MY heart goes out to Mr. Alba…I was one of those that signed the petition in support of him. Thank God the RIDICULOUS charges were dropped. He should have NEVER been arrested in the first place, and that STUPID woman should have definitely had charges against her and SHE should’ve been arrested!

The arrest is part of the process. I agree that he was innocent, but I will NEVER agree with failure to thoroughly investigate a crime scene because you FEEL a subject involved in a violent act is innocent. No. Police officers must do their job without favor or bias. Leave proving innocence to the judicial system.

I'm an old white guy in florida. I'm carrying 100% of the time I leave the house. Yeah, 3 blocks to the grocery store, the 9mm in my pocket. I have no illusions about trying to play tough guy with some young thug. I'm going totally submissive waiting for an instant where his attention is elsewhere. At that moment someone would get a very personal lesson on what "triple-tap" means. If it were caught on video, I'd expect (hope) that John Correia would be featuring it.

I'm not a lawyer but I'm glad they got dropped and I'm kind of stunned he had been arrested to begin with. Sorry but, in my view, if you've cornered someone and are being violent toward them, they have a right to protect themselves. It's just that simple.

I think an initial arrest after a killing is not too surprising, just not sure they should hold them for long if it seems reasonable that they have a self defense claim. Very odd but I don't know how the police usually handle these kinds of cases.

With the girl's man dead, we really don't know what she went back and told him. I wouldn't doubt she made it sound like the clerk said and did more than actually happened. She may have added much more to it in order to spark her man into more anger. The fact that she vowed to come back with him for revenge suggests that may have happened.

The problem here was the fact that Mr. Alba was even charged to begin with. This 'arrest/charge everyone and let god sort'em out later' attitude that prosecutors have hurts a lot of innocent people.

Look I hate to be someone to call attention to race. Identity politics get way too much negative attention?? My thing though is how many times do we see people that are white in a similar situation and the cops arrest no one. They assume self-defense exists and if something pops up that disproves that they come back to arrest them. Literally numerous examples of that playing out. Ahmad Arbery just to name one. I mean we can all sit in this circle jerk and keep pretending something isn't broken. That both sides don't have valid points. There is both a huge issue with crime and a huge issue with how our society polices crime. Both sides have a valid argument about certain issues that compound here. They have made such a boogeyman out of CRT being taught to children (it's not) when these are cases where CRT actually has implications. Look I don't give a crap one way or the other. Republican Democrat. Be you right? But we share this country. I just want to make this country fair for everyone. That someone's personal religious beliefs do not dictate other freedoms and rights especially for those who do not hold those beliefs. Also, The barrier for entry to a good life should not be success. I don't have any answers. I'm not highly educated but it seems like ignoring the actual problems are a pretty damn stupid way of solving anything. Anyway, I'm sure I will trigger people for trying to be honest but... I don't really check replies to my comments so. Any people who want to, Bash me all you want. I'm sure that is the best way to help discover a solution anyway. Based on the efforts all of us are putting forward, it seems like the only method to produce a solution we are even willing to take part in.

He killed a member of a protected class, so he had to be charged. A formality even if they knew it wouldn't stick. You do not have the right to defend yourself from assault by a disenfranchised melanin enriched individual in this country.

If the prosecutor was using an "Arrest/charge everyone, and let God sort then out" approach, he also would have arrested the girlfriend. This charge was about skin color. Mr. Alba had less pigmentation, and thus fewer virtue points.

Not sure how your statement applies to this situation. A woman wanted a snack, couldn't pay, verbally makes a threat and then gets her dude to come back to assault the cashier, who in turn has the right to defend himself. Not sure how defending his woman's honor applies here but the entire situation is ridiculous and unfortunately Im not surprised having lived in NYC. ✌️🤙

The bodega owner being arrested was in itself criminal. The bodega man did nothing wrong. He was physically attacked and threatened. The young man is showing his dominance over the bodega owner. when the bodega owner tries to leave (because the young man had no idea he was retrieving a weapon but instead must have assumed he was trying to get away) the young man grabs him and tries to maintain control over him. He is basically trying to keep him in a dangerous position. And it cost the young man his life to try to dominate another human being over some damn snack food. He took his life into his own hands and he lost. The bodega owner was scared and thankfully was able to defend himself. Who knows what would have happened had the young man continued to work himself up and lose control in this high anxiety situation. What kind of outcome do you expect in a situation like this..? You get what you give.

