You never shoot blindly at anything, that's the first rule of gun safety. To dump a full magazine without having a target is insane.

Along with being a Retired Military LT. Colonel, Military has/is always trained to never fire until you have identified the threat.. Period! The same as LEO’s are trained. I feel as though he should have been charged with something! On another note, the 911 Dispatch call along with the video did not match up! He didn’t begin yelling at the pool guy until after he fired the first rounds. Then 47seconds later emptied a 30 rounds is completely crazy and reckless! If anything, homeowner who is a Retired Military LT. Colonel was/had been highly trained to never shoot at a target/enemy unless you can identify the threat. Not shoot blindly. Same thing applies to The Rules of Engagement of the Enemy. I know this as fact because I was in all three wars of OIF/OEF/OND. Whose to say that after he was repeatedly told by dispatch and wife to stop shooting after the first few rounds and he continued to ignore them both ( was on speaker at some point) then empty the 30 round magazine anyway. He could have possibly shot/killed a LEO that was on scene/others surrounding their home. Reckless and Dangerous! Yes, the their pool man should have notified them that he was coming. But came so close to being murdered for being there at night, innocently to do his job in cleaning their pool. Do we know if the company he worked for told him that he had to go there that night to do his job because they were behind schedule? All in all, if he would have killed an officer(s) the second set of rounds that could have been around the side/backyard beyond the screened in pool( those bullets travel 300yards+, I feel that this briefing would have gone differently. My opinions.

@Victoria, yesss Amen. I am so grateful that the Lord Jehovah Nissi protected the pool guy. My Lord, and the owners were afraid. I would have been afraid, too as a single woman not knowing who Or what is coming towards me. Finally, I pray this works out favorably for all involved. I feel bad for the homeowners and the pool guy. Mercy

The pool cleaner should have notified someone that he was going to be there, but the home owner, in my opinion, was reckless. They had already called 911, and the pool cleaner clearly did not attempt to come thru the door.

⁠@djdoubledealzeriously?! Was the front gate actual people who checked him in and give him access, was it only a coded pin pad but no attendant or did they actually contact the homeowners?! That would be absolutely premeditated if the homeowners had authorized his entry only to shoot at him Edit: It sounds like it was a gate code so he let himself in

I also agree 100% that his actions were very extreme. You don't just fire 30 rounds randomly, he could have easily killed a neighbor. The pool guy had his own faults.

Maybe he suffers from PTSD, you don't know. Also, not all military retirees are combat veterans - this might have been a desk jockey's first encounter with perceived danger. Don't be so quick to jump to conclusions.

Retired law enforcement here, with 30 years of experience. That homeowner needs some serious training if he's going to spray and pray. He's shooting at noise, y'all! This was a stupid situation situation. Like a hunter identifying a turkey or a deer, identify your target!!

100% And this Sheriff calling it a reasonable response, and letting you know that this guy is a retired Lt Colonel but couldn’t land a single round on-target with 30 chances. He could have shot anyone. If he hadn’t been told to put the rifle down by the 911 operator he very well may have shot and killed responding deputies because he didn’t ever bother to even think about what was out there. If your first reaction is to behave like this homeowner then I’d suggest taking firearms 101 again.

If you are safely locked down in your home and hear a noise outside, open your blinds, turn on your lights, check your cameras and never shoot blindly through doors and barriers. Side note, if you are suffering from ptsd seek medical treatment

I see what you're saying, but define " safely locked down in your home." Burglars always have burglary tools. If they want in badly enough, they'll get in. What kind of brain dead pool boy is stomping around on someone's patio after dark without giving the homeowners a heads up? He didn't think that through very well in a state where Castle Doctrine is the norm. HOWEVER. It was definitely a bit over the top after the first two shots. Bro was having Vietnam flashbacks or something. He did everything but toss a grenade out the door. Very fortunate none of the neighbors or Einstein from the Acme Pool Cleaning Company were hurt. Perhaps next time Mr Braveheart will man the phones and let the Missus handle the weaponry. If that had been the case on this night, the whole thing probably could have been avoided. She obviously had better control of her nerves than Rambo did.

As a lawful gun owner, this hothead gun owner needs to go to jail. 30 rounds in the dark, with a carbine, at something they can’t even see. And he hit NOTHING. with 30 rounds. Where do you think every one of those 30 rounds went? It’s obviously something this homeowner didn’t bother to think about. You have to account for what you can’t think of, like someone wearing headphones, or being hearing impaired. What if this was a pool guy working late? Or an elderly man with dementia?

They have a regular pool cleaner, a camera and supposedly made vocal contact .. yet they clean a mag at someone kneeling around thier pool .. ?? Reckless .. Someone needs to investigate the relationship between the sheriff and the homeowner. I seriously doubt this was within the law. They will never find someone to clean thier pool after this.

I would be really pissed if I were his neighbors. The property doesn't look that large that any of the strayed bullets could have reached the neighbors yard and house. The insurance company should have a lot of fun with that if the shooter tries to collect for repairing the 30 bullet holes

The homeowner knew when she was on the phone with 911 that her husband was wrong to shoot because she wasn’t admitting it was him at first. Absolutely insane to shoot and have no idea what he is shooting at, no idea if he got anything. That was seriously impaired judgement.

