You apparently forget that Disney has LONG been known to be worse than soulless. It was a general fact that Disney was villainous, right down to the last scummy stockholder. They don't really have to solve a PR Nightmare that is essentially confirming AGAIN what loads of people have known for decades upon decades. They're doing this to scare people into never challenging Disney, and hoping that it works well enough. Still, you gotta give it to them. It's ballsy, I'll say that much. It's worse than the spiderman tombstone travesty.

There was a huge lawsuit over piracy in Australia. The defendants ended up getting fined......the cost of buying the DVD of the movie. There haven't really been any other cases since then, hahahaha

Right and wrong is subjective. If the "wrong thing" is the thing that's better for me, then it's the right thing. I don't care what the right thing for a company is. If the company made and sold their product ethically, I would allow their opinion. If they don't, then their opinion, their revenue, their very existence all become meaningless to me. America decided companies should be treated like people. People suffer the consequences of their shitty actions.

Its bullshit in case of many games though. Piracy being a solution when it isnt in cases for many games that are just not possible to play and own, esepcially cases for pc only games that got stupidly updated and taken aways or rely.on online for biggest chunk of its gameplay. Such cases are Warcraft 3, Overwatch 1, Counter Strike Global Offensive, all of which are effectively entirely gone in their original versions permanently and impossoble to pirate and enjoy in original with people online in its full and intended way ever since replacement or horrid remasters entirely replacing the og version. Similar cases can be made to updates that delete content from og releases like GTA IV being butchered on its 10th anniversary and EFLC standalone expansion being just impossible to have as pirated gane as noone even provided it, its only base GTA IV that you might still find online on shady sites, but never Episodes from Liberty city. Only way to play original releases is on PS3 if you want radioes as they were before the butchering update.

Yeah, but don't worry, people are fighting back and it's working. For example, in last few years the non-competing agreements became illegal in the US. It was illegal for a long time now in socialistic countries like EU countries, of course. Common socialism W as always. Before, when a company takes you to a job in US, they could ask you to sign an agreement that said that you can work for them but then if you leave, you can't work in that field anymore. Now it's illegal. Same is probably going to happen in this case.

Facebook is one example since most people are on there and the alternatives are often kind of empty which defeats the purpose of a social network. sometimes it's very difficult to establish alternatives and even if there are: they often have very similar TOS. ToS should NEVER be allowed to be altered after the initial purchase. ToS should legally be made so that an average 5th grader can understand them. ToS should not be more than standard size characters on an A4 sheet of paper and be no longer than what those words would cover on a sheet of A4 paper for standard purchases and basic agreements

In Germany we have this ruled by law. ToS cant be misused. Companies can write what they want in their ToS, but if it goes against general consumer understanding and the intended purpose its not applicable

Always make a physical copy of any agreement that you sign immediately. That way if they decide to change something, you have your own copy of the original to prove that it was altered after you signed it.

Even F*cktbook changed their terms of service, after I joined years ago. In my contract, as with most people's contracts, both parties (them and us) agreed that no advertising is allowed in personal timelines/news feeds. Yet they bombard people with unsolicited advertising. That unsolicited advertising is also a breach of the Australian (where I live) spam act. The act makes it illegal to send unsolicited advertising in an electronic form. (The act doesn't specify just emails, as some people assume it does.)

The ONLY way to access certain content is via these awful, draconian services where you have massively eroded rights and levels of service compared to what was common place decades ago. Technology was meant to ENHANCE product offerings, not artificially restrict it. When a corporation is being maliciously harmful to the consumer, do not be surprised when the consumer decides these new terms of engagement are not to their liking, and turn to alternative means. Whether corporations like it or not, piracy is a competitor, much as I dislike Steve Jobs and his shitty walled garden fashion accessories people call "phones", he at least understood this concept.

