Lady was told that the dog was bitten so as soon as she saw the lump she should've taken him to the vet immediately rather than waiting four days and doing it in an emergency situation on a Saturday. She claims that she thought it was part of his separation anxiety but if she knew that was a bite and she knew that was a lump and that's bull.

Except for the fact that sometimes things don´t show at the moment. I was in a very small car accident. I was wearing my belt. I was in traffic. My foot, by mistake, hit the accelator and hit the car in front of me. I was just inches away. Barely moved. It wasn´t up until weeks later that I started feeling serious pain in my lower back. Couldn´t handle it. When I went to the doctor he told me I was injured. It was severe enough that I couldn´t drive, had to drop college (since I had to drove there), and had to wear a type of girdle and be in bed for a month.

I agree. He should be protecting the dogs from other’s dogs who may have resources guarding aggression. My dog has major anxiety issues. It takes him a couple days to get back to normal after grooming. I totally disagree with the judge in this case. I also think the judge seemed annoyed before the plaintiff said a word.

She should have taken the dog to a vet as soon as she picked him up, dogs often have harmful bacteria in their mouths. Also, you can't just assume that there wouldn't be any conflict at a no kennel dog facility. The dogs might have been well mannered but even generally well-behaved dogs can cause conflicts.

It's a great fit for a lot of dogs. However, In my experience, dogs with any type of anxiety do not do well around others. It creates more anxiety. The idea of boarding should just be about keeping them safe for few days. Usually, patients with high anxiety, We recommend in home care. ❤

It really doesn't matter how annoying the plaintiff may be, the defendant was negligent. Judge Milian didn't ask the right questions about this facility. He said he was a "three kennel" facility and was watching three dogs--one dog per kennel. I've boarded my dog before, and even if the dogs are socialized all day long, when they sleep and eat, they do so in their own kennels away from the other dogs, because that's when dogs are most vulnerable. Even the most social and friendly dogs can have food aggression. Even people who have multiple dogs at home generally feed their dogs in separate spots to be safe. For a boarding facility to just freely feed strange dogs in an enclosed area and NOT watch them (and YES, I mean STARE AT THEM to make sure they don't try and steal from each other) is negligent for someone who is supposed to be an expert. A lability waiver protects the owner from anything that arises as a result of something dogs just do. But if you, as the caretaker of the animals, put dogs in a situation that is LIKELY to result in aggression, that's gross negligence and I think the defendant should be liable for it. I'm sorry, but I think the judge is dead wrong. If the dog got hurt just running around in the yard or something, then yeah, you assume certain risks, but even a dog novice knows you don't feed strange dogs together. The ONLY thing I agree with is that the plaintiff shouldn't have waited so long to take her dog to the vet. Me personally, if I went to get my dog from boarding and they told me he'd been bitten, I wouldn't take their word for it that he was fine or just to put some ointment on it. I'd go straight from the boarding facility to the vet to have my dog examined. Regardless of if it would be covered by the facility or not, because I want to make sure my baby is good. But I don't think it's unreasonable to wait a few days to see if your dog comes back to normal after being in a boarding facility. The defendant should have been liable for this. Bad call for JM.

The judge is wrong on this one. Any reputable dog boarding business is going to ask whether your dog has food aggression. If the answer is yes, then the dog must be fed in another location. Honestly, while this show is very entertaining, I would never bring my issue to her court room because it’s hit or miss whether she will get the decision right.

No, Alex follows the laws the best. While there is a burden of proof, the judge has to decide more likely than not. If the judge is convinced in the absence of strong evidence, it is entirely legal for the judge to rule for the plaintiff/counterclaim.

Also, in all fairness, dachshunds can be aggressive little jerks. I don’t doubt he started it. That being said, I understand cage free facilities but it’s common sense to separate dogs that aren’t familiar with each other when they eat. That is dog 101.

In regards to their conversation about meeting people you know in far off places-I live on the Midcoast of Maine. My grandson was visiting me from GA. We were walking on the mile long breakwater in Rockland. I heard some ladies talking and I had to ask where they were from (because my late mother was from SC and I’m always reminded of her when I hear that accent) Turns out they were from the same town as my son in GA and his family and knew my son from his place of employment.

Cage free boarding is always red flags for us in the Vet world. Plus all boarding facilities always have a liability clause that releases them from any damages done to pets in their care. Sometimes you don’t know your pet has an injury until it worsens enough to notice. My cat had gotten bitten on his chest near a front leg. I only noticed something was wrong when he started acting lethargic. My daughter and I were concerned and were petting him and when I felt a wet spot. It wasn’t yellow or noticeably oozing. (Of course I took him to the emergency vet right away where they shaved him, cleaned the puncture wound, and sent him home with meds. It was around $700. ) So, no, a wound or illness isn’t necessarily obvious right away. Having said this, I wouldn’t board my pet where it would never be separated even to just decompress, but especially during feeding. The dogs don’t have to be in cages 24/7 but common sense is there should be times they have their own space. And I would also not board my animal at a place they take absolutely no responsibility for any injuries. That’s literally giving the business owner carte blanche. Unfortunately, the owner signed the contract so she has no recourse.

Rooster was on a literal roller coaster this entire case...
