@@leza6288 it depends on the situation usually, if law enforcement plainly sees it was self defense, they usually dont arrest you but if they have anything they think they can charge you with, they will arrest you. Its best to not fight the arrest, talk to your attorney as soon as its possible and they will get you out. Fighting any arrest will only hurt your case, sometimes its something you have to deal with in the beginning. Also depends on your state, some states will arrest you and charge you even when its obvious it was legal.

I'm in Massachusetts. Years back, I shot a home invader. The cops took all my firearms and my license to carry until the ADA told them he was cool with me having them back. It took almost 3 months to get most of my things back. They kept the revolver I used for almost 3 years. The guy had pled guilty and was already in prison before I got that one back. Some weapons got damaged in the process. This incident got me into the 'Armed Citizen' column.

White, older, I think he has an unusual name. He's into gun rights. He has a video on what to do in these situations. It's a bit more nuanced than the advice here.

No contact for nearly 2 months, Gloria (suspect 2) remains outside in the vehicle, ATM on location (tattoo parlor), Brandon (suspect 1) 1. accusatory, 2. sucker punches, 3. pulls the gun out pointing at Sam. Grill was never the real issue, everything points to a possible armed robbery attempt by Brandon and Gloria was the get away driver. Gloria heard the shots from inside the tattoo parlor, Brandon comes out running, Gloria assume he's being chased so she does a cover fire. The suppose spat was just the cover, but the CCW fouled their attempted robbery scheme. I would not be surprised the detectives draw a similar conclusion. JMO

I don’t think this was a robbery. You wouldn’t bring your kids to stick up someone. They potential witnesses if they see them with cash, jewelry etc. It’s obvious Gonzalez and Clay’s baby momma had a threesome with someone - possibly Brandon. I think Clay found out about the threesome and was heated because he doesn’t trust Gonzalez. Gonzalez tried to insert herself in the argument and Clay essentially told her to mind her business. Gonzalez took exception and somehow manipulated her brother to go after him. Why that day? That’s what I don’t know. Maybe the baby mama & Gonzalez broke up as friends later and she wanted revenge. Either way Gonzalez is manipulative and is the primary reason her brother is dead.

@@runninggreywolf8313 correct, it would have been better if a lawyer was present. However, Police Departments vary greatly in how they treat a shooting. Some go by the standard of charge every shooter regardless and let the prosecutor decide if the charges should be pressed and some Police Departments will only do the report and not file any charges with the prosecutor ( a report is till sent to the prosecutors office for review). The Police will question the shooter as a minimum requirement and confiscate the gun as evidence (99% of the time) until the prosecutor informs them they are not pressing charges. Then it varies by state on how owner gets their gun back.

Hence my understanding of this honest and straightforward young man laying it out because he did nothing wrong. Any backup in an interrogation is a plus, I was a union steward for the National Association of Letter Carriers, and the Weingarten Rule is like the Miranda right to representation. But, you gotta ask for it. I sat through some really gut-wrenching stuff and went to arbitration where someone's career was at stake. Always have a witness, and an attorney is a good choice.

A 25-year-old woman has been sentenced to five years in prison for shooting an employee at a Lakewood tattoo shop after a fight over a threesome led to an exchange of gunfire that killed the woman’s brother. Gloria Gonzalez pleaded guilty in Pierce County Superior Court in November to second-degree assault for the Sept. 2, 2021 shooting at the business in the 10200 block of Bridgeport Way Southwest. On Wednesday, Judge Alicia Burton handed Gonzalez an exceptional sentence above the standard range of 39-45 months in prison as part of a plea bargain, according to court records. Gonzalez was the only person to be charged in connection to the shooting. The defendant’s brother, Brandon Toj, 19, was shot multiple times by an employee at the shop after Toj allegedly punched the employee and then fired several rounds that didn’t hit him. Lakewood Police Department spokesperson Sgt. Charles Porche said Friday that detectives’ investigation found the employee shot Toj out of self-defense. After Toj collapsed on a sidewalk in front of the business, Gonzalez picked up her brother’s gun and shot a different employee, shattering the man’s pelvis, according to court records. Toj was taken to Madigan Army Medical Center, according to the probable cause document, where he died of his injuries. The man Gonzalez shot was transported to St. Joseph’s Medical Center for treatment. Gonzalez was arrested outside the tattoo shop. The defendant was charged with first-degree assault the day after the shooting, and Pierce County prosecutors wrote in charging papers that Gonzalez and her brother had gone to the tattoo parlor to confront an employee about a “past issue.” After Gonzalez was arrested, she allegedly told Lakewood police officers that she and Toj had been involved in a threesome with the employee’s girlfriend, and that this angered the employee, causing him to shoot Toj. Police noted Gonzalez appeared intoxicated. Police said the incident started at about 6 p.m. Records state Gonzalez and her brother parked outside, leaving Gonzalez’s two children, ages 2 and 7, in the car. Inside, Toj punched the employee, possibly breaking his nose, and a fight broke out in front of customers and other employees. According to the probable cause document, Toj and the employee exchanged gunfire. The siblings left the shop, and Toj collapsed outside. Records state that’s when Gonzalez shot a different employee. “He stated that after the shooting stopped and Toj and the defendant ran out of the shop, he attempted to close the front door, but was confronted by the defendant who was standing in the parking lot holding a handgun,” prosecutors wrote in charging documents. “[The employee] stated that the defendant accused him of shooting her brother, and then fired at least one round, striking him in the left buttocks.”

