Phillip Hamm was on the road with a friend in Paducah, Kentucky when he was pulled over by local police over a busted tail light. Instead of letting him go, the officer held Hamm for over an hour, during which time he forced Hamm to undergo a sobriety test, searched his person, and demanded access to his vehicle. When Hamm declined, the police brought over a canine unit and searched his car. Despite finding nothing, officers tested dollar bills from Hamm's wallet for methamphetamine and then arrested him on felony drug charges. Police Accountability Report examines the footage of Hamm's arrest as an example of how police routinely abuse their power to manufacture the outcomes they want. Phillip Hamm himself also joins the show to speak on his ordeal.

It is, it's called wrongful arrest and I think that if it's a bad case, or a repeat thing (like twice) it should be automatic dismissal from duty and a criminal charge with mandatory probation

In this case he got set up, that cop was following him since they were at the joint they were having drinks that's why he asked to see if he'd lie to him saying that he was somewhere else, this kid is someone's personal project, he admitted that he has a problematic past, that tells me that he pissed off someone and he doesn't even remember, (reminds me of my cousin when he nailed a cop's daughter, the cop hated all of us in the fam because of what he did, he fixed that by becoming a cop himself😝) this is not a regular stop and not a coincidence, this screams pure hatred "we don't want you around here" ... next step seems like could be worse...

My God not only should there be zero charges, he should be significantly awarded monetarily in a lawsuit for violation of his civil rights. Once this is thrown out in court, please sue the police department.

And keep watching your back for the rest of your life because cops murder those who win lawsuits against them. They sent a plainclothes hit team to kill Rodney King years after he won his lawsuit. I mean, yes, sue them, but beware. They kill others who don't get the chance to sue them too. They kill for fun too.

My dad was a cop for 23 years. He was a humble and honest man. He was all I ever knew of the police. I had always associated police with good however, because of these videos I have seen on youtube, it has made highly suspicious of police. If my dad were alive today to see what has happened to policing, he would be appalled. So many thugs with badges caught on video. I just wouldn't have believed it, if I had not seen it on video. I do not believe it is just a few bad apples. If I had to venture guess, I'd say that only about 25-30% are honest. It makes me very apprehensive now to travel.

The number I heard was 80-90%. The drug residue gets transferred from bill to bill by ATMs and bill counting machines that banks use. this is also the reason drug dogs can find cash. They are only detecting the drug residue on the bills ( the more bills , the more drug residue , the stronger the sent is for the dog to find)

@@benonihiggins8204 I'm sure that like 90% of bills would test positive, and a large portion of that would be trace contact transfer, but I'd bet the majority of bills test positive because they have been directly used to do drugs. Also, dogs are very capable of detecting bills themselves.

It's better to say that you invoke your 5th amendment right to remain silent. Be specific. If you don't, the courts have ruled that they didn't violate your rights if they keep asking questions.

It's necessary to delete the notion that the police and the system is only attempting to "protect and serve" to understand their actions. What they actually do is take advantage of the limited bad acts and actors to exaggerate the dangers to citizens so they can elevate crimes and charges and sentences, claiming to need more police, more courts, more jails, more prisons, more prison guards. Their goal is to expand their BUSINESS and salaries and benefits and get more jobs for more their sons and frds and just keep increasing the funding of our tax dollars to THEM while they hammer US with the excessive power we give them. Seeing them in this light you can understand what is occurring and why.

