This video must be corrected. RAS of a crime is NOT a sufficient evidentiary threshold for requiring ID in a state without a stop-&-identify statute.

And all of it because the police 'got a call' about someone 'knocking on doors' and 'possibly soliciting.' Not to mention that if there was no video, it's a 50/50 whether the charges would be dropped and the Guy would have never heard a "sorry" from anyone, and i doubt a lawyer would take the case to civil court.

In today's "day and age" we are pretty confident the police body camera footage would have been lost or corrupted and the investigation would find no wrong doing. The general public has needed dash, body and home cameras for the last 40 years - but it has only recently starting become more common.

​@@jchar2347Yeah, somehow for civilians (who usually never have formal education in legal matters), ignorance of the law or information pertaining to laws is inexcusable, but when a police officer (who ought to EXTENSIVE training in the laws they're meant to enforce) get away with with wrongful assault, battery, and manslaughter because "they acted correctly based on the information they had available," which is another way of saying "they didn't know shit and didn't bother to investigate further before resorting to violence."

The woman who recorded all this deserves a freakin medal of honor. I love her no-nonsense-yet-respectful attitude, and she even offered to escort the guy's kids back to his house after seeing how unhinged these officers were. I wouldn't want any kids near those two, either, to be quite frank.

you mean jailed for felony kidnapping, charged with felony conspiracy, felony conspiracy to deprive rights, felony assault and/or battery, etc. This cop should be in prison for this for a year to think about the dumb shit he just did to make it impossible for him to be a cop anywhere else also. That would be the only just course of actions. He tried to lock this man up, collecting signatures, for like 5 years for resisting. What should happen is he should spend that same amount of time in prison as a result of his exceptional rights violations and trying to imprison a citizen conducting a first amendment activity. THEN and only then would this end.

The concept of “qualified immunity” flies in the face of the Constitution, and needs to go! The blue gang constantly says that they “hold themselves to a higher standard”, which is the opposite of reality. If there were REAL repercussions for them when they choose to break the law, (as there are for we “lowly” civilians), then they might care a bit more about conducting themselves properly.

I love how the gal took complete ownership of her friend’s rights being trampled, and correctly viewed that as her own rights being trampled. Its BLATANTLY obvious that this Cop made the decision to arrest this man when he approached him with handcuffs in his hand already. Then he dodges every legitimate statement and question that both of these citizens present to him. There REALLY needs to be more done when hiring these cops to determine who is right and wrong for this type of work.

@@mega4318 Unfortunately the only thing you can do in a situation like this where the Officer is just breaking Departmental Policy and not a Law is to try to get a Supervisor on scene or have someone be on the phone with Dispatch relaying information to them so its documented and recorded. If the Officer is breaking a law that becomes a different situation all together. The best thing to do for situations like this where an Officer is hindering your rights or breaking policy is to document the situation in a safe manner the best way you can and just go with whatever is happening, remain completely silent and deal with it through proper channels another day. There is nothing you can do to make the situation any better when its happening, only worse.

Handcuffs in the hand is a rather aggressive intimidation tactic which is more of an inner city style, but we don't know how rough that County might be relatively speaking or where that particular deputy hails from. Retraining would be a good idea there. I've seen officers walk up to someone with handcuffs while jingling the handcuffs and then a few minutes later they put their handcuffs back on their belt, so while it's always signals an arrest it doesn't necessarily mean an arrest

The government and states cannot afford decent training and legal advice support for police officers because they need the money to provide tax cuts, bailouts and subsidies for the rich. @@kheldaur2107 c'mon man scissors are way more dangerous than guns. Maybe barbers should wear hobbles so they cannot run with them. I have noticed an ongoing theme cops respond to a 911 call and feel compelled to stop the activity no matter how innocent it is. Problem is none of these 911 calls is an emergency. Most places have done away with normal dispatch procedures.

Here's the rub, if we, as a society, enable bad conduct in officers eventually all we get is bad officers. How can this be fixed/reduced? Further training of officers so they know the laws and punitive actions on officers that violate laws/rights. It may be too late unfortunately. Why would any good person willingly submit themselves to constant hate and fear from the public ? It is pretty hard on the psyche. Hopefully someone (s) smarter than me can come up with a solution.

She even realized that she could have been arrested on the same "grounds" as Mr. Marshall. The deputy that arrested Marshall for not identifying himself turned around and tried to demand her ID, too - and she pushed back with the same vigor. Respect!

I used to live about 2 miles from Wyndham Town Homes and I swear its like the BCPD and Calhoun Sheriff offices go-to spot to either start some drama or to "go investigate" a legit call and then ignore it. Also, that deputy with the glasses showed up at my residence in 2018 with a female superior and they were responding to a call about someone being "attacked by a cat" and when I cracked my door open he placed his hand on my door and started pushing. I said "hey, let me change into some pants and a shirt and I can step out" (was wearing just gym shorts at the time since I was about to go to bed) and when I walked back to my chair, he walked right into my residence and his superior pulled him out forcefully and said "you can't just walk in a residence unless we have a warrant or were invited inside" and his response was "he has a gun on the table [lifted finger to point] right there, in the holster." I said "I have a CPL and don't ever step in my residence unless I say you can" to which the female superior nodded her head and then said "ok sir I think we have the wrong residence have a good night." (I see that female deputy a couple times during the week when my work takes me through this area) If he is still employed with the Sheriffs office, they need to fire him. He is a walking liability and a lawsuit waiting to happen.

Oh they were and are commonplace. It sucks because there ARE many police departments across North America which are exactly what you'd hope they'd be, but since policing is such a necessarily invasive act (not in a bad way, just objectively by nature), the failures and crimes of bad officers and departments often have especially serious impacts on individuals' lives. Good cops do a job that does need doing, and that most of us really don't want to do ourselves. I still agree with nation-wide police reform, up to the federal level of police regulation, and not just in the US, but certainly there first.

