The plaintiff got caught over exaggerating the price of her outdoor furniture. She’s not a credible plaintiff. I’m a big believer in inspections. The owner is solely responsible for inspections. So, basically her “work husband” paid to move her. He charged $2200 for the job and the judgement was for $2100. The defendant had to pay his workers, so he lost money doing her a favor that involved three days of work. The plaintiff clearly inflated the value of her junky patio furniture, so it’s likely she did the same for whatever was in the shed. It always leaves a bad taste in my mouth when folks don’t have receipts for their high value items. There should have been clear instructions about what was trash, donate, and keep. That’s Beau’s job. Beau’s responsibility as her agent was to also walk the property with the vendor to verify the job was finished satisfactorily upon completion. The law is about being made whole. It feels like this judgement enriches her because she got moved for basically free. She inflated the value of her items and also picked more expensive items for her “documentation”. If she’s lying about that, then what else is she lying about? I would have given her a third of that judgement because she, Beau, and the defendant have shared responsibility in this case. Let her sue Beau for the other $700 and take on some of the loss herself. It’s poor form to sue ones “work husband”. Awarding her a third of the judgment is rough justice. Also, the $2200 he quoted her is a pretty cheap price for a move that included deep cleaning and fixing things. It’s also unfortunate the buyer didn’t let her have the items or call to say “hey, this shed still has your stuff in it” given the situation. I couldn’t just keep someone’s mower and be like it’s abandoned because it was here 30 days. That was discovered before 30 days passed.

This is one of those rare times I disagree with the judge. The defendant knew she was going to be trouble... and sure enough.

Should not of taken job then..
@Bakaferret3 жыл бұрын
I'm curious about which part you disagree on. The plaintiff was for sure inflating the value of her items, but the defendant acknowledges that the shed was left. It's not his fault, it's the realtor, but since the plaintiff didn't file against him, the defendant is stuck. I think the real nail in the coffin is the plaintiff showing undeniable proof that the patio furniture EXISTED, while the defendant was adamant it was never there. It reinforces the notion that the whole job was subpar quality
@MordechaiBen6133 жыл бұрын
@@Bakaferret This is only my uneducated opinion here... but it seems to me there was no actual agreed upon contract to start with...if there had been, and he left the shed, I'd agree... but the defendant was, it seems, following what he understood to be done... he did not come across as shifty and scheming type of guy.... I just think some fault should be on plaintiff and realtor. This goes to show clearly what can happen when one does not have a written contract.

"She's got a really good excuse.." Excuses are like a$$ holes, everyone has them. She didn't itemize what was to be packed. She needed to at the very least list everything to be moved, if she didn't want to be there to supervise the packing process herself. She is to blame. The mover can't read her mind and he isn't going to break the lock to a shed to pack things he can't guarantee are hers (the shed could be rented to another person for storage). The ruling was all wrong!
@michaelweiske7022 жыл бұрын
She gave Bo, the guy who was organizing Jason's work, a list of all the places that hadn't been packed yet, including the shed. And it isn't like she had the time to go through her shed and everything and make an itemized list; if she had that time, she would be using it getting packed!