Remember the threat that is printed on DVD's for years and years saying you'll be liable for $250,000 and up to 5 years in prison? I noticed on a Bluray yesterday that the figure is now $302,500 and up to 5 years in prison. I guess that's inflation talking ? Don't know why they didn't round up tp $350,000

Either way the name on the internet account would be held liable as usage is your responsibility. And yet, as I pointed out, even the FBI can't find that kinda proof. Plus all you have done, is is prove he owned the device, but doesn't prove that A, the device was used. Mac Addresses can be spoofed and faked. Didn't prove it was his IP and Networked. Didn't prove it was to his specific device, and didn't prove it was HE, HIMSELF that used it and not a Virus, or third party like a friend, family, or burgler to prove that HE, HIMSELF, SPECIFICALLY, did it. And without that proof, you can not even legally request his stuff to check with a Warrant, as that would be too broad of a fishing expedition and a violation of a citizen's 4th amendment right. You proved nothing, except you have a lot of illegal tools we should destroy and harm you, the government and companies, for having access to and using against american citizens illegal and unconstitutionally.

@@nicreven There was a massive investigation by various corporations to try to prove how "harmful" piracy is. The results showed that it if anything, it actually makes them more money because it causes more word of mouth spreading, especially for lesser known things or smaller releases. Availability is your most powerful tool, along with ease of use, which piracy usually allows for. Because the results didn't show what they wanted, they basically ignored it. They were going to use it to release to the public, but it didn't prove what they said it did. Even in indie stuff, piracy actually causes it to spread more too. Thing is, most pirates are either too poor to afford it anyway, so it's not a lost sale (given that over half the world is lower class or below, this makes sense) or they are trying before buying and will buy the product if it's good. I've bought things before I don't even play to support developers I like. I'm a big voucher of voting with your money and rewarding good behavior/products by indie and AAA alike. When I can afford it, I have a list of things I'm going to purchase when I can. Also, buying from the publisher still connected to the creator of the game/music/movie etc. is better than second hand, because those sales aren't really counted the same and don't go to the people you want to to make more things. There are some fringe cases in which an Indie developer is hurt financially by piracy, but those are more rare than people think. Most of the time, if piracy was enough to tank it, it just wasn't a good enough product. Most people don't pirate. It's a small minority who do. Just like most people don't use Adblock because people still make money, in many cases, millions on KZbin. Corporations whining about either are just mad that they think they're losing on a tiny portion of revenue they assume they would get otherwise. In the case of piracy, they're generally wrong. In the case of adblock, they should curate their damn ads to not have viruses and porn popups.

If they settle other people will start including Disney in their lawsuit even if Disney is not at fault. Disney does not own the restaurant, they own the land. The owners of the restaurant are still on trial. The owners are overseas businessman so it’s unlikely plaintiff will get money.

This hasn't been ruled on yet. Unless there's an activist\bribed judge who's willing to put their name on a ruling that you can loose your right to sue a company that killed your loved one by agreeing to a ToS Disney will lose this motion. Even in New York or CA they'd probably lose, anywhere else... I think they're really just trying to drag things out long enough that the husband can't pay his legal bills and drops the suit. That's Disney's usual legal strategy.

Louis. Last year congress tried to push a bill called the Forced Arbitration Injustice Repeal Act (FAIR act for short) and it's currently stuck in committee. The intention of this legislation is to ban company's from being able to compel forced arbitration contracts. Forced arbitration enables company's to avoid accountability to people who should be able to have their day in court and touches almost every kind of agreement from the purchase goods / services to hiring agreements. It is insane. I would very much enjoy seeing you channel your power for good in bringing this institution to the ground because every company uses this bullshit and if there's anyone who won't stand for bullshit. It's you.

It's not just tightening. The parts that slide don't have the right surface properties or shape. You get effects like tightening deforming them so only the center has any pressure, where it has the least leverage to stop it folding. Adding a rubber washer might help.

It can't. It's not how the law works (if what I've read about this particular case so far is correct.) Ultimately, it won't stand in court. It's just a scummy trick the horde of disney lawyers are trying to pull off to scare their victims. Ultimately, Disney has entire truckloads of money to waste. It really isn't about that. It's about creating terror in anybody that would stand up to disney via a lawsuit. And it works. Most people, myself included, barely know anything about how the law actually works and what will or won't stand up to scrutiny in court in the US. Disney will have sacrificed what little reputation they had left with the type of audience that actually pays attention to their scumbag behavior, and will win in the long run by actually showcasing that they truly are the unstoppable juggernaut of a villain that we have all known them to be for a long time. That is to say, they will prove once more that you are playing with your life and your finances if you do anything against Disney.

