I have my teleconference scheduled for Monday. The regenerative braking hasn't worked since delivery. I opened my initial case on November 9th and despite multiple promises to send out a tech no one has even contacted me for service. Car has been sitting unused in the driveway for months except to take it around the block to keep the 12v charged. We'll see what happens. Congrats on winning your case. I hope you actually get paid.

@@EV-365 For sure. The mechanical brakes squeak like crazy now because they were never designed to stop a car that heavy with out regen. A tech told me on the phone it wasn't safe but there's just no way to prove that.

@@justinbukoski1 focus on the main issues and avoid to mention the smaller ones cause people have to listen to you on the phone and their attention span is quite limited. Big points are convincing and as EV 365 pointed out focus on street safety . Avoid to mention you have had used the car cause if you tell such circumstances you shoot yourself in the foot. The counter argument would be instantly : how could you drive on a public street with a car that was not safe Your credibility will be shattered or at least damaged. You have 1 chance only cause time is running up.

@@EV-365 No I went through some financial difficulties around the same time so I ended up voluntary repo it but before that I got a 2018 clarity plug-in, hybrid It did ruin my credit, but it was ruined anyways from some other issues, but that was in 2021. My credit is now back to prime I plan on trading in my Clarity for either an ID4 or polestar 2

@@EV-365 update, a tech came out about 3 weeks ago and addresses all of my issues (replaced my Adas module, installed air vents, updated. Y key fob and made sure all other modules were current). The car is now working as it should be with 2.0 software. Now if we can on,y get software updates 3.0, 4.0 and get access to R Tesla superchargers. We have a month to see what happens.

EV OG....I've watched all your videos and you have been very reticent to address the myriad of problems many owners are having with Oceans. Sooner or later your vehicle will develop a 12volt problem or FOB doesn't work or bricking, then I'll be waiting to have you tell us again how good customer service is or how special the vehicle makes you feel.

Thanks OG. I don't think this would work for partial buy back due to features not delivered. But one of their three items is value (usability, safety, and value), but it would have to be tied to actual warranty related issues that Fisker has had a chance to repair. If you can do that, it could be worth a shot. Worst case they will not offer an arbitration hearing. But this may be more for small claims court, which is also what folks will need to do if they do not like the result of their arbitration.

When you submit the case, you have a few options to choose from...Repurchase, replacement, reimbursement of repairs/expenses. I opted for Repurchase.

The main difference I can tell is that the NCDS process is governed by the warranty, and the 5 points I mention in the video. Each state has their own lemon law rules. NCDS does take those into consideration with their cases, but it is more about warranty issues that impact driving, safety, value that the company has not been able to resolve after being given ample opportunity.

No. I think people are either having issues with their 12-volt battery, or software 2.0 was causing an issue with the 12-volt causing it to drain quickly.

I listed out everything I had in the original case but the main ones were the car not going into gear, automatically shifting into park, seat sensors in the back seat not working, and it ultimately being bricked and completely unusable. But I notes all of the other greatest hits as well: key fob, AC vents, software updates, alerts, cruise control, etc.

@@mrking58 I sent those into the NCDS. Short 15 - 30 seconds clips. I spoke about those in the last several videos. I had to balance working with Fisker with hopes of repair and piling on Fisker while the rest of KZbin was. Wanted Fisker to succeed and gave them benefit of the doubt so did not want to highlight issues that I was told would be fixed. Unfortunately did not happen so had to go arbitration route. Figure I would help people through the process that have legit issues. The seat sensor issue which kept the vehicle from driving and affecting rear seat air bags and the car being bricked are the main ones I had.

Realistically we ALL don’t have features that we paid for. They should at least be looking at the packages that were offered and refunding buyers, but the note holder is liquidating all they can as quick as they can to wipe things clean.

