So if it's never their product essentially, since you bear the full cost, didn't the buyer just destroy your property? So if I bought a box of chocolates, ate the entire contents, and sent it back, no problem? They will argue that it isn't the same product I received? Really.....you don't say. You mean to say I altered the product. Go on. I have seen precedent, all documented. And I do believe he sent back the broken one they replaced. Made in the same factory by the same people using the same machines, which put all tags in the same place and unless you two items in front of you, or incredible photographic memory, would never see the difference. Just a small unique mark or two on those tags would do.

If you think you’re going to sell on eBay and not lose money occasionally you’re joking you really fooling yourself you need to be realistic grow up and be a businessman and woman and face the facts there’s just no two ways about it Ebay is not wrong you’re wrong sorry I am a fellow seller and I’m pretty picky but I faced the facts remember they’re giving you an option for 50% that’s almost your cost on an item and if it’s not then you’re not a good businessman end of story accept your money back to cover your cost and move on and start again you didn’t lose money LOL

This is absolutely morally criminal. If this is how eBay runs their business, there's absolutely no protection for sellers. And sellers of high-priced items costing thousands are especially at risk. If I have an item costing thousands and a buyer made a similar claim against me after returning the item damaged, I could very well be out thousands of dollars. I'm now serioiusly considering leaving this platform because eBay obviously has no regard for their sellers. Thank you, Nic, for sharing your experience.

Easy to say, Amazon is way worse, with their fees and customer protection, you could literally return a brick, and when seller would receive it and told Amazon that received a brick, the buyer would simply be able to state it is the seller trying to commit a fraud! These 2 platforms are the most popular to sell items on the internet... and unfortunately a lot of people depend on it! Its not to stop selling on those, but to actually create a department who deals with internet fraud, scams right away! To report Cyber Crime does nothing! Many times I came across internet fraud, scams, violence and child abuse or pornography (apparently under ART protection), and reported it to a cyber crime (department/division)... Nothing happened and nothing will... Cyber crime is only fought if 1. Attacks or exposes government, military, and other secrets etc. (Example: Wikileaks) 2. If offers music, movie downloads (example: piratebay, kickass, etc.). Police, governments, military, banks and other billionaires' businesses are only interested in protecting their own "secrets and dirty work". Then you can hear it constantly in the news... But when you need a help, they simply ignore it, as it is LOW CRIME, but for a seller or buyer whoever is at loss it may cause a huge loss.

Actually - start selling on Ebay - get used to how things work, learn how to run your business. Open up a *GOOD* website (not some shoddy looking piece of crap), and start including it in all of your listings, emails, and receipts. After your first few months with the website, begin offering discounts if purchased at your website with a coupon code. Make sure that for the duration, you are keeping an email list - do NOT send them out any sales or marketing emails to piss them off. When you're ready to take a brief hit to your sales - make the switch. Close your Ebay store with an announcement. Send an email to everyone on the email ist announcing the same, include info on some items you're selling, along with at least one or two insanely great deals. Loss-leaders of some kind. Say goodbye to Ebay forever (except maybe becoming the occasional buyer for your own store :). Hire someone to do your email marketing. Usually very affordable, and worth its server-weight in gold.

As a seller and a buyer I do my best to describe an item as best as I can. If it's a vintage clothing piece, I research to see about the year and origin and so forth. I buy all kinds of things and for the most part (as long as it isn't coming from China) the item is as described when I receive it. China selling to people in any other country shouldn't be allowed because they never have anything as described! It's all crap! I bought a "ring" light from China not knowing it was coming from China it said it was coming from New Jersey and they described it as a 16 inch ring light, it took a long time for me to get it and it was barely 6 inches! I tried to return it and they gave me a partial return but I wanted to send it back to them so it sits on my desk in the box. I probably will end up selling it in a yard sale, won't try to sell it on ebay that's for sure! Oh not to mention on the ebay ad it showed a metal ring light I got a junk plastic one!