That's not how it works. They have essentially said that but using the arbitration as well because it's cheaper to do than to fight in court over the fact they aren't responsible. As well they used Disney's fact they had the menu as roping Disney into this lawsuit, so I would say this is exactly why arbitration is good because it is there to stop lawsuits like this where they name a party whose real only fault was it was on a piece of land they owned.

Actually, I had a similar experience! I was at a restaurant in I think Universal Orlando, and I ordered a noodle dish. I explicitly asked the waiter if there was buckwheat in the dish, as I am fatally allergic. He assured me there wasn't, that it was something called "soba". Luckily, I just happened to look up what "soba" was before taking the first bite. News flash: soba is Japanese for buckwheat. If it hadn't been for my impulsive decision to look up this food term, if I had just blindly followed the waiter, I would have gone into anaphylaxis.

Supporting disney at all has been a bad call since around 2012, and honestly every other service of the current day, but if we're going to be a "law abiding citizen" I would hope to be treated like one.

The time has come for some high court to rule that these "EULA's" (those dreaded "I Agree" buttons) are void, unenforceable, and possibly illegal. First, any click of "I Agree" is done under duress----as the only other option is to junk the new product and throw your money away. Second, the average person does not have the means to hire a contract lawyer every time they purchase a new product (yes, those "agreements" are that complicated).

He is suing for just 50k, because the restaurant isn't Disney owned. Disney just has the information on their website that you can get allergene free food at the restaurant. I can be wrong on this detail, but as far as I know they don't even claim that every food in this restaurant is free of allergenes. If that's true, Disney isn't at fault for them ordering food that isn't save. That's something they have to communicate with the Restaurant. Also just as far as I know they did ask the restaurant and the restaurant made false claims. That's why he also sues the restaurant for a way bigger sum. If all of that is correct, the only thing Disney is responsible for is the informations on their website, which possibly aren't even wrong. I still agree that the arbitration thing is still complete bullshit and Disney needs to be criticized for it. I'm all in for that. I just don't think Disney shouldn't be criticized for something that isn't their fault. And regarding the arbitration bullshit: It has absolutely nothing to do with the Disney+ free trial. Disney clearly stated that the arbitration clause they are referring to is from the account the couple made on their website to buy the tickets. That account is recent and directly connected to their stay at Disney and thus their visit at the restaurant.

Under any normal circumstance, the company owning the restaurant would have settled fast - but Disney is a pile of shit that is almost the worst if not the worst (Google and FB are perhaps more evil) and wants to not pay a thing even though they are in fact entirely responsible. Are you suggesting a man's wife dying because a restaurant fucked up would not lead him to sue if its was not-Disney? We have a mountain of history to show you are wrong, and in many cases, much worse than a settlement happens to that location or the whole franchise. Since I live in a region that's often forgotten or gets limited (the Balkan, specifically N.Macedonia), I've learned from a young age to torrent. Every person here that knows how to turn on a computer has pirated something in their life. I've never had netflix, even in its heyday, and I've exclusively pirate everything. Only for media that I truly love I will pay, and in a physical form (especially music, manga, books and so on). Plus piracy here is technically legal, so I don't have to worry about it. Many people from here who live in the west to work (Germany, France, Austria, Denmark and so on), come here to pirate many things, especially movies and software.

To the people saying you should have read the agreement........ Corporations are betting that you don't have time to read 30 pages of the most boring material ever. Not to mention it's worded to intentionally confuse people. Most TOS can be simplified into a few lines with the legal BS under it. This is intentional, and a scumbag practice.

I remember when Tim Hortons was selling "gluten-free" stuff. I was taught and trained initially long before gluten free was even a fad that if a customer asks, there's no guarantee about allergy prevention. There's a good reason for this, nobody in the store is trained for such a thing, I doubt even the cook is. So I explained this to the person who was baffled that a restaurant could try selling something allegedly gluten free, yet have no guarantees about such a product being safe to consume in the first place. The person ended up escalating to the supervisor/manager and it was a load off my shoulders lmao.