It wasn't because he was forming the tenant association that they harassed and arrested him. The lead cop thought he was out collecting money and no amount of evidence could tell him otherwise. The fact the victim in this case wasn't having any of it and stood his ground just made the cop annoyed to a point he "had to prove his dominant position". It is bad policing at it's worst and sadly far too common.

My first impression was that the person calling 911 was someone in the housing development who was against the formation of a tenant's association who may have called in a favour. It seemed the only reason the deputies would be so hell bent on arresting and not listening to anything proving the gentleman's innocence. Their mission was to stop him doing what he was doing, lawful or not. Nothing is as relieving as hearing scumbags like this get fired, and I can't wait to hear the outcome of legal action.

I'm very happy he was fired. His behavior was disgusting. And to that in front of the man's children. It's something they will never forget. At least he can tell them he was arrested doing what was right. Kudos to the amazing neighbor who spoke up and recorded the incident. I hope there was compensation, especially for the assault. You should never be quick to undermine a father in front of his children. The other officer knew it was wrong but said nothing. It was all over his face. We need officers with the strength of character to challenge wrongdoing. Those are leaders. There are often external investigations, but these organisations are still vias towards officers. There needs to be a neutral organisation that investigates and prosecutes police misconduct. Something that just occurred to me. I don’t expect law enforcement to have memorized every municipal code. That is unreasonable. But when called to address an accusation of possible criminal behavior I would expect that en-route they should always look up the relevant codes or otherwise radio in to a supervisor for advice and to look up the relevant codes as they respond. It’s not good enough to say that they thought there was a municipal code outlawing solicitation! That should be something they confirm quickly BEFORE they begin demanding citizens to surrender their rights and escalating encounters! Maybe requiring a desk officer at all times or specially trained dispatch officers proficient in conducting quick reference research of relevant state and local statutes as well as being able to provide basic instructions on preserving civil rights of an issue comes up. Seems reasonable no?

Qualified immunity is just an excuse for officers to break the law and intimidate people. If qualified immunity wasn’t a thing, interactions like this wouldn’t happen because officers would get **YEARS** in jail for it.

@black wolf101 They are required, in most instances, to do less weapons training than I do. I'm not a fanatic, either. I'm a grandmother. But I go to the range. I practice my aim.

@black wolf101 the training they receive is often physical, use of force, weapons, tactics and so on. The training they NEED is understanding of laws, codes and so on, de-escalation and psychology to understand the person they're interacting with.

I hate the "We got a call" excuse. 1. If the call is anonymous DIREGARD THE CALL. 2. If caller gives name and address GO TO THEM FIRST 3. Now that you may have started an actual investigation CONTINUE ON WITHOUT VIOLATING A PERSON'S RIGHTS. I do not understand how an investigation starts at the end and goes backwards. The LEO's should start with the accuser first then, if valid, go to the accused.

Civil rights were given to people of color in the 14th amendment suggesting civil rights existed before they were given to people of color, so even white people had them and other legal immigrants at the time. So no, civil rights are not exclusive to colored people, they are exclusive to citizens of the United States. Maybe if you learned your history and laws you wouldn’t look so dumb and ignorant. Please go back to school, the 1980s school system wasn’t enough obviously.

There is no evidence that he was accosted because the color of his skin. His rights were violated by 2 incompetent officers, and I hope he does sue, but to inject race is based on your obvious biased opinion without evidence does not help anyone. America has to do something about it's fear of the black man; this incident was a case of someone with an agenda, a phone, prejudice and too much spare time. As the police in the US are armed with at least two forms of lethal weaponry everyone should think twice about acting out of pure malice - this is one of the reasons that innocent people get shout.

It's pretty common from what I hear. People like them often have the money and time to schmooze with police and gain personal connections to law enforcement. Especially in rural or small town communities. There's a family in a nearby town by me where my mom lived where the police ignored certian traffic violations or issues for a certian family who owned one of the few apartment complexes. And used the police to intimidate or harass residents who protested their slum lord practices.

So true! I find it absolutely ridiculous that if a citizen is charged with a crime and there is no legal precedent AKA a grey area he can be charged and penalized for the crime. But when an officer breaks the law and its a grey area he gets immunity. That is ass backwards, and officers should be EXPECTED to know the law.

I'm not licensed in your jurisdiction but have read enough about your legal system to know that his qualified immunity ceased the moment that he infringed upon his fourth amendment rights. I might be wrong though, law school was heading to twenty years ago for me now and the stuff we read about other areas was limited.

If a phone call comes in and the caller refuses to give name and address, the investigation is OVER. Investigations should start with the complainant. How many times does the complainant complain about some he/she doesn't like but isn't a crime. By starting with the complainant and the officers knowing the law these idiotic stops will go away.

Qualified Immunity only applies in civil court, when they're sued by their victims. Yes it needs to be trashed, but it's more about the power of unions, police gang culture, and cowardly leaders - if they're not just as bad... criminal police need to be criminally charged. They need to be disciplined properly if it's not quite criminal. But yes - QI needs to be drastically curtailed.

Absolutely qualified immunity should be abolished. In addition, qualified immunity only applies when an officer is not breaking the law. This officer was clearly breaking the law, thus qualified immunity does not apply. Acting under color of law does not make you immune to prosecution

Why is it that so often in these interactions, police arrive misinformed about a situation and, when discovering the reality of the situation, they throw their toys out of the pram and try and make it an arrest/ticket/warning, as if they'll be humiliated for leaving people alone