Sadly the DA was within his rights and duties to charge alba. If he went through with the prosecution then you could definitely have a case for malicious prosecution but he bowed to public pressure and dropped the charges.

Simon didn't lose his life over something stupid; he lost his life because he was going to do grave bodily harm or even kill an innocent old man. The problem isn't that nobody thinks about an act leading to death, the problem is that the c*nt has no self-respect and her "man" had no self-control. Do you seriously think that Simon didn't contemplate maiming or killing the old dude? That never crossed his mind? He thought that real-life violence was like old westerns where a sixty-person bar brawl ends with no injuries and not one person even has their hair messed up? Do you seriously think that Simon is some kind of angel born of immaculate conception who's never hurt a fly until that moment? You think he wasn't intending to send the old guy to the hospital? I feel so sad for the little girl. I am a therapist and have seen so many children with deep guilt about what their parents do. It is likely that she will think her daddy is dead because she asked for a snack. Children often feel responsible for terrible things that happen even though none of this was her fault. I would encourage all parents to think about that before they act aggressively. It’s my position that when parents over react they are selfishness making the situation about themselves and the child’s well-being is sacrificed.

Fr!! I got upset at a really rude employee like a year ago. I didn’t say anything to him, told my bf and he was like “that sucks, let’s go get ice cream after this to bring up the mood”. It’s that easy to not make bad choices (but then again I chose a great guy).

Maybe I'm just too desensitized and honestly jaded at this point... but I just can't feel bad for people that die because of their stupid decisions. The problem is, usually these stupid decisions aren't isolated incidents. This guy got so hotheaded over some stupid bs that I'm sure his wife over exaggerated as well, I seriously doubt he was just a nice calm guy in his every day life. This probably wasn't the first time his wife had some silly drama that she called him to "handle" for her and he came running right away. He was probably an extremely hot headed and violent person, and I don't know these people but just judging by all of the similar stories to this that I've seen, maybe even a little domestic violence sprinkled in there from time to time. Obviously regardless of his stupid decision that led to his death and whatever kind of person he was in his life, he had friends and loved ones that have to mourn him and his daughter lost her dad, so it's sad for those people... but other than that I have a hard time considering it a huge loss as a whole for society when things like this happen. I'm glad the charges were dropped for the bodega worker, and I hope he is able to move past this with the support of his family.

I feel the same. Watched the full video more than once and couldn't feel anything for the guy despite its brutality. He grabbed the store owner, yanked him out of his seat, and started dragging him somewhere. The man was perfectly in his right to prevent whatever he was going to have done to him from happening. I don't know, maybe it's just the sheer audacity of the guy. What gives him or anyone else the right to think they can just behave any way they want to others whenever they want? If everyone acted like him, he would've been stabbed so much sooner, but he literally forced the owner's hand. We live in a society. You want to live like an animal, go out and live in the woods. Feel so bad for him having to deal with with all of this nonsense. Man's just trying to run a business.

One thing I learned early in life - don’t start something with someone unless you’re prepared to take it “all the way.” You don’t know how people are going to react. For clarification: The Bum's Rush is when one grabs another by the back of the pants/trousers/belt and the back of the collar/hair and "rushes" the "bum" out of the establishment. Bonus points if the ejecting party picks up the ejected party by the described grab points and swings him/her back and forth in a one-two-three type motion. Double-extra-mega points if the bum's rush includes a defenestration.