I didn't know this story and literally gasped out loud when you said she died. That's awful, I can't even imagine watching your wife die like that, it's not a slow death and you have to sit there and watch with nothing you can do because of negligence. Then after that a corporation tries to get around it like this. Everyone knows Disney has always been a giant POS but this is a new low. This makes me not even want to watch a Disney anything ever again, except they own Hollywood now, so I can certainly understand why Piracy is getting more and more like the right choice. If the legal system won't hold them responsible then their customers should, by pirating their content. You earn my time and money by offering a quality product/service and standing behind it, when something goes wrong you make it as right as you can, if you don't you don't deserve anything except to fail.

Imagine this BS, right? You and your wife go to Disneyland, and you and your wife go to a restaurant to eat something. You tell the waiter or waitress there that "My wife is deathly allergic to this substance, could you make sure she doesn't get that for her meal?" 15 minutes later, as you eat the food you were provided, your wife dies of an allergic reaction. Who's at fault? The staff at the restaurant who is Disney's priority, meaning Disney themselves are guilty. You sue Disney, and should expect a 50k fine back from them. Disney then tells ya: "Oh, no you can't sue us for killing your wife. You signed a contract when you purchased Disney+ back in 2019 and only for 2019. That contract means you are not allowed to sue us for anything, ever." In essence, Disney tells you to that if they KILL your family member, they are fully within their legal right to do so, because you got a free trial for Disney+ to watch the Mandalorian that one time. Meaning, if you value the safety of your family members, you DON'T get Disney+ trough THEIR ways, you pirate it, because piracy now a days DOESN'T harm ANYONE in your family, turns out. Who could have guessed? Giving corporations money means they can screw you over whenever they bloody well feel like it. You PAY them to SCREW you over. See how that is not fair in any capacity whatsoever? So yeah... Even though I see myself as a law-abiding citizen and follow it to the best of my ability... I will STILL say that you are perfectly within your right to pirate these things. Because Disney is actively making it a better option.

The mic stand is falling apart raises another topic. Who else noticed brand new stuff lately is more and more often sold in unacceptable state? My 2 years old headphones broke 2 months ago, I tried to do makeshift fixes to it to keep going, but soon after the battery died and *nearly simultaneously* the socket for the charger went loose and it's now nearly impossible to keep it on. I regrettably went to a shop to buy a new pair for a similar tier of cost (150€), and the new ones were already having massive problems right from the start. I went back for a replacement. It's been 3 week and they are *already* having issues. This is extending to nearly everything I'm forced to replace lately. I am now giving for granted that anything brand new I buy will most likely malfunction within months. Yes, it's under warranty. But considering they keep blaming consumers for polluting, it is frustrating to see how much stuff is designed to be on the edge of breaking "any moment now" and not repairable.

Ya know, there's a weird sentiment around not using evil services right now tbh. Like, I'm not remotely naive enough to assume my personal buying power, or even thousands of folk's buying power at once means jack fuck to a company (it's their public image and the whims of a capricious and moronic investor/shareholder class that matter), but I avoid amazon and disney and other shit at every opportunity (i.e. I KNOW that the company or product comes from or benefits them. Because it IS increasingly hard to keep up with how far the monopoly has spread) just because it's the right thing to do. And it's genuinely not even fucking hard? And then I'll hear about folk who just... DON'T do that? People my age, people who have an ear to the ground re: the tacky horror of late stage capitalism. And it's like.... Fucking WHY?? How hard is it REALLY to limit your feeding of these fuckers? Of COURSE you personally aren't going to be the one chosen one who makes them bleed, but how hard is it, REALLY, to be the SLIGHTEST bit aware and conscious of where your money goes? I mean ffs. These are the same companies convincing you that you can save the goddamn world via paper fucking straws while they suck up the entire energy grid, and your dumb fuck ass will buy the "every bit counts" rhetoric from THEM, but can't conceive of the same idea for yourself??? Don't vote with your cash because you expect to see some impossible, juvenile, instant change for fuck sake. Do it because it's genuinely just the right fucking thing to do.
