The bottom line for me is if one of my friends died mysteriously and I got letters from court telling me that details on my phone might help to figure out what happened; I would do EVERYTHING IN MY POWER to get that phone to the court. I’d be making backups, if I needed to get a new phone I’d be setting the original in a safe place, I’d be showing up at the damn police station with my stuff asking to take my info and find out faster… If that man did Absolutely Nothing Wrong (highly unlikely) the way he disposed of his stuff feels like spitting on your dead friend.

I don’t disagree that it is hella sus that they all seem to have gotten rid of the phones, I just wanted to clarify one piece of the point you made. It wasn’t the police that wanted their phones, it was the defense. But if you did nothing wrong and have nothing to hide then did everyone get rid of the phones right around the time that the defense was asking for them and that the preservation orders came in?

Maybe it's changed, but an Air Force in Florida let anyone drive right through. They closed that in the aftermath of 9/11 and I don't know or it was reopened. I assume they did eventually because it's on A1A and it would probably take someone an hour to go around. I assume it's a very minor portion but nevertheless it is part of the base.

Emily, I will be 81 on September 11, and I long ago made the decision not to allow laws sportsman, which I actually support, to take possession of my phone, or anything else without a warrant. And, I will not participate in an interview involving a serious matter without an attorney present. I’m not smart enough to handle it by myself. Just watching you and Peter, as well as a couple others, have taught me that. I feel I have learned so much about the law over the past couple of years. The base near my home in the UK, you need a photo pass for yourself and a vehicle pass. For the vehicle, you need to provide proof of insurance, an MOT, and they do an inspection of the vehicle. The photo ID comes after a background check. Even then, they can refuse to let you in without an additional security inspection when you try to enter. (And all I did was transport authorised people in to visit the church on base)

I think the fact that Higgins can't remember being at the police station the next day is very important. According to the key swipes, he was at least there around 9am, 11am, 2pm, and like 5-6pm. He initially claimed that he doesn't remember being there *at all*, and later said that he only briefly "stopped in" before going home. I think it's quite possible that Higgins was talking to his buddies and trying to figure things out. According to the Defense, another policeman will testify that Higgins and Chief Berkowitz (who is now a Defense witness) were in the sally port around the time that Karen's SUV was brought in, and they were in there together for a "wildly long time" (at a time when the security cam supposedly wasn't working for like 45 minutes). I think this is when Higgins could've planted a bit of John's blood on the taillight (since the blood evidence was in solo cups within an unsealed bag sitting right next to the taillight). Also, we know that the broken taillight pieces weren't found until later in the day by a State (non-Canton) policewoman. IMO, since Higgins was supposedly in and out of the station that day, I think it's possible that he could've gone to where Karen's SUV was (probably still in John's driveway at that point, right? And I'm sure the police weren't guarding it or anything), broke off pieces of the taillight, then planted the pieces at 34 Fairview, then made sure to be back at the station when the SUV was brought in so he could plant the DNA. As to how Higgins would know about the taillight, I'm sure Jen or the other police could've mentioned it to him - or really any of the other witnesses who could've talked to Jen, Julie, or the police. There is also supposedly hair evidence either on the taillight or on one of the taillight pieces, and I'm still not sure exactly how that hair would've gotten there (there are a few possibilities, but they're a little more farfetched). There's slowed-down footage (taken from John's Ring cam) of Karen's SUV backing into John's car when it's in the driveway, and you can see John's rear left tire move slightly when Karen bumps it, and then you can see that there's a small hole/crack in her taillight as she pulls away. IMO this basically proves that the many taillight pieces found at the scene were not actually at the scene until later that day, so I think Higgins could've been the one to plant them there. That's why the police on the scene never saw them when they initially checked the scene. They were also supposedly found right near where the body had been, which is interesting because I don't think it would be physically possible for the pieces to fly off of the SUV in the exact same direction (and to the same distance) as the body itself. I think someone like Higgins would be dumb enough to not consider the physics of these things. The problem with my theory is that the Defense didn't really get into any of those points, so they must either believe that something else happened, or perhaps they're waiting to get Berkowitz on the stand and didn't bother asking Higgins about it since he's being so evasive anyway. Edit: Sorry, I started referring to "Jen's SUV" when I meant Karen's. Fixed those.

