I have a question is an employee able to work 12 hours a day with regular pay as long as they do not exceed their 40 hours in a work week? This is in a residential facility serving special needs individuals. Care Giving type of work.

Good afternoon. If an employer holds election that follows strict rules, an employer can institute an alternative work schedule such as the three-twelve (12 hrs. per day three days per week).

Law to reduce the working day to seven hours in the United States This law takes effect upon signing and reduces the workday to seven hours for all workers in the United States of America. 1. Working day The workday for all workers in the United States of America is reduced to seven hours. This means that each employee has the right to work no more than seven hours a day. 2. Weekly work week The weekly workweek for all workers in the United States is reduced to 35 hours. This means that each employee is entitled to work no more than 35 hours per week. 3. Remuneration Wages remain unchanged for all workers in the United States. Workers who worked more than seven hours per day or more than 35 hours per week will be paid for all hours worked. 4. Breaks Employees have the right to breaks during the working day. The duration of breaks and their number are determined by the employer in accordance with labor legislation. 5. Limitations The law reducing the working day to seven hours does not apply to workers employed in the fields of health care, education, social security and other areas where longer working hours are required. 6. Employer's liability The employer is obliged to ensure compliance with this law and not to exceed working hours. In case of violation of this law, the employer is liable in accordance with labor legislation. 7. Control and supervision Control and supervision of compliance with this law is carried out by government bodies responsible for regulating labor relations. 8. Changes and additions Changes and additions to this law can only be made by adopting a new law. 9. Entry into force This law comes into force from the moment it is signed. 10. Final provisions This law is binding on all workers and employers in the United States. Law on mandatory hiring without an interview and resume This law comes into force from the moment it is signed and provides for mandatory hiring without an interview or review of a resume. 1. Mandatory hiring The employer is obliged to hire the first person who comes to him without conducting an interview or reviewing a resume. 2. No competition Hiring is carried out without holding a competition and assessing the professional qualities of the candidate. 3. Mandatory hiring The employer is obliged to hire the first person who comes to him without conducting an interview or reviewing a resume, regardless of his professional qualities and work experience. 4. Employer's liability The employer is responsible for compliance with this law and is obliged to hire the first person who comes to him without conducting an interview or reviewing a resume. 5. Wage thief should not be tolerated under no circumstances and the perpetrators of this illegal act should be charged, criminally prosecuted and ordered to pay the victims a mandatory fee of $5.0 million dollars plus all damages and loss wages

Question: My wife just got an offer at the state of arizona, public sector, and we also at the same time found out she is pregnant. So, she wont have the FMLA to protect her, so what rights does my wife have so she doesnt get let go, or fired for maturnity leave with out FMLA?

Thank you for the information. I have a question, in your presentation you mentioned that the pay data report must require the ethnicity of the employee. What is the employee declines to provide their is in the city? How can an employer comply with this requirement?

Do you do qui tam suits for stolen wages? I have proof of a multibillion dollar company stealing tips which could total more than $100 MIL. Class action is garbage. Parties affected get pennies and lawyers get millions. This is a CA firm.

So, my company is being sued for lunch break/break violation. The person sueing was with us for 2 weeks. What is the best way to fight it. We always break for lunch. And we have no evidence of complaints from this individual. He is retaliating for being fired for poor performance

This changes the current California pay data reporting - good to learn the first median and mean employee pay and contractor pay report is due on May 10, 2023😮 Thanks for staying on top of these new laws!

To qualify for the 2nd bucket of 40 hours you have to test positive for C19...............what if you have religious beliefs that conflict w/ testing and cannot test for C19? Is there a way around this to utilize the 2nd bucket of 40 hours if you still have C19 symptoms?