@@mikeswanson6145 seems like thats exactly what decent cops would do Mike but thats not what predatory, bullying aggressive violent thugs with badges do. And because this is what they do and know their other cops do by their "war stories"back at the cop shop, it causes decent people who became police for the right reasons to feel alienated and not fitting in. And when these decent cops voice these feelings they incur mistrust from their fellow officers and higher ranking cops. Comments like "the guys dont know who side your on" are made or "we dont know if you can be trusteed since your sympathy seems to lie with the criminals instead of the guys who are the ones that will race to help you when you need it" And even "if you see things that disturb you about the realities of being a cop maybe you chose the wrong profession?" It does not take a good cop long to feel the pressure to just go along with what is long standing behaviors oand become a bad cop. Either that or retain their moral pricipals and refuse to become one of them and leave the force which is by far the decision made in most cases. It doesnt take long for this series to play out over and over to reach a state of constate balance where the department is well stacked with violent bullies who are out to prove to their comrades on a daily basis how tough and meanspirited they are and how little they actually care about law and order and all of the things the swore to folllow when they took the pledge.. Since we NEVER hear a word about any cops being held accountable for breaking their pledge to serve lawfully what good is this pledge made to themselves about themselves? I think body cam footage showing behaviors clearly outside of this pledge are all that is needed to ban these liars from service. If they cant be honest about their pledges they cant be trusted to take the stand or even write police reports. Start holding these bullies to account for their observed behaviors and how it conflicts with what they are tasked to do BY US, FOR US and when they start seeing harm and penalties from their blatant disregard for citizens and their trashing of their oaths then we'll see a respect for the citizens who hire them and only from monitoring what these guys are actually doing out there can we know if they are they kind of people who we should be turning lose on ourselves. Clearly just giving these people a badge, a gun, and a car and a car and hoping they are doing the right thing out there is not a model that is working or sustainable. It is dangerous and wreckles and leads to what we have now

The scary thing is this is not a isolated incident. Similar acts I'm sure have occurred daily and for years. I know from personal experience that police officers lie, violate constitutional rights, and bend the laws on a daily basis. In recent years much of this behavior has come to light thanks to body cams and personal recording devices. What's even more crazy is that officers don't even care if they're questionable behavior is being recorded. In their minds they are above reproach and that's a very dangerous attitude to take.

Lawyers are lining up to take this case to the supreme court if need be. This case is going to go viral in social media. Especially now that cops can confiscate the money on your person when doing a traffic stop, and test it and if it comes back positive for even the minute traces of any illegal drug(usually contaminated by the handling from random drug users and drug dealers in the past) even when you are innocent, you will go to prison for 4 to 12 years automatically. Cops love this new strategy.

@@ericalexander5890 - I will beg to differ with you on tagging only "red states" that this takes place in as hunger for power knows no boundaries. County commissioners are usually elected as are city council members, who also take their marching orders from their state legislators. Local elected officials appoint others - the good ole boy system of watching each other's backs. Elections have consequences and the people are to blame for what we are seeing today as the process takes place long before the voting citizen gets to the voting booth. Too many allow their ears to be tickled and led astray when the voter learns candidates are promising the most benefits from the public treasury, the voter discovers they can vote themselves largess from the public treasury. The voter also allows themselves to be led astray believing they must vote for so and so as that candidate is the only one with a chance to win. The citizen rustles themselves up a solid Constitutional candidate and then they work their fanny off to see those candidates get elected - basically telling "the party" to stick it. Of course no two states operate their elections the same so this will mean the voter takes on their responsibility to learn the process and no better time to start than now - after a midterm.👍🇺🇸

I have a friend in the Kansas City metro to whom this happened. They literally removed the headliner, trunk liner, glovebox, center console, and seats. Found a few marijuana seeds under the rear seat and promptly arrested and charged him with possession of marijuana. The car was left disassembled on the side of the road (which was subsequently robbed) and the tow company towed the car without grabbing all of the "pieces." Luckily the judge threw it out but he still spent a night in jail, had to pay for a lawyer, and his car was junked.