Every time I’ve seen a cop or former cop questioned in an official interrogation setting, they have ALWAYS had an attorney with them. Every time. THEY KNOW ITS 100% NECESSARY TO PROTECT THEMSELVES WITH COUNSEL! We as civilians have that right and no matter how innocent you are, ask for an attorney!!

They’ll get you an attorney after about three months if you sitting in jail. The cops know he killed the guy. If Clay doesn’t claim self defense, no one is going to claim it for him. They would just throw him in jail until the public defender has the time to tell the investigators/prosecutors EXACTLY the same thing that Clay told them to begin with.

If you were guilty then I could understand why you would not want to help,the police. The vast majority of videos that I have seen , where someone insists on having their lawyer present , it turns out the person is actually guilty.

@@DMSJagXK It’s not about not helping law enforcement… it’s well known in the concealed carry community NOT to talk to law enforcement without your attorney. A shooting, justified or not, is still a lethal force incident and has all sorts of serious legal consequences that can, and often do, result in criminal charges being filed on the person acting in self defense simply for stating things incorrectly or in a manner that an overzealous prosecutor can use to charge. This can vary widely from state to state, county to county even in some jurisdictions.

If your wife or children had been murdered, you would be a suspect. Would you really not do all you could to enable the police to be able to not waste time investigating you?

As someone who works homicide scenes with the medical examiners office, alongside police, I get to see how police operate when piecing together a scene. If the police don’t have any cooperation, they may overlook evidence or witnesses at a scene. Once they clear the scene, a cleaning company may come in, and possibly throw away evidence that you needed to prove your innocence. (Is a hammer on the ground in a garage a weapon, or is it a misplaced tool?) I’d call 911, say I was a victim who had to defend myself. I’d say that suspect is hurt, and needs an ambulance. When police are on scene, tell them you are a victim, and you want to press charges. Point out the suspects weapons, and identify any possible witnesses. When police want you to describe the events, tell them you are more than willing to cooperate, but first want to contact an attorney. Police officers get a cool down period before having to make any statements after a use of force incident, so don’t be ashamed. You might go to the county jail for the night, or the week, but who cares. You need to focus on the bigger picture of staying out of prison.

You’re right, but if you’ve never been in the situation, it’s really hard to gauge every correct decision to make. While you’re at home typing this in the warmth of your home 😂 it’s easy. Try actually shooting a mf in self defense and then being arrested…the amount of bizarre thoughts that enter your mind before “hmmm I’m not talking until I get a lawyer” is astounding.

Also property is never justified to defend unless "they" are throwing molotov cocktails or the like. Payment for damages and restitution are things to know exist. Cameras for evidentiary proof are another great thing to have.

@@sarahm.1632 exactly in some states he would definitely be charged. In California he most likely wouldn’t be going to jail. Just by him saying he ran inside and grabbed his extended magazine and went looking for him. That changes it from self defense to revenge or intent. Some states you can go out and chase them if you know your family is outside waiting in the car for instance. Firearm laws are very exact and the modern world for some reason really hates those of us that choose to carry a firearm. This is why it’s so important to know the laws in the state you are carrying in because they can change dramatically from one state to the next.

After I bought my house & rehabbed it folks in the community (renters with no hope/sec8) were constantly talking behind my back, screwing with my car, puncturing my tires ON camera. When I have (5) cameras facing the front. I got a license & all that stopped. All I did was pop a few rounds off on new yrs like everyone else does & folks started heading for the hills! It was crazy how they were booking it outta here. I felt like without a firearm these folks were just gonna come in the house, alarm co. be damned. Its hard to live in peace sometimes!

I have seen video's of police officer shootings. They give the shooting officer 48 or 72 hours before they have to make a statement and have an attorney present to advise them. Same should go for a private citizen.

This video is a great example of why you don't talk to the police. The interrogator is framing his questions to trap him. SO how do feel about Gloria- "I don't like her" So there is tension between you and her" He does a great job of getting out of that by saying he doesn't have tension because he doesn't talk to her. Several more questions were framed the same way. A good lawyer would have the officer rephrase the question or not have him answer it.

