Being a Slippery Sales Man

The plaintiff bought a car and one-year warranty from the defendant. She says the transmission went out and when she went to fix the transmission, he returned the warranty. She’s suing for the cost of new transmission. The defendant argues the plaintiff didn’t know there was an approval process for the warranty, but she just wasn’t approved. He even sent her a refund, so it’s not his fault she didn’t get the warranty.

I own a used car lot. I have sold a couple of warranties with this exact company. I have only been in business since the end of last year and only been a member with C.A.R.S. for about 6 months. But the warranty company seems to be pretty good so far. C.A.R.S. warranties are legit if they are paid for. And I offer them to my customers at my cost just as a benefit if they want one.

Once the papers are filled out and the warranty is paid for C.A.R.S. sends the customer a packet of info on what is and isn't covered and a membership card with their name and the information on the car being covered. This is seriously wrong what the salesmen did in this case and I will bet you if they did it once they did it hundreds of times. This is the type of thing that can put a dealer out of business.

I own a used car lot and actually use that exact company. I haven't been in business for all that long but I can tell you that the few customers I've sold the warranties to seem satisfied. I specifically asked them to come in and let me know if the company actually covers what they are contracted to or not and so far every one has had positive reports. I also only sell the warranties at my cost. It's just a service to the customer if they want one.

This is so common that it is like the number one thing that used car dealers get sued for. They charge you for a warranty but never submit the warranty. If you come in with a problem they either fix it on their own dime or submit the warranty and then make a claim. This is why these third party warranty companies are forcing a 30 day waiting period before the warranty is in effect. If you buy a used car and a warranty you should get paperwork for that. Because she had no paperwork it seems likely this dealer was scamming people out of their money and never buying any warranties.

Me and my husband went through this same deal! Bought a truck at a uses care dealer, warranty was through a third party. Engine blew after four months from the purchase. Warranty was denied. We had no money to hire legal help. So we were sunk. It was our only vehicle at the time, so we had to buy a whole new engine. DONT EVER BUY A CAR WITH A THIRD PARTY WARRANTY.

I purchased a 3rd-party warranty plan when I bought a used Mustang. They paid to have the transmission rebuilt or replaced. I can't remember which one, exactly. All I remember is that the warranty company did what they were paid to do. It probably helped that I purchased the car from a big Ford dealership, because they gave me employee pricing; as opposed to a ratchet, fly-by-night car lot.

C.A.R.S. is a national company with a decent reputation. The plaintiff was scammed but soley by the defendant. I own a used car lot and have sold warranties from this company. They aren't in a little office where you can work out a mutual scam with someone. You go to their dealer site, fill out all the info and submit it. A bunch of contracts print off and you have the customers sign those, you scan them back into the computer and send them back. Then, at the end of the month C.A.R.S. automatically debits your account for all the warranties you have sold. You, as the dealer collect the money from the customer and most dealers mark those up a few hundred bucks to increase their profit. But the warranty company has nothing to do with this. And they send the customer a packet containing info on what they are covering and a membership card with the customer's name and the information about the vehicle being covered with a membership number. Just image this as getting a regular car insurance policy from State Farm or some other place online. There is no way that the actual company would be involved in the scam.

This EXACT same thing happened to me! The warranty cost was $150 but they never sent it in with the paperwork and I ended up a plaintiff in small claims for a transmission against the dealer that sold me my vehicle as well! This happens all the time with used car dealers lol, people just don't know. The judge used the term "roulette" which is 100% what it is. Here is how it works: The used car dealer sometimes (not every sale obviously) charges a customer for warranty, but never actually purchases the warranty from the 3rd party warranty company (just like this case). They hope the term of the warranty runs out before anything goes wrong with the car, which is how they profit the warranty cost. If something DOES go wrong during the term, they usually just count it up as a lost scam, and pay the money out of the dealerships pocket to fix the problem, and just tell the customer it was covered under the warranty. This is still profitable to them because the amount of scam warranties they sell with no mechanical issues during the term of the warranty outnumber the ones where something actually goes wrong and they have to pay out of pocket to keep it hidden. What's crazy is usually the warranties they play roulette with are not 1 year unlimited miles lmao. Thats way too long, and something (even small) is bound to go wrong on a used car in that time frame. Usually the warranties they scam with are 3 month 3k mile warranties (the most popular ones from used car dealers). This idiot ruined his own scam by playing roulette with a LONG ASS warranty on an old ass car, and ALSO telling them the warranty was denied, instead of just shutting up and going fully into pocket and counting it up as a loss and just not telling the customer. He figured he didn't want to take the loss of 1,800 (2800 for new tranny minus 1000 he already made from the scam). He was banking on them just rolling over and taking it, and instead they went to court. This case just touched the tip of the iceberg of this scam, but its a very real thing. Also, this guy has absolutely done this tons of times before.

So I guess that consumers need to educate themselves when buying this type of stuff. Since it's 3rd party they need to expect some kind of contact from the company after the sale to validate everything. Otherwise you are right that the customer will pay for something they never got.

@10:07 the Judge states that the warranty company said they had a record of someone calling in November and that coincides with the time line both the plaintiff and defendant laid out. I'm not saying the defendant isn't a scammer but the warranty company DID have a record of his call. And it is also possible he was too busy greasing his hair to keep track of what his sales staff was doing so he wasn't the actual crook in this situation.

It was obvious that the guy scammed them. If he was legit he would have been happy with the judge's ruling because all he would need to do is show that he paid the third party company. Then he can wipe his hands from all the mess. But since he was upset at the judge's ruling, that was a clear sign that he knew he did not have the proof that he needed because he knew he was being dishonest.

If the defendant had submitted the warranty to the 3rd party, then yeah, it'd be against the 3rd party. But he (or his agent) took her money, never paid for the warranty, and got caught. Given the amount, if she filed a police report, and presuming this his his s.o.p., it could shutter his dealership.

The judge didn't realise she caught him in a lie when he said he had called the insurance company and they told him they were declining the claim, yet when the judge phoned them they said they had never seen that policy, so he lied to the judge, as it is impossible for the company to decline a claim when they didn't even have the policy. He should be in jail for fraud and theft...

Don't buy warranties from Wal-Mart with your purchases. I did once and was given a repair shop to call. They refused to honor the warranty because they said "We don't fix those anymore". The item was six months old.

When the defendant walked in that idea entered my head that he never submitted to warranty. It is a common scam. They never gave the the woman a cop of the warranty for her to check into it herself.

I own a used car lot and actually use this very company. Everything is done on the computer with no actual interaction with anyone from C.A.R.S. They have specific rules for the cars they will cover and what it costs. If I was to submit a Hyundai for instance that was a 2001 model with 250k miles the paperwork would print off but within 48 hours the company would call and let me know that they will not approve that car for a warranty. But all the info would be there while filling out the paperwork so I would know before ever submitting it that the car would not be approved. They warranty virtually any car that is less than 20 years old with less than 200k miles though so that pretty much covers most of the used car market.

The "insurance" place is in cahoots with this "dealership", IMO.. if not, this "dealership" needs to be shut down immediately for fraud and embezzlement. Unbelievable . And he had the audacity to try saying he "had no legal obligation beyond the sale of the vehicle." FRAUD. FAKE. I hope no one ever buys another car from them again.

The Defendant, tried to play the roullete game, and lost, he kept the $1000 bucks, did not register the vehicle in any warrantee, gambling that the car would not need repair, and he lost the gamble simple as that, HE IS a SCAMMER, and a dishonest businesman !!!!!