In Texas, 2012, I got pulled over at 2PM on a SUNNY Summer day for ONE of my TWO tag lights being out!!! My license showed an EXPUNGED non-specific VUCSA charge (no conviction) from 1981, so he wanted to search my (actually, my Dad's) truck. I refused because I was in the middle of moving from Washington to Georgia and had all of my worldly possessions that I had ever owned stuffed into the back of that truck, and I KNEW that he lacked probable cause... So, he then detained me to call in a K-9 unit (dog wasn't even a full year old). OF COURSE, the pup 'signaled' near the front grill of all places. The next thing I know, I'm sitting on the side of the highway with a 3rd degree blistered sunburn nearly 7 hours later, as cops from 3 cars dump all of my worldly possessions out onto the side of the highway. They never did search anywhere near the front where the pup supposedly signaled. They opened up a small denim pouch they found in my jewelry box. I told them it contained locks of hair that I'd collected from my Teddybear hamster, and my horse, when they died. They also found a 3-6 mm long piece of dried leaf entangled in the coil of my horse's forelock. There was NO WAY it could possibly be pot; I hadn't even LOOKED in the pouch since 8th grade, and I only ever smoked pot a handful of times after I was 30 and married. They charged me with possession of less than an ounce with intent to sell (because I was carrying around $500 cash for emergencies), AND ARRESTED ME!!! THREE FREAKING DAYS IN JAIL!!! I INSISTED they test the leaf fragment they found, and that they do a hair test on me. The leaf turned out to be a tiny piece of scotch broom. The whole ordeal cost me almost $500 (civil FREAKING forfeiture), and my truck got robbed in their impound lot. They never even cited me for the burnt-out tag light. Biggest lesson learned from this whole ordeal: If you have out of state license plates, avoid driving in the State of Texas, and NEVER EVER carry any amount of cash with you.

However, once you plea bargain, you're legally guilty of that crime and lose standing to pursue the wrongful arrest and Constitutional violations. They had a tragic story about a poor lady who was essentially financially forced to accept a plea bargain about counterfeiting, but through the Real News Network they got her justice. I don't see that one right now, but maybe somebody else remembers it.

Same here, my friend. I was pulled over by a cop in Greeneville, Tennessee, and told the reason I was stopped was because I crossed the white line. The only problem? The cop was IN FRONT of me. He lowered his window and stuck his arm out, and pointed to the side of the road for me to stop. Then he tried to say I was DUI. I, too, had an injury and couldn't perform a field sobriety test. This was one of the most notorious, crooked cops in the state of Tennessee. (Vince Mullin state trooper) That was 10 years ago. I've been keeping tabs on the cop and you don't have to worry about him any longer. He has joined the ranks of the dearly departed. Dear to some I guess. Personally, I say, as with every other dead cop, GOOD RIDDANCE. I hope he got right with God for all the lies he told before his passing.

Back in the mid 70's. The Gainesville, GA PD was the worst for violating Beer Truck Drivers. I was pulled over and charged w/ DUI. I had NOT been Drinking ! I was just driving a Beer TRUCK FOR MY JOB. No Tests, no Road side tests, no BAC test. Just straight DUI charge. Jailed for the night ! Thank GOD My Company had a good Lawyer and set those tyrants straight. I should have sued the hell out of them for false imprisonment.!! I was in my 20's and not too well informed. Today, I would OWN Them !!!

Additionally, the rules of evidence should logically preclude such nonsense as testing currency which has 1.) been in the possession of others, 2.) not proven "sterile" prior to possession by the accused, 3.) been in immediate contact with contaminated objects (other currency). Good defense demonstration in court: bring in the same test kit used in the arrest and test currency in the possession of the judge, prosecutor, bailiff, court reporter and arresting officer.

The reporter was not truthful with her narrative. she never reported that they found drug paraphenalia, she only reported they happened to find a rolled up note that had evidence of drugs. That happened was found in zip lock bag ,plus they said they had been drinking which officer confirmed he could smell the alcohol. The video shows them crossing the line on both side of the lane they were driving in. It's amazing to me that anyone watching this video is blind to see how the driver swerved across the white lines.

The cops tracked these guys in real-time and they chose the time and place to pull them over, for maximum terror and inconvenience. Notice how the cop uses fake friendliness and voice tones to lull the guys, get their guards down a bit, make it sound like he's just doing a quick routine check, being helpful, this'll be over soon, etc. He's lying - with his voice and body. Everything about this cop is a trick. Notice how the cop asks all these questions, working it into the conversation, like have you ever interacted with the police before, etc. The cop calls the one guy 'bud'. This is not friendly, it's condescending and it's meant to show the citizen that he's low, basically a boy and that the cop is the real man, the big man and to gain compliance from the citizen. The driver tries to play it cool, trying to seem forthright and open with the cop but the cop just keeps tearing into him, asking more questions, digger a deeper hole. The cop claims he can smell alcohol on the driver? What? The driver says 'Okay.' Then the cop waits for him another time, as punishment, personal revenge, for the driver having filed a complaint about him. They torture us with the arrest process. That's what this is.