That is when a bunch of people who aren't allowed access, rush _en masse_ in order to overwhelm the security. I think it's intended to be non-violent like flag football; plenty of pushing but no harm intended. I like the original, because it's so funny. A friend was watching sumo wrestling, and in one bout a wrestler got behind the other, got him by the back of the diaper-thingy, and tossed out of the ring. In this case, there is a fundamental difference to the German legal system. In Germany, the public prosecutor must investigate independently of any party. This also includes the determination of self-defense. The public prosecutor must collect evidence as to whether self-defense was present or not. As I understand it, the prosecutor in the USA only collects evidence that speaks against self-defense. The court then decides whether there was self-defence.

Well, it’s a bit similar in the US. The prosecution is supposed to prove that it wasn’t self defense, but they also need to gather ALL of the evidence. The only issue is that the New York DA does not want people to have the right to self defense.

Except the guy came unarmed, didn't brandish any weapon, the owner stabbed the guy AFTER he was out of the corner. It was because of all that that they considered trying to go after him for murder, since he didn't try to run away and he escalated it when he was only being yelled at and pushed around a little, no punches or anything. I do think it was self defense and the guy was incredibly stupid to go get behind the counter into that dude's face, but the escalated it unnecessarily, his life was clearly not in danger.

I'm amazed that they arrested the bodega owner for defending himself when it's actually the woman who was at fault. She made a scene over a candybar, then threatened mister Alba, got her boyfriend with premeditated assault, the owner defended himself with a boxcutter (probably the only thing he had available) because he simply wasn't allowed to escape WHILE the woman was even stabbing him with a knife during the incident. So why was the bodega owner arrested and charged with murder and a ridiculous bail setting; while the woman just was let go without any issues when she was the one who premeditated the assault by riling up her boyfriend? The bodega owner should have never been arrested nor charged nor put in jail for several days! This was clearly self-defense so hell yes those charges should have been dropped as those charges shouldn't have been filed in the first place! I hope mister Alba is doing well and will be compensated somehow for all this because he lost several days worth of income. Regarding this Simon; good riddance to bad rubbish. We need less of these agressive criminals who go in with premeditated assault to rough up or even kill an old man (over a friggin candybar).

There is a parallel between this case and the Oscars fiasco. The outcome was different, but both cases are a guy thinking he is defending the honor of his woman and doing something really stupid. Simon lost his life, Will Smith lost his career, both over nothing. All they had to do was think.

@@angc214 I think the fact that you and the law don’t care that she told him to go attack the man his part of the problem. I think a preventative measure for situations like these, is for someone like the woman knowing that there’s a consequence for instigation. If in the eyes of the law, it can be proven in court that she instigated the assault originally, if they were to introduce stricter laws regarding instigation, less situations like these would happen. Not to say that the attacker should be held any less accountable, but I think accountability should by held by the instigator as well.

The way I see it, the moment you initiate a confrontation by giving someone any inclination that you are about to put your hands on them, you open yourself to someone else’s perception of how the victim viewed the threat. NYC is a special place. I lived there for about 2 years when I went to college. I loved the energy, the dynamic, the flow, but oh boy, things can go south quickly. Coming from a mid-sided town in Germany, your situational awareness goes up exponentially. Unless you are in your own 4 walls, you don't let your guards down ever. I don't blame the bodega owner at all. I studied there around 2003 when things were still kinda "low key". Now, I'm not the least bit surprised as to how this situation ended. Sad for everyone.

Lol, your heart goes out to this Simon dude. There is no need for his existence in this world. I hate bullies and I hate people who always feel someone owes them but never give back. Sounds like these people fit that bill. Sorry for the kid and the Bodega owner but not for the gf and dead criminal.

That is what happens when police and prosecutors don't do their job. When a guy is allowed to go on stage and attack another guy in live TV and there are no consequences.

Man, the whole concept of taking your two guns to go to grab a bite to eat is so bizarre to me. It's like some post apocalypse stuff where America is a lawless wasteland so dangerous that you need multiple guns on you at all times

New York district attorney is more interested in releasing criminals into the streets and wanted to crucify the bodega clerk. He only dropped the charges when the general public including the mayor took the clerk’s side.
