Our expert employment lawyer and partner, Marie Davis, Esq, demystifies California's new law, "Silenced No More" SB 331 Act for employers and business owners. SB 331 prevents Non-Disclosure Agreements (NDAs) and confidentiality clauses from hiding any type of harassment and discrimination in the workplace. It will make it easier for employees to speak out about racism and other forms of harassment and abuse in the workplace even if they sign non-disclosure agreements. The new law also expands a ban on broad confidentiality and non-disparagement clauses that employees have to sign.
Non-disclosure agreements have faced criticism for shielding companies from public accusations of wrongdoing. This law targets NDAs that prevent employees from speaking about workplace discrimination.
This new employment law, SB 331, goes into effect on January 1st, 2022. Employers will need to review their separation agreement and termination template. Wow. “She should just he able to take that money and keep her mouth shut.” Do you listen to yourself? This law was put in place to discourage workplace abuse by allowing employees to discuss what their employers did to them. How does it feel to be on the wrong side of history?
