Ego, position, and power. That’s what the stop immediately turned into. Once the cop made that subject the purpose of the stop it was always going to end poorly. Sadly, most of the time that means submitting and bowing down to lick the boot.

I understand they need to hear both lawyers arguments, but wouldn't it be cool if after watching the video, the judge could simply tell the truth and end this from the get go with the officer was a complete ass, you lose. :) I mean that in itself was the totality of the problem...end of story. Anyway, not an ideal outcome but it seems it was acceptable to the victim.

Exactly… she said 10 cops are killed each year. A quick google showed 86 citizens were killed in interactions that started as traffic stops. Cops are cowards.

They make them dangerous with the concept of "Investigating". If they wrote a ticket before approaching, then approach and give the ticket to the driver it would take all the "danger" of prying into someone's business out of the equation

There are 20 million traffic stops every year but only 10 deaths, those numbers are far lower than many other jobs/activities people partake in so I’m not sure it was a great argument.

@@feminazislayer No you are conflating two completely different things. He is asking why they aren't fired. Qualified immunity has nothing to do with the officers being fired or not. It also has nothing to do with being charged with assault. It protects them from being civilly liable.

@@feminazislayer As mentioned, qualified immunity has nothing to do with criminal charges or punitive action by their department (firing,) it only prevents them from being sued in civil court. Department heads and county/city prosecutors are who decides to bring criminal charges or not. 99.99999999999999% of the time, there will be no criminal charges.

The one with the attitude was the cop. He clearly escalated the situation and is a complete embarrassment to his community. If I lived in that community, I wouldn't rest until this cop is fired. in that situation when she talked about ''reach'' if a cop has reason to believe they are reaching for a weapon, they would draw and fire their own weapon at the driver, which gives me the fact that the cop did not feel threatened at all.

Had to laugh at this female lawyer! So ... he was stopped for NO apparent reason (illegal). He was forced to provide his personal information (4th Amendment Violation). He was forced to get OUT of his vehicle (4th Amendment Violation ... no lawful reason for exiting). OH ... and let's NOT forget that body slam that broke this defendant's nose ... which according to her was an appropriate use of force. AND yet she's saying how LEGAL this all was. Wonder how she would feel about being drug out of her vehicle and slammed to the ground? Would LOVE to see it!!

There should be a sweeping investigation across the board to see just how rampant the problem is. It's part of the process, and probably the only part that I respect in spite of its unsavory nature. Everybody deserves a vociferous defense like this. Imagine you are getting fired from your job in the private sector and had this kind of support to make sure that you were getting fired for a good reason. I think police are trained to say "stop resisting" during arrests like this as a kind of performance art. They know the bodycam will possibly be played for a judge or jury, and hearing that phrase will be led to the conclusion that the person was in fact resisting. My uninformed opinion is that police like this one are looking to "tune up" anyone who is even mildly disrespectful.

There should also be some form of positive reinforcement points system bonus for merited service… because if I know I was doing something stupid when I was pulled over, and the officer communicates the issue professionally & respectfully, expressing concern for all involved… that deserves a positive feedback, made easy to provide. Even if the officer gives me a citation and hints at how I can have the citation tabled unless I commit another similar infraction within 2 years… that is actually serving the community.

Lawyer says 2000 cops injured and 10 killed during traffic stops. With about 20,000,000 (20 million) traffic stops per year and an attitude like this cop showed, it’s surprising the numbers are that low.

Every job I have ever had, there was potential to lose my life. Going outside and walking under a tree or in an open field, there is a possibility I could lose my life. The difference between me and a police officer that acts as though everyone and everything done is an attempt to take his life, im not a coward, liar, or bully. I would love to believe I didn’t risk my life to pay psychopathic pussies to uphold the law guaranteed to all citizen of this nation. Unfortunately, I feel I and many others are being failed in that regard.

Wow. The cop said "I'm going to hurt you if you don't get out." Not I'm going to pull you out, or you'll be put on the ground, I'm going to hurt you. That right there speaks volumes. This is a clear case of arrest for "contempt of cop." Disgusting.

It's pretty disgusting that prosecutors are usually in tight with cops. The DAs office in Scottsdale should've charged Koller with assault (for stating we was gonna hurt Andy) and also battery (for following through) if they had any decent principles.

More critically to this case, it establishes that the reason was not due to an alleged perceived threat, making the claim of a threat based on a "reach" a "hindsight argument" thus not applicable to the objective reasonableness standard.

There is no need for the guy to get out of his car he can say whatever he wants as long as its not threatening to harm the officer, he can tell the officer he just left his mom's house and there's nothing that the cop can do without violating his ammendment rights. So there is no right to ask the man to get out of his car.

The male lawyer was 100% right. When the citizen had his hands up, when the cop opened the door, he was showing absolutely not threat!! Hands were in plain sight. There was no reason to use that force against the citizen!!