No, I'd say it was just because she was in shock, confused, trying to talk and listen to both the husband and 911 operator at the time, trying to calm the husband down, trying to listen for sounds of the intruder, had ears ringing from the gunshots, had an alarm going off, and there seemed to be some language issues at play too. There is zero suggestion or evidence that she was deliberately hiding that her husband had fired the shots.

If you were thoroughly "taught" that during training, you would know it's called 'rules of engagement', not 'rule of contact'. You would also know officers do not receive the same training Enlisted receive. And let's also take into consideration a retired LTC likely hasn't been in any kind of legit weapons training (aside from weapons qualification where he's only given a brief amount of time to familiarize himself with the pistol he's about to shoot plus 30 rounds to qualify) in 25+ years.

I partially agree. However, according to this, they did attempt to communicate with him and did not get a response and he made no effort to notify them of his arrival. On the other hand though, firing 30 rounds into the dark with no line of sight is a bad decision.

I'm pro 2A and a licensed conceal carrier...AND NO YOU DON'T...Especially if the person is on your property at night, has no business being there or being there unannounced. The homeowner had no knowledge the pool guy would be there because the pool guy/company (if the company knew he would be there) failed to contact the owners and get permission to be there at that time. The homeowner was in his right to defend life and property at that point. He had no obligation under the law to ascertain the motives of someone trespassing on his property at night using a flashlight.

Thats what I don't get. Why have a camera if you don't check it first? The pool guy never approached the house like a prowler. Give me a break. He probably had ear buds in or just didn't hear him. But I didn't hear the homeowner yelling on the 911 call prior to shooting. Unless I missed it?

This police officer giving the press conference sounded like the homeowners’ defense attorney 🤷‍♂️ he was taking their story verbatim….like everything they said was exactly true. The pool guy shouldn’t be there at night of course but there was no reason to shoot at him with 30 rounds. (Or shoot at him at all). If nothing else the male homeowner should no longer be able to own a firearm. Even his wife was telling him “Stop shooting!, put down the gun” Meanwhile, the police were clearly on their way, possibly there already while he was still unloading his firearm.☹️

Nothing about this is dangerous. The lights for the pool area where OUTSIDE THE HOME. This home owner was a veteran with more experience with firearms than most people. Home invasions and armed robberies are at a 20-year high. If someone is around your house at 9 pm and is shining a light into your home, the worst thing you can do is turn lights on and show an intruder where you are. Every day, people are killed inside and outside their homes in Florida and around the US because crimes have gone bad. In fact, the pool company can probably be sued. What kind of idiots come over to someone's house late at night without informing them ? Also, when they don't leave after being instructed to do so, this is completely the fault of the pool guy. 99.9% of people would assume their house was being broken into.

He clearly wasn't there to break in because if you don't break in in the 1st 5 minutes you're not breaking in. And 30 rounds ??? He could have easily killed anyone of his neighbors ! The "Colonel" probably has a pretty good dose of Little Man's Syndrome. Probably a Navy seal dropout or Army special forces reject and now he has to over compensate to prove his manhood. That's how it works with these guys. Next time he'll kill an innocent and the same people will be making excuses for him.

@@aaronkamakaze2967 the pool guy did not leave because he didn't hear the owner's command, because he was looking for outside lights, quoted by the person giving the report. So, the light switch had to be inside. The lights being turned on would alert the pool guy and also reveal who was outside. For all we know, maybe the couple were supposed to be away. Pool guy knew the code to get pass gate.

As a ex pool guy this is very upsetting, and as a gun owner I know that ur supposed to identify the target before firing. I can tell you rn that if he told him to go away then the pool guy did not hear that. It doesn’t make sense that u would ignore a home owner when ur in their backyard let alone that he’s telling u to get away. Even after servicing for a pool for years you’re awareness is always higher when you’re in someone’s backyard. That being said, the latest I ever shown up to service a pool was around 6pm. 9pm is very late but i only had 55-60 pool while some guys can have up to 90+ pools a week.

Both parties are at fault. That been said, the pool guy should have contact the Owners first to let them know he was running late, especially if it was at dark and never been there servicing their pool that late. There is negligence there as well. Glad he was not seriously injured and came out alive.

Not trying to to cause a major argument. Please read the laws for the state of Florida that relate directly to this case. Read stand-your-ground law. Hopefully that will help you understand how it applies to this situation. According to the report and some of the camera footage from that home the pool worker entered the screened-in area of the pool. In Florida that area is considered a structure. If you enter that structure, depending on the circumstances, you may be considered a burglar. Apparently, the homeowners perceived this individual as a potential burglar. A burglary in the State of Florida is a forcible felony. Again, read the laws to help you understand. The prosecutor also determined no charges will be filed in this case.