Just another victim to them - they could care less about what rights they violated, as long as they got that dollar bill to come up positive on one of their tests, that’s enough to convict someone for 3 years in their eyes, and throw them in a cage for daring to possess a dollar bill with traces of drugs on them..

Back in the early 90's, the Waukesha cops pulled me over for "swerving in my lane"... after following me / tailgating me with their high beams and searchlights for nearly a mile.. making me nervous, and temp. blinded at times, at night, as I was driving to my job. I was pulled over, questioned, searched, and then coerced into having my car searched. I was told: "Your refusal to allow us to search your car, is the probable cause we need to search your car." "We can do it the easy way or the hard way. Your choice." I was told they would have to make me wait even longer..(I was already late for work, during the probationary time of my new job, where I needed to have perfect attendance for the first 90 days).. for their K-9 unit to arrive..if I refused. So Im like.. Oh well... might as well... since they say that there is basically no refusal no matter what.. From there, they literally tore my car apart..! My stereo system was destroyed, they damaged the cords to the amp, the speakers, ripped off the inner door panels, and broke the fasteners, (This happened in the middle of January, where it was very cold).. yanked out the floor mats.. the contents of the glove box were strewn all over the ground. Then they opened the hood, took off the air cleaner assembly, tossed the cover on the ground, damaging that, pulled out the air filter, tossed that. yanked off the amp wires.. (I wasn't even playing my stereo while driving to work).. Then when that was all done, and they couldn't find anything at all, perhaps because I didn't do drugs of any kind, they wrote me a ticket for failing to stop at a controlled intersection. Even though, I was fully stopped at the light on Moorland, when I made eye contact with the cop, sitting in his cruiser parked at an ice cream shop, as I was was checking for traffic. He says to me, that my car wasn't shaking from stopping. "If you had stopped, your car would have shaken a little bit, which it didn’t." That was bull, because I was fully stopped, and checked twice, even though he made no mention of these at the time I was pulled over. All together, 3 squad cars had me on the side of the road.. Thankfully my boss recognized me, or I would have lost my job! The cops then falsified the report, and made no mention of the search. I tried to explain this to the assistant DA, who called me a "Liar"... "How dare you lie about my professional officers.".. I later plead No Contest to the charge, because....1. I traveled that route every day, and was afraid of the cops retaliating and making things worse for me, perhaps planning evidence next time, and the fine was low enough to pay it and be done with this bullshit. Prior to that, I had a favorable opinion of the police. That was the first of several total BS interactions I had with the police, which I now have a rather negative opinion of the vast majority of cops. I back the badge for the most part, because I do like a society of Law & Order, but I can do without all the crap.

Loveland Co native here. I can't tell you how many times I've been pulled over. I've gotten so many lame tickets after being searched and nothing being found. Also have been told I was driving in an unnatural driving position. I'm tall so my seat is usually pretty far back.

Do not consent to any searches or seizures, ask for an attorney, and invoke your 5th amendment right to remain silent. Hand over your ID, only if they have a legal reason to do so. When ordered out of your vehicle, calmly exit the vehicle. If they place you under arrest, do not resist in any way. Above all, ALWAYS record your interaction with police.

It’s not just Western Kentucky. It’s a statewide problem. Sad and pathetic. It’s not just the police in Kentucky but also judges, prosecutors and county jails. Not to mention the Kentucky Dept of Corrections. I know of a man that was held 1,558 days with being convicted of anything. They will hold you until you plead guilty of anything just to get out

I remember a study conducted years ago, where a research team collected many thousands of random dollar bills from every State and examined each of them. They found that almost all had cocaine and/or other drug residue embedded in them. So the chances are that most people in the U.S. have drug residue on the bills in their wallet. I'm sure that all Police Officers are well aware of this.
