote nag PA survey bago Lang saisama Yung loteng nabili nmin at ni Lagyan din Nila NG muhon.. Ano Po ba ag pwede nmng gawin hinggil dito.. Kasi ki ni claim NG katabing nagmamay ari nasa kanila daw Yung lupang nabili nmin... Gayung nasa amin PA ang mother title NG nabili nmin lupa at na PA survey nmin.

Atty meron po lupa ang tatay namatay po ang magulang namin ko. cloa title po kaso hndi namin na ayus wala po kami hawak ano po unang gagawin namin wala po kami documents

Pwedi po bang ibenta ang lupa ng taong may utang sayo, halimbawa po binigay nila sa akin yung owners duplicate tapos may utang sila sa akin ng malaking halaga, yun lang po kasi ang hinahawakan ko sa kanila.. Ang hawak ko ay owner duplicate ng titulo ang lupang yun ay hindi pa nahati-hati