A double shooting at a Lakewood tattoo parlor stemmed from a fight over a threesome involving the dead man, his sister and the other victim’s girlfriend, according to court documents. It started just after 6 p.m. when Gloria Gonzalez, 24, and her brother Brandon Toj, 19, went to a tattoo parlor in the 10200 block of Bridgeport Way to confront an employee there “about a past issue,” prosecutors wrote in charging papers. They parked out front and left Gonzalez’s two children in the car, ages 2 and 7. Once inside, Toj allegedly punched the employee, possibly breaking his nose, and started a fight. He fired several rounds at the employee but did not strike him. The employee then pulled out a licensed gun and returned fire at Toj, hitting him at least four times in the chest. Gonzalez and Toj left the tattoo parlor, and he collapsed on the sidewalk out front. That’s when another employee was shot by Gonzalez, records say. “He stated that after the shooting stopped and Toj and the defendant ran out of the shop, he attempted to close the front door, but was confronted by the defendant who was standing in the parking lot holding a handgun,” prosecutors wrote in charging papers. The second employee “stated that the defendant accused him of shooting her brother, and then fired at least one round, striking him in the left buttocks.” Police were called to the area and found a “chaotic scene,” records say. Gonzalez was standing outside the shop “screaming and waving around a pistol,” covered in blood and yelling about who shot her brother, according to court documents. Officers took her into custody after watching her charge a man and shove him. A bloody expended shell casing was found in her leggings, which police believe she purposely picked up and tried to hide. Toj was taken to Madigan Army Medical Center, where he died of multiple gunshot wounds. The employee who was shot was taken to St. Joseph Medical Center in Tacoma and was listed in stable condition. Gonzalez was charged Friday with first-degree assault for allegedly shooting the employee. She pleaded not guilty and was ordered held on $150,000 bail. Police said she was intoxicated when arrested and told detectives the employee at the tattoo parlor was mad about a threesome she and her brother had with the employee’s girlfriend. If you lawfully carry a firearm for personal protection, the best thing you can do is get legal protection in case you have to use your tools for defense. I’m a retired LEO. Don’t ever talk w police without an attorney. Your only response should be “I really want to help you & will cooperate fully however I need to protect myself and I want a Lawyer “. Then don’t say anything else until they get there. You may sit in jail until they get there but it’ll be worth it. You can give your name & address but anything else should only be said w a lawyer present. Don’t fall for “we’re just trying to clear things up” or “we just need some help to close the case” etc. they have a job to do. Get a lawyer Lastly if you own/carry a firearm you need insurance. I use USCCA. Their lawyers specialize in the 2nd A and shootings. Let them talk for you

Its a random interrogation, some ppl like to watch it to see how the interrogator tries to catch the person they are interrogated and also they wanna see how the person defends themself or tries to lie

Look up “tattoo shop shooting Lakewood Washington” the guy in the video killed the other guy but was deemed innocent due to self defense.

I teach CCW/PCP in Ham Lake, MN where I STRESS to all my students NOT to give any statements until they have an attorny and they have had at least 24 hrs. before any interviews.

"I want to cooperate with your investigation so I will answer all your questions with my attorney present." And multiple cops will ask you so they can write it in their notebook so always give them the same answer. You're going to spend some time in jail until an attorney can get to you, but they have the best advice. No matter how clean you think the shoot was or what kind of threat you faced. Shut the hell up and let your attorney defend you.

For the record Glocks actually do have 3 safeties which are all passive rather than being a mechanical safety that you click on and off. If you're using a proper holster designed for your pistol then it is perfectly safe to carry it with a loaded chamber and in fact hundreds of thousands of law enforcement officers and citizen concealed carriers do exactly that every day. Train with your firearm and carry it in a manner that allows you to use it as quickly and safely as possible. It worked out alright for this guy but I personally would rather carry a G19 with a 15 round mag and one in the chamber than a G27 and have to dig in a back pack for an extended mag.

Word up. I deleted the external safety on my S&W M&P Mod 2.0. I appendix carry it as well as my M&P Shield, which also has no external safety, with one in the chamber. I also sometimes appendix carry a 1911 in .38 Super, also with one in the chamber. The designers of these weapons knew what they were doing. If I can walk around all day with a round chambered and pointed at my nuts, so can anyone.

Just an observation of the silliness that occurred. Interview starts with both people masked and on opposite sides of a plastic window. It ends with no masks, sitting next to each other. Don't ever let them bring those "rules" back.

They literally can't question him without reading his rights first. They're never going to read you your rights *after* they question you, because that would make no sense. You should still definitely get an attorney before you say anything though.

Stuff is getting crazy out there. This man's words as he was talking on the phone to the tattoo shop owner really hit me in the gut. "I'm just trying to succeed..." and the part about how when everything is starting to go well, bullshit rears itself in some way shape or form. I felt for this guy. I don't know how or who this story is about - I'd like to read what happened (per the media, *sigh). Was the guy who he returned fire on get hit? Anyways, if there is ever a chance that this guy finds this video and reads these comments, I just want to say that I'm sorry this happened to you. I'm glad that you were able to protect yourself.

I bet this whole situation happened in under 5 seconds. I couldn't imagine having to make a decision like this in that short period of time. After something like this happens, you have all the time in the world to think about the why's and what if's, but in the moment you don't have seconds. Praying for the people who have had to go through something like this 🙏