No, a mechanic could have broken it also. If you get into a car accident, you need to visit an auto body shop, not an auto mechanic. If the housing is bent, an auto mechanic would just try to jimmy the light into the housing by brute force. Now, I'm not saying the guy didn't try to fit it himself, he might have tried to, but I'm just saying that this kind of mistake can easily be made by a mechanic as well. Once a car gets into an accident, it may no longer have its original dimensions, one has to be extra careful because things that used to fit may not be able to fit anymore.
@Skulllywag
@Skulllywag 4 жыл бұрын
@@RustyAndroid Playing devil's advocate here. I did not notice the crack in the video until pointed out. I can see a buyer that has not THOROUGHLY inspected it, not seeing it until taking it to a shop (hence the good, but hasty feedback). I have bought headlights similar to that one, and will say it would be EXTREMELY hard to crack one like that during installation, even if installed by a chimpanzee. The back molded portions of those lights are VERY structurally sound. I would also point out that many people buy headlights not to replace ones damaged in a accident, but merely because todays plastic headlights look like cloudy sh*t after a few years, and nothing makes a car look nicer than a new set of fresh, clear headlights. Nobody here has even questioned that the light may have been damaged in transit? The ones I have purchased ( I have purchased several sets) came packed in molded styrfoam to prevent damage. This one was in bubble wrap. I have personally seen drivers STAND on one box to reach another in their truck. I have also seen them pull boxes out to get to another...and THROW them back into the truck. Here in the states, delivery services are well known for mangling packages or damaging the contents.

Here a long story short about my sale on eBay: I've sold an expensive piece of art, $4k. The buyer wanted to return it for whatever reason, so he chose to claim "it was not described correctly". I disagreed as it was described in detail in the originall, but to no avail, I had to accept the return. In the end I've accept the return as the item does have a personal value to me and I was fine not to sell it after all. So when I've receive the art piece back the buyer didn't bother using the custom protective packaging I've created and it was badly damaged making it pretty much valueless. Guess what? I fought to the end and still I had to give him FULL REFUND and I lost $200 in shipping costs. F*ck eBay.

EBay in general is so full of crap that some days I can hardly stand dealing with them! I miss the days when Meg W. was in-charge she had a pretty good handle on things! It has largely been a race-to-the-bottom since she left the company! Hopefully EBay will pay attention to this video and make some changes! Thanks Again :-) Best Wishes from across the pond :-)

I basically had the exact same experience as a seller. I'm glad a quarter of a million potential eBay sellers watched your video showing exactly how eBay treats their sellers when a buyer sends back a destroyed item or an item lot returned with items stolen. They don't help sellers at all, they just talk you into giving the buyer a refund regardless of what they broke or stole. In the end they'll make you feel like a crazy insane person just for trying to cover yourself as a seller from a bad buyer.

100% right. I have some bike forks on gumtree and was searching ebay about 2 weeks ago and noticed my fork images on a new listing so reported to ebay, 24hr later still listed and got over 400 in bids, so online chat with them to report 2nd time, even sent link to my gumtree advert, they thanked me and said would get right on and investigate, 24hr later STILL listed, SO 3rd time I actually get them to call me and explain it all again and am promised it will be passed onto the fraud squad and be investigated. You guessed it, listed stayed up for 4 more days and ended with high bid. I was fuming. Oh I even put a listing up on day 4 to try and warn buyers, not much else I could do. But Hey atleast ebay and PP get there cut from the scam listing so there good. OH the scammer also had 2nd high value bike part listed which also sold for alot of money. So 2 buyers got screwed thanks to ebay.

I done that with eBay about 8 years ago. It was a $300 speaker box for a 2002-UP Dodge truck. Customer messaged about not fitting in is 2001. Told him its not listed for 2001. He replies its only 1 year difference. I told him no, totally different trucks. He then asks for a prepaid return label. Told him its not our mistake and he has to pay for shipping. He then opens a significantly not as described dispute. I copied eBay in on the messages of the customer admitting he ordered the wrong year and they obviously didn't care as they sided with the customer and gave him a full refund. I then had to file for buyer protection. I ended up winning the buyer protection case. BUT, along with that email were more emails informing me that ALL of my open listings had been removed and my qty of listings allowed was changed to ZERO. I called seller support and asked what was going on? They said that all of my listings were big ticket items "$200-$400" and that I now have a history of not being willing to work with customers and Ebay is not willing to risk doing business with me in the future. $400k a year in sales, 99.6% positive and they dump me over 1 item because they had to eat the loss.

