the companies that help me understand trademark classes best are Dove Chocolate and Dove Soap - same name, different companies, assigned to different classes of goods and services so they are allowed to exist concurrently and there is no likelihood of confusion

I make crafts (t-shirts, cards, etc) and my daughter asked me to recreate her favorite KZbinr’s t-shirt. It wouldn’t have taken any real effort, but I refused. I told her if she wanted it, she could save her allowance and buy it. We then had a trademark, copy write, and patents discussion. I asked her if it would be okay for someone to copy her homework and turn it in as theirs (best analogy I could come up with on the fly that she would understand). She never asked again.

@@laum5371 respecting that Cristine and ben have worked hard to create their own brand and come up with the product is also really important. the young girl wants to show her appreciation for that KZbinr there are many ways to do this but she is knowingly trying to recreate something they have spent time and money on. for example, fanart supports them but doesn't damage them financially, making counterfeit merch does. I personally think for more independent creators this is really important but if it was, say, someone like Kim Kardashian that the kid liked not so much.

I remember my daughter asking me to take her to b&b works bc she wanted to get your hand sanitizer but when we got there and I saw it I had a feeling you were being ripped off. I told her we would come back for it after I looked into it. I felt it was completely shady and wrong. Needless to say we didn't go back to get it. Recently we were at the dollar store and I saw a clear top coat but it said clear taco. My phone was dead otherwise I would've taken a pic. Next time I go I'll look and try to find it.

The taco bell letter was so well done, not just because it was playful and shows goodwill, but also because they understand that there may be a real issue because of how big they are. Picture coca cola, they have made apparel, make up, toys, lamps, Christmas decorations, they have done everything and seeing how food brands become more and more fashionable (think forever 21 x Cheetos collabs or any other collab with a make up brand) I can why they would think that there could be an issue with a random person trying to file the word "taco", but at least they recognize that you have a big enough brand that it could negatively impact them and also admit that there is place for both brands to coexist. I really like these videos about the other side of youtube as a business because I feel like most youtubers are overprotective of that information so it's really interesting

Wow I remember when that all happened and what a surprise it was, and it’s so disappointing to hear they were so unhelpful in their legal exchanges (although I do totally understand the legal strategy they took). Makes you wonder if they did an internal review of some kind to reprimand whoever made the booboo in letting that product get out the door without doing trademark due diligence. Also I hope if Taco Bell ever decided they want to try nail polish that they would collab with you. And you should send that amazing TB lawyer a PR package with an equally punny letter. 😆

What I don't understand is that places like Amazon and even eBay know that counterfeit merchandise commonly comes out of eastern Asian countries (or I'm assuming they know because even I know and I'm usually somewhere in the late middle to last to know of things like this) yet they allow these places list on their site and it's usually thousands and thousands of products. Hell, Wish is mainly, if not all, counterfeit merchandise. What's worse, is that especially on eBay, these companies are lying and saying they have a warehouse in Canada or USA or wherever, yet, when you screw up and order something from them, it comes from one of the countries in question (ex. China). I'm starting to notice more and more "mainstream" businesses allowing other companies, including these distrustful companies, to sell their products on their reputable websites. What's worse, is that 9 times out of 10, you can tell that it's these counterfeit places because they are the ones that usually have the long, repetitive, odd descriptions and they are (usually) a lot cheaper than similar products cost. P.S. To try and avoid having these places listed, try to click/tap on the "Sold by [actual company's name]" or on Amazon, choose "Prime" - you still need to use discretion for Prime, because it can be "[XYZ} fulfilled by Amazon"

I always thought that Wish was a Chinese company and that would be the reason why they can sell this stuff, because it is difficult to have a lawsuit against a company in an other country. But I agree with you that this trend is bad. Maybe there should be fines also for the websites if they did not control their sellers enough

I agree with the fines; it's a good idea but it would be kind of difficult to get every country to sign off on it and then, who gets the money for the fine? I would imagine the actual company that is the originator of the product(s) but then "the internet police" would need their cut too. It's a big mess.

Ive commented this multiple places but im hoping holo taco can offer a monochromatic box of all available colors. Specifically a purple box containing all the purple polishes. But also all the blues and all the red/pinks etc And/or provide a box design for a build your own box. (Mine would be all the purples lol) doesn't even have to be as fancy as the collection boxes but I'd save up every penny to be able to buy a custom box of nail polish. Also, I'm sure you're already working on it, but holo taco magnetic polish would be amazing. (Especially in purple lol) 💜

Here’s my question: how did that other company with “sexual” know about your trademark? Does their lawyer just regularly look out for sexual trademarks or do they get an alert or would that come up during review of your own trademark?

They most likely have a lawyer that looks up and looks out to these things (similar to cristine) and notify the company. Not to mention, cristine mentioned that on the trademark registration process, the examiner will publish the trademark registration and other companies will look out for it.

IP legal firms generally have watch and maintenance systems so that after a trademark application is published for opposition purposes by the corresponding Trademark Office they can cross-reference that information with their records to see if some of their clients' trademarks are sufficiently similar (though other reasons may be applicable too) to serve as basis for opposition. If that is the case, they will alert their clients who will decide if they want to oppose or not.

When a certain influencer copies dozens of make up looks, vocal arrangements , clothing and sister suffers no repucusions due to the fact theres no copyright issues there or there is but the other side dont have the finances to fight it- that gets me wound up something chronic.
