The two clauses in the constitution refer to a person who was a vice president at the time of the death of an incumbent. ECL was just as good as Mr Sampa. ECL was a minister in another ministry, so for him to qualify as president of the Republic of Zambia he had to be voted on and sworn in. In 2021 Ecl was elected and sworn in for the second time. So he doesn't qualify for 2026 elections. Judges must come out and tell Zambians, " No " he doesn't qualify for "yes" he qualifies. Judges should not hide their judgement by merely interpreting the technicalities of the clauses which an ordinary person won't understand.

This is issue will never die or rested till one day we will be told what happened to our forefathers dream not to allow third term, why and how did pf secretly included this clause which even sangwa is confused with?? Who startedbto court matter at first and why?? Whose interest was it for?? Why did ecl threaten judges , these issues will never die just as we have all failed to pick what is it that has made us not to accept judges judgements on this issue. We are so convinced it was a wrong judgement, wrongly before them, wrong included a hidden clause as ba pf knew what they were doing were away from their pro poor policies and now they entered into looting,, even now their wish is to have a weaker crooked man like eçl to help them out..Zambians, rambert where we have come from and why 4 to 5 constitution reviews were held and all never allowed this clause and all never thought of having this today. Mr sangwa I ask you in the name of Jesus tell us when and where did clause come from?? Who included it in and at stage was it.why didn't you notice it. Third term is what we know ecl wants,, manipulating the law to benefit you is sin,, read malakai 2 v 7 to 13. You are all cursed,, we don't want it third term we want what we wished for held office twice sworn in twice elected twice, if these are there then ecl does not qualify. As to make it to 5 yrs as term, is wrong as mps don't do that, mps even one month they get elected, dissolved they don't claim this 5yr term

In my opinion, it looks like it was the court's error to have arrived at that judgment. Otherwise, in my understanding, we are still using the same constitution in spite of some amendments being made.

you can not apply a new law retrospectively unless a provision is made for it. SIMPLE. The ConCourt made a huge error in the Dan Pule case and carried over the same error to later court petitions. They need to address the error in judgement made in the Dan Pule case.

Phiri is lost. Does the enactment of an amended constitution nullify the rulings that were made under the previous constitution? If this is his line of argument, it would then mean the like of FTJ would still be able to run for office if they were alive.

Indeed the person with chipala is a PF cadre. If people are not satisfied they can appeal for a review of the case and not what he is saying. It is the peoples constitution. What is special about LUNGU? There are cases that have appeals for review and example is the mutembo case.

You need to ask a proper question to get a right answer, as long as your diagnosis is wrong,you ll never arrive at a satisfactory answer to rest the matter, The question is why was the constitution amended few seconds before the 2016 election?????? Presidents are not saints, always remember that, The 2016 amendment was specifically instituted to favour an individual,and thats why nothing else was touched apart from this section, Unfortunately the provisions made in 2016 again does not entirely cover the situation we had in 2015, Therefore even if we allow the amendment to apply retrospectively,the specifics are not in concordance because we had no vise president,we had a new man nomited and elected 2015, If the 2016 makes 2015 null and void let them say that the law can actually apply retrospectively.

This is just comedy and the court can never pronounce itself twice differently weather am a legal person or not and what is the spirit of this case given that Lungu is stopped from standing and the implications thereof , and please don't say landmark ruling it's share vindictiveness, arrogance and very divisive and tribal

As long as lungu was eligible in 2021 ecl is eligible again because he wasn't victorious in 2021.