I hate Ebay and will never sell anything on there again. When I had my paintings up for auction I sold eleven of them and of course was charged a hefty fee for the sale. Fine. I understand that. About a month or so later I decided to add more paintings and even opened a store front. I wasn't getting any bids on anything so I closed the store and removed my listings. About a month or so later I started receiving bills from Ebay. I had no idea what this was all about so I called. Of course there's no way to email Ebay and trying to get in touch with customer service is a nightmare but I finally got someone on the phone. The woman had such a thick Asian accent I could hardly understand what she was saying and by the time we hung up I had a massive headache. Basically it was, "blah blah blah fee blah blah blah and more blah. I explained that I had already paid the fee for the big sale but apparently the fees continue on until you want to scream. I paid the damned fee. A month later I received ANOTHER fee!! I went through the same thing on the phone and it was basically the lady reading things from Ebay's website. She couldn't explain to me why I was being charged yet again. Grrrrrrrrrrrrrrr. I paid THAT fee too. Not a lot but enough that ticked me off. Next month, another fee. This crap was getting out of hand. Customer service is no service whatsoever. I finally got fed up and asked her if she could waive the fee and she said she could waive half of it. Okay fine. I paid the other half. Another month comes and ANOTHER fee. This time for $2.52. I call. What the hell is THIS for? The fee is for closing my store. Huh????? So I was charged of course for my sale, charged for something I didn't understand, charged again for some other crap and charged for closing my store. Ebay can kiss my ass. Honestly I don't know how anyone makes any money on there. Etsy is the same way. A fee for this, a fee for that, fee fee fi fo fum. All of you can kiss my bum.

I disagree completely with what eBay has said and the buyer should have at least sent something back in writing informing Nic of the reasons behind the return (particularly if it was outside the 14 day returns policy). The trouble with doing what you suggest is if the buyer can prove they sent back the item via images (as I always do when returning an item), a seller saying they returned a brick could be considered fraudulent on the part of the seller giving a false declaration. You can try it of course but be prepared to accept any consequences, that could include a permanent ban to the account you used in conjunction with any long standing reputation you have gained through (possibly) years of intensive labour and usually love. You need to as an individual weigh up what is worth more; the goods that have been returned compared with the possible loss of not only positive reputation gained but the account associated with it as well when making that choice. TLDR: Be cautious when considering shady tactics of your own in response to a buyer's. You may be the one who ends up getting burned.

It happens more times than you can imagine. They are complicit in allowing it. I steer everyone away from selling on eBay now, OR the only way to sell is to only sell items as cash on collection. The buyer can then inspect the item before they hand cash over, and it is no different to selling anywhere else at that point. The buyer has no protection (down to paying by cash, do not let them collect after paying by Paypal!).

I have been warning sellers about this for years, the buyer can return any item in any condition and get a full refund. There is NOTHING the seller can do. Thank you for this video showing what so many of us sellers have been going through with these new eBay policies. It did not used to be like this, eBay was simple, easy, and fair to both buyer and seller. It was easy to determine if a seller was a good one, or a bad one with the feedback system they originally had. I sold thousands of items on eBay for 5 years without any problems (I received only one retaliatory negative feedback), now it is nothing but problems.

If you think eBay is bad for fraud, try being an Amazon seller. We get approx 6-7 items a month returned that have been deliberately swapped, used for a one-off job, had parts scavenged etc. I am sure the likes of Argos also suffer the same sort of thing on a regular basis.

Hi Nic and Andrea, I can’t believe this kind of activity is still allowed to continue and no action is being taken against eBay or buyers. I used to sell high end watches on there and it was the first and last time it happened as I ceased selling on eBay down to my experience and was put on exactly the same wild goose chase as you. I sold a very expensive Breitling watch on eBay and explained that the watch required a service and needs to be sent to Breitling for a full service costing approx £300 but he decided to take it to a local shop who were not certified and consequently broke the internal workings of the watch, it was returned to me for a full refund which was nearly £8,000 and eBay did exactly the same as with you and refunded the money in full and had no regard for myself. It took me months and months of heartache and stress to resolve my case and my only saving grace was the fact that I had owned the watch from new and had it serviced on two previous occasions by Breitling and they held photographic evidence of the previous services and could prove the damage was caused buyers choice of service place but if I didn’t have that evidence I would have undoubtedly lost out on £8k and that’s why I no longer sell on there and never will again. Hope your case gets resolved. David.

1 - Why does he need a new headlight for his car? 2 - almost certainly because the car has been involved in an accident and the headlight was damaged 3 - if the headlight was damaged it is probable that the body of the car was also damaged. Looking at the damage to the new headlight I would almost guarantee that this was caused by trying to force the headlight to fit into a distorted body, he's either done it himself or his mate 'who knows a bit about cars' has done it for mates rates. This would not have happened in an actual garage - apart from anything else they rarely fit parts they have not themselves supplied.

