It seems it was primarily the strangeness of his vocal tone that caused the judge to deem him incompetent to stand trial, robbing him of his right to defend himself in court. Simply having difficulty managing a self check-out is certainly not a reason to trespass a customer from a store. These services are not always easy to use. I don't think prisons are filled with people like this man. His mental handicap isn't prominent in the prison system. There are a lot of issues that cause people to become mentally disabled due to drug addiction, but they do have a right to claim that they are incompetent to stand trial and many of them freely plead guilty or no contest and get found guilty by a judge when the prosecutor reads the charges of what the person is accused of. In so many of these cases, they should take their case to trial and never forfeit their right to a speedy trial and force the prosecution to prove the crime beyond a reasonable doubt. There is a log jam in the jails because of all these deals being made for shorter prison terms when a good number of them have a good chance of being found not guilty. In this case, the store and the cops were wrong and it is arguable that the cops knew that they were wrong for making this arrest and even removing the man from the store. They could have helped the man put his money into the kiosk and then help him out of the store and told the store that you can't discriminate against a disabled person. It is highly doubtful that it didn't cross the mind of any of those officers on the scene but not one of them stood up for the man. The man goes to jail, not certain if he was put in a cell with other inmates which could have possibly put the man in harms way, because real criminals have criminal minds and don't care about the consequences because they are likely getting a deal that is much less than the time they should be serving in prison and they know that they are already going to prison, and most of them don't press charges against another when someone assaults them in jail out of fear of retribution later.

The right to remain silent does not mean you do not have to identify yourself or respond to officers commands, it means that during a criminal investigation you do not have to answer questions if detectives are investigating a crime. This makes me absolutely sick. He was targeted and punished solely for being disabled. Even if he seemed "off" or under the influence, he clearly needed help; not to be treated like his mere presence was so disturbing that he was deemed unworthy of the rights of a citizen and even the basic empathy of another human being. Regardless of what he is specifically dealing with, this had to have been incredibly traumatizing and alienating for him to be put through. If shopping and caring for himself is difficult, this likely added a new barrier for him. In a world not build for him to thrive, he now needs to fear of not only the intentions of strangers but the literal people tasked with protecting him. Disgusting.

I've been arrested for resisting arrest. All I did was ask why I was being arrested. I didn't physically resist. They said I was under arrest, I put my hands out to be cuffed. They tackled me down and told me I was resisting. Spent the weekend in jail before arraignment. Felony conviction for asking why I was being arrested. Didn't find out until later that they had originally stopped me for a traffic warrant. I'd forgotten to pay a ticket. They never told me that on the scene of the arrest or the entire weekend I spent waiting to see a judge. After the arraignment for felony resisting arrest they sent me home. Didn't even hold me on the traffic warrant. It's been 20+ years, my license is still suspended because NJ invents new surcharge fines every year for old tickets. I haven't even lived in that state since 1999. Every time I paid them they would create another fine and keep me suspended. Any interaction with cops can screw up your entire life forever.