The defense doesn't have any witnesses on their witness list other than expert witnesses that are going to testify about the forensic evidence. There aren't going to be any friends or other cops or random bystanders that are going to be giving any testimony that conflicts with things the prosecution's witnesses have testified to. There is video of Higgins and Chief Berky in the sallyport with a bunch of other people the next morning though. And not just coincidentally in the same general area where Karen's vehicle was. They were both specifically looking at and putting their hands all over that vehicle. Of course the video is mysteriously missing from the time when the vehicle was brought in, so they'll never be able to prove definitively what happened at that point. But it's not going to be lost on the jurors that Higgins and Berkey's swipe logs show them both swiping into the sallyport shortly before Karen's vehicle arrives and not swiping out again until just before that period of mysteriously missing camera footage is over.

Back when cell phones first came out, in 1992 or so, I don’t know if we wiped them. But in the last ten to fifteen years, as more data is on them, yes, everyone transfers the data to the new phone, then resets the phone to factory settings. This “aw shucks” butt dialing man knows way more about smart phones than he admits. As a federal law enforcement agency investigator he knows what is retained on a phone, and how to get rid of it. The fact that he says “if I “ tossed it I would cut or break the SIM card suggests he has done. I believe he is a very dishonest person.

The only reason that I can think of to get rid of the sim card is that some new phones have a eSIM so you don't need it anymore. Personally I would have chucked it in my junk drawer or left it in the last phone that it was used in assuming that it wasn't one of those trade in situations.

Changing your number/carrier doesn't require getting rid of your phone though. He'd just need a new SIM. Had he done that at a phone store, they would have broken the SIM & tossed it. There are so many questions in life I could never answer yes or no to. And lawyers absolutely do attempt to give false impressions based on limiting you to only a yes or no answer to something. First impressions are so important to forming opinions, so whichever lawyer gets their answer first will often be the information and impression a jury member will retain . Its fine to say the other lawyer can fix that on re-direct, but you're fighting against an opinion that's now been formed.

Exactly my thinking. I have NEVER seen a trial run like this - including the two half days every week and all the random days off. Followed by the judge going on about how they need to speed up the trial. She had Better not use all of this schedule related delay and all of the Lally time wasting chatter to prevent the defense from presenting their case. 😡

I'd be shocked if after weeks of useless testimony the judge doesn't rush the defense through their case in chief. I'll also be shocked if there's not serious games when it comes to both jury instructions and them being instructed on reasonable doubt.

Exactly! I wonder if he carries two phones, one for work, one for personal. Sounds like he did. He already had a new phone, he had selectively transferred his data he wanted, is my thought. There is some information stored on the actual phone minus the SIM card. I learned this the hard way when I damaged my husband’s phone replacing the battery the night before he went on a business trip! 8 P I thought I could just switch my phone and his , put his sim in mine and everything would be golden. It was not! It was a Frankenstein-phone and it did function but I believe there was a problem with his contacts. I broke his wi-fi antenna, yikes, which was something I could purchase, and not particularly difficult ( very tedious, but not difficult). This man is lying, and it is going to put previous testimony in federal cases at risk. His pretending he wasn’t aware of preservation orders and their implications is completely unbelievable. Someone clued him that order was coming down and he destroyed it before he received the order for plausibility deniability. But it is not plausible.

Brian Higgins is not kissable, and is sketch AF. Too many coincidences of his involvement and connections ... friendships, phones, trips to the station, Karen and John, etc. Not sorry if he is fired. He has a terrible memory and is ill-equipped to be a Federal Officer, imo. Perhaps he was involved in harming John out of jealousy because he wanted Karen to himself, or wanted to punish Karen for not pursuing a relationship with him. Revenge and jealousy are often motives.