@Eddie Turbine I don't think that anybody is suggesting that going to small claims court is sensible or would produce a desired outcome but I think he would win. If what he says is correct he has photographic evidence that the item was in brand new undamaged condition when he sent it out, the buyer gave positive feedback and then subsequently returned it in a damaged condition. It wouldn't really matter exactly how the damage was caused or who the individual was who caused it. this is all hypothetical of course.
@andystokes8702
@andystokes8702 4 жыл бұрын
@Eddie Turbine OK, since we are talking hypothetically this is not just a civil case, it is also a criminal case. If the buyer has returned the item asking for a refund in the knowledge that the item was OK when he received it and he is responsible for the damage he commits a criminal offence of attempting to obtain money by deception.

I've given up on eBay. Like many other comments here, their only interest is to please the buyer and do so at the expense of the seller. I sold an antique, cast iron train car for just over $200 after a very active bidding war between multiple buyers. After the item was paid for and shipped with postal insurance, the buyer contacted me with the hope of cancelling the purchase because she realized it wasn't what she wanted. I refused the return simply because she changed her mind and advised her that she could simply list and sell it herself as it was an item in high demand. After it arrived, she notified that it had arrived broken. I knew that could not be the case as it was cast iron and packed incredibly well so asked for photo evidence. She sent some and it was obvious the thing had been hit with a hammer to intentionally break it. I showed the photos to my local post office to inquire about the postal insurance and they too said it was entirely obvious it had been intentionally broken--giving me a letter to that effect. I sent the post office letter and the photos to eBay, asking for advice on how I should proceed. What was eBay's response to my inquiry--they register it as a dispute and immediately close the dispute in the buyer's favor so I have to pay for all the eBay fees, refund the purchase price and shipping, and pay for the shipping back to me, plus they warn me that I am not following the terms of their return policy. I receive the item in return, submit a claim to the post office which then requests I deliver the item for inspection, and ultimately (and understandably) deny the claim as fraudulent and dispose of the item. I send the post office denial to eBay to show that an independent, government entity had found "fraud," but they do not care to even respond. So it cost me $250 to throw my item in the trash can because the buyer changed her mind and knew how to manipulate the eBay to make me pay for it.

@@jackc70 Same here. They just took the money from my account as soon as I inquired about what to do. Ebay even said I had violated their return policy because they could see in the dialog between me and the buyer that I had stated I would need a signed statement from the buyer that the item was received broken so I could submit the statement with a claim to the USPS for the shipping insurance. It was actually the post office that suggested I do that because they said some (questionable) claims are not filed when the person realizes they have to sign under penalty of fraud that the item was broken. I guess eBay does not care if there is fraud and do not want to 'bother' the buyer about it.

For reference to anyone selling on the platform. I’m currently going through a similar situation with a buyer for a $1000 dollar laptop. Only recommendation I would give is if you’re selling any electronic, even if it’s completely functional and good. When you list the item, sell it “for parts” and write a normal description stating it’s functional, just being sold “for parts” because it’s a used device. This will remove the liability from the seller in most cases and eBay will typically decline any return requests. Only ones that might still go through would be “item not as described” but usually any other reason will be declined assuming they try to open a case. When items are sold “for parts” eBay automatically considers that the buyer is acknowledging a risk.

3 Years ago I had a similar experience dealing with eBay with a returned item by the purchaser who claimed it was faulty. It wasn't of course and I could prove it as well. I got absolutely nowhere with eBay and like you I went around in circles dealing with eBay. I decided at that point I would no longer deal on eBay as it made no sense whatsoever to trade under these conditions. eBay have lost many many sellers over the years with their ridiculous seller terms and conditions. With your particular case I do know that many traders dealing with car part sales do have a clause in their selling contract that all high value car parts must be fitted by a registered garage business and an invoice must be produced to prove this in the event of a faulty item return claim. I do believe you have reached the end of the road though with eBay as they will just close your account as a seller if you stir up too much trouble for them.

It's very simple for Ebay to solve this issue: 1) Keep track of the number of purchases divided by the number of claims/returns a buyer makes. 2) Allow sellers to filter out buyers who have too low a rating 3) Buyers with a low rating won't see many listings on the platform since they will be blocked from buying by the sellers themselves 4) Those bad buyers will leave the platform