Hi Raj! I just won my arbitration case today! Unfortunately, it is the same day Fisker Group filed for bankruptcy. The document the judge sent over states “Fisker now has a legal obligation to repurchase the vehicle” I am wondering what your thoughts are on this given the circumstances revolved around their bankruptcy. Do you think them being legally obligated matters anymore? I am not sure if I will be paid back even with winning the case. Also, have you been paid back yet?

Glad you won the case! They have been turning a lot of them down. As expected, I have not been paid back, and have received no communication from Fisker. NCDS has tried to reach out to them and no response. I financed through Fisker Finance (aka Chase) so I am putting the pressure on them to get this resolved as well, and have made clear to them and Fisker Legal that I am not sending in any more payments. I am not sure how bankruptcy is going to affect this. Companies are supposed to have money set aside for warranty related issues (this would fall under that), but I read somewhere that they did not do that. Either way, having that paperwork with the decision is good to have as we navigate this. Ping me directly if you want to chat further!

I would love to get on a call and chat about alternative solutions with you sometime. This whole situation is mind boggling to me. Right now, I’m at a cross roads. The dealership I purchased the car from is offering me a Fisker they currently have that is working order in exchange for the current Fisker that doesn’t work. Honestly, the car is unsafe and not dependable so I would take that car and sell it. But at this point, I would lose an arm and leg doing so. I’m sure the longer I wait, the larger the likelihood of the dealership revoking that offer. I’m not sure if I should risk it, reject the offer from the dealership and take my chances with a document from the NCDS stating that Fisker has a legal obligation to pay me back for the car. What are your thoughts? I just can’t imagine that because they filed Chapter 11, they don’t have to honor the decision made. The letter also stated the car falls under the Massachusetts lemon law.

@EV-365 Thanks for the info Raj. I have had a long list of problems with my Ocean since delivery. So far only 2 things have truly been addressed. I did have my AC vents replaced and I do have the 2.0 software update. Everything else is sitting in a black hole of non-response with Fisker. Because they addressed the vents and provided 2.0...will it hinder my claim with NCDS? Will the arbitrator say: ….”Fisker has made some efforts” or something like that? I have significant issues still remaining with multiple tickets that touch on driveability, safety and value. Also, my car is not totally dead. It turns on and technically it can be driven. Although I'm hesitant to do so because of other issues that make me feel like safety is a concern or I will be left stranded by the car. It seems like your case was successful because you had no service and the car is bricked. Whereas my car has has some service and it's still driveable. Is it still worth pushing for NCDS or would my situation still have merit and a chance to stand up?

Yes, I think you should take the first step and submit and NCDS will let you know if it qualifies. Yours sounds very similar to me other than you had a couple of successful repairs. Each issue is unique though so if there are issues that keep you from driving safely and Fisker has had ample opportunity to repair, then you atleast have a case worth considering.

Raj, Thank you for a very informative presentation. Given that I have not started the process, that Fisker has stated that it does not have sufficient cash to operate thru month end and that the few Fisker employees I have dealt with (trying unsuccessfully to address the problems I have had) have been released, I cannot expect a resolution prior to the lights being turned off. One question: how did you get replacement A/C vents. Mine have been broken for months and Fisker has never responded to my calls, emails, etc. If you are interested in selling, please contact me. I actually am not sure on this. I do know companies are required to have funds set aside to honor warranty claims even if they go bankrupt. I would assume this would fall under that since it is driven by the warranty.

@@EV-365 I reached out to Chase a while ago and the person I spoke with was pretty clueless and not very helpful. Sounds like I should try again. I’ve had numerous safety issues with the brakes (both regen and the petal itself) and the accelerator when trying to move forward on a slope before and after 2.0 and had some serious scares. Definitely going to pursue the route you did but worry it’s too late at this point. Hope you get payment from Fisker before it’s too late. Are they taking the car back?

Can’t hurt to atleast submit the initial request and let the NCDS make the initial call. They usually make that first decision on if you even have a case or not within a couple of days.
