As such, the vehicle is illegally being operated and can be impounded which constitutes a warrantless search. They didn’t even need to give permission it’s very likely the impoundment of the car led to a search.

A local shop tried to do this to me and my wife, she wanted a little 6 shot revolver that comes with a. When I was in the military, I went in to buy an HK USP compact. I was from Kansas but stationed in Washington State. Dude wouldn't sell to me due to being technically a Kansas resident. No worries. FFL owners reserve the right not to sell if something seems off and rightly so. That old Fudd just lost a sale, is all. The next place legally sold me one actually at a better price. This video is a perfect reason to refuse a sale, however. It is called straw purchasing and is illegal.

@@Killer-vi4ihgun stores aren’t actually beholden to reviews scores to survive as they are not establishments that have a frequent customer basis like restaurants or department stores. It also doesn’t matter much when a majority of all FFL(s) work with L.E. or have a L.E. program. I mean biggest thing to get from a review of a gun store is the pricing, range care/time, and personal. It’s just not as a debilitating factor to their businesses as you’d like to think. Now that’s not to saw bad customer service won’t turn away customers. But the majority of customers going into these FFLs are primarily concerned with customer support or education. The other thing is that the FFL has the right to decline making any sale, meaning they could refuse to do business with anyone except law enforcement for example. Now because of consumer rights and other laws/regulations, if you did a background check to purchase a firearm and have given money and no response from the ATF came back in regards to your background check, then the firearm is allowed to be sold. It does not mean that it will be, just that it can as the ATF has failed their responsibility as required by law. Another thing, a review about someone not being able to purchase a gun versus a review about being sold a gun used to kill are two different reviews that will never exist on the same platform. “this guy at this gun store pointed me in the right direction for my gun of choice for my first drive by, although he didn’t know I was going to use it for a drive by, I just I need it for self defense.” Versus “they have bad customer service, would not sell me gun cause I was on the phone.” SOME FFL do not allow use of phone when purchasing a firearm. It’s a very unnecessary gray area that exists because the ATF is broken and so is our societal structure. I’ve done straw purchases to prove a point and it’s very easy for someone with a friend or to even fool a friend into getting a firearm very easily. The fucked yo thing about this whole thing, is that we can sell a 12ga slug that’ll completely tear a human apart to a 18yo but a 9mm or 22 that is survivable is at 21. And the main excuse is, shotgun big, pistol smol. Yea sure. Cause a kid can’t buy a shotgun, take him home and modify it for ease of access or deployment. I mean there are so many rules and regulations that don’t even keep people safe, they just make money or oppose rights to citizens. If you want a gun in America, ATF AINT GON STOp YA AND NEITHER IS THAT ONE GUN STORE!! PEOPLE WHO WANT TO KILL WILL KILL. Reviews won’t stop FFLs from doing business, People will always be smart and dumb, and the worst of all is that we will all keep going on in a system that has acknowledged problems that we ourselves refuse to fix. It’s fuuggin nuttz!

I worked at pawnshop on Van Dyke near 8 mile and know this quite well.. Or just be some illiterate that they don't understand the questions on the 4473, or possibly high and keep answering questions wrong. We started having people put the firearms in layaway before doing the paperwork since people would come in to see if they'd pass or not and just walk out. It was a lot of fun working there sometimes, just left a few months ago after 6 years.

I went with my friend when I was 17 (he was a couple years older) and he bought a 30-30 winchester lever gun for me right there at the counter. I was even holding it and checking it out and told him yeah that one lol. That was back in the late 90's though, and at a Dunhams sporting goods. I also walked behind the counter with a friend at that same place and got a couple canisters of pyrodex smokeless propellant for muzzleloaders when we were both 15 or so. We just walked behind the counter, grabbed a can or two, then walked up to the checkout and paid for it. No questions asked or anything. Good times, good times lol

Back in the '70s I bought my first deer rifle at Woolworths in Milwaukee on North Avenue. Got an 8mm Mauser and 1000 rounds o Czech armor piercing ammo for $9.95. I was 14 years old and no paperwork to sign or an adult present. I had the ammo in my Radio Flyer wagon and the gun slung over my shoulder. A cop pulled up and asked where I got the "canon" and where I was going with it . I told him where I got it and what I paid for it and that I was headed home. He revved up the cruiser, did a U turn sped down the road toward Woolworths.

They can. With a golf club, baseball bat, axe handle, or other some such item. I have firearms but will first use an axe handle that I sawed down to about 24 inches long. I know my house well enough that I don't need a flashlight, so I can easily get the drop on intruders.

Plus you are technically saying they have 2A rights with melees even with a felony which guns are covered under arms so technically they should be allowed to own a gun. The law passed in DC was ridiculous in the first place and clearly violated the 2nd Amendment, but saying the “history and language” of the 2A protects the right to self defense is hardly a black and white issue. To take Justice Scalia’s majority opinion as the end of the discussion ignores the fact that 4 out of 9 justices disagreed with him. The very same case you’ve referenced even says that the right to bear arms is not unlimited and that certain restrictions on guns and gun ownership are permissible. You know what that includes? Background checks, and preventing people with violent felony convictions or mental illnesses of owning firearms. You’ve invalidated your initial claim that background checks are unconstitutional.

From my understanding, The idea behind straw purchase is that the store does not know who the real owner is and if they are elegible to own a firearm, the person buying and doing the paperwork is not the owner which is illegal. Even if it's a gift, some stores require the actual owner to pay for it and do the 4473. i'm not sure if that changes from state to state or store to store.

So, as everyone else mentioned, this is an illegal straw purchase. You cannot buy a gun with the intent to give it to someone who can't legally own guns/pass a background check. The clerk was being cheeky in the way he framed it, basically saying "I won't sell you this gun". Which he is obligated to do. If someone makes a straw purchase, the firearm dealer isn't usually also guilty unless the buyer was suspicious. In this case, he's on the phone, and asking the other person what gun they want. That's an enormous red flag for a straw purchase, and could leave the dealer liable as well. Even if they aren't legally liable, it's not good practice.

I was picking up a transfer and the woman next to me was on the phone with some guy basically asking what gun to buy and he told her a hellcat. I didn’t want to assume it was a straw purchase because she might have just gotten her CCW permit and needed help figuring out what she wanted to get for herself, so I decided to make conversation while we were both waiting for the guy behind the counter to see if I could figure out who she was buying for. From our conversation, it was obvious she had no interest in guns herself. When my paperwork came back for my transfer I pulled one of the managers aside and told him what I heard and that it was very likely that a straw purchase was attempting to be made. He told me he also had his suspicions because of how she answered some questions earlier. I didn’t stick around to see what happened, but I’m pretty confident she was denied the sale.

Had a guy try to purchase a firearm once. He filled it out no incident but, he looked nervous. Manager told me to send it to the NICS system and it denied him instantly. Received a call 30 seconds later from an ATF agent who told me to stall until they came to pick him up(luckily he decided to go to the bathroom). As soon as he returned there were two agents with their guns drawn reading him his rights.