Homeowners knew they were wrong. Dead wrong. Could've killed that kid. A good attorney would have found the homeowners guilty. There was nothing to be afraid of. They had the security cameras, pool guy was just trying to do his job. Maybe the pool company dropped the ball and didn't tell the homeowners he was going to be there. Still no justification for shooting that many times like a mad man.

Certainly not without knocking on the FRONT door to announce your presence. Even out here in the suburbs where I live, there is plenty of crime, both property crimes and home invasions. Hesitation will make you another victim. Did he shoot more than needed? Sure. Did he shoot blindly? Sure. But, here in Florida, it's not a crime. It doesn't matter how good your attorney is.

The man didn't communicate for the pool man to leave before shooting, and they disobeyed the 911 operator when he said to stop shooting. There are many laws against recklessness such as this example.

Security cameras may not be tethered to a monitor. Some cameras use an SD card as their only means of recording without monitoring. A camera such as that would require the SD card to be removed and placed in a reading device of some sort. I don't know which they have. I can also tell you from experience that we don't know where the monitor or monitors are located if they had any. Phone apps are slow in many cases when used to monitor cameras if they even had them set up to do that. Most likely they did have a monitor for at least some of the cameras. Where is that monitor? Is it actually on all the time or do they need to activate it for a picture to come up live? In an emergency it's not always easy to do that quickly. I've stated in other replies I wasn't there and I'm not condoning 30 rounds used. The pool cleaner may have had earbuds in or had a hearing problem. We don't really know how loud the people in the house yelled to get this pool cleaners attention. Not only did the sheriff decide not to charge the prosecutor also agreed. May I suggest that you read the laws of the State of Florida concerning stand your ground to better understand why this was handled the way it was. The pool cleaner apparently was perceived as a burglar by these homeowners. The pool was inside a enclosed screen room. This is considered a structure in the state of Florida. A person inside that structure depending on the circumstances could be considered a burglar. A burglary in this state is a forcible felony. This entire situation is unfortunate.

@kurt9994 I don't care if it was a structure! The entrance to their actual locked dwelling (living space) was not tampered with. He didn't touch the door handle or giggle it in any way. He was waking away with his flashlight when the rounds was shot off. I really don't think they were doing any critical thinking. And of course, Florida's stand your ground law is the main reason the sheriff explained away their ignorance. So, I'm standing my ground on this position!

I wasn't there either however I know about the different operation of security cameras. I'm not defending anybody. I'm not condoning the discharge of 30 rounds. @mypeeps333 Ummm hmmm, because of that high noon-ish night vision camera he could likely have been watching from the safety of his bedroom, while he waited for the police but that would have made too much sense and he probably mediocred and gave orders all his military career during wartime, inside an office somewhere and this was the moment he had waited for, maybe trained for, all of his life. You know military men far and wide came and went and came back again if they were lucky, and the general consensus was... naaaa, man. Whatever he says, it didn't happen and he's goofy AF.

Firing a long arm in a residential neighborhood is indeed criminal. Firing after a threat has retreated (the pool cleaner had left the property while Bradley was still firing) is indeed criminal. That was a "perceptive" statement. From her perception, it was definitive. I see a lawsuit on the pool cleaner's company by the homeowner and possibly the pool cleaner on the horizon. Not one bit of this would've happened if they had informed the homeowner that they were sending someone onto his property at an indecent, unprofessional hour. They are entirely at fault for this whole incident.

Pool guy is at fault. Homeowner can sue pool company. This guy will probably get fired unless he owns the company. Even if this company only signed up psychics & clairvoyant as clients, they would still need to call clients to get permission to come onto their lanai after dark. He probably had ear buds on. I get that the pool guy should have probably notified them but if you scheduled an appointment that day and you see someone around your pool, common sense should tell you “oh maybe that’s the pool guy” like??? And they had security cameras, what’s the point in having them if you’re not going to use them!

It’s the summer time, and it’s Florida and pool companies are busting their butts doing their rounds. This entire situation is on the home owners period!!! That could have easily been neighbor kids goofing around. Would every one be ok with the home owner blasting the bits out of neighbor kids goofing off!? Oh but Timmy shouldn’t have been in my yard so I blasted him to pieces. Exercise some common sense. It’s shocking how many idiots have guns. Army vet too... the guy wasn't responding to multiple verbal commands on someone else's property.... the law is right... being an army vet doesn't mean you know the law, you also don't know what type of environment this guy home is in....is it surrounded by other houses or is it isolated on acres of land?... there's many factors to consider before just spewing stuff... also there's many soldiers in the army that can't hit the broad side of a barn with their rifles, I've been to many ranges and instructed many on shooting as well and I've seen so many take more than 300 rounds to zero... so being in the army doesn't automatically make you a damn sharpshooter😂😂😂 would I empty a mag on a target unknown around my house, probably not, but does the law say I can... It sure does...seems like this guy knew his land and environmentn and felt comfortable enough to dump all 30 rounds.... the law is right... FYI it's in Dunedin, fl.. each property put that way has acres of land per lot there's not many areas where the house are close together out that way.

I FULLY support 2A and the right to protect your family, but this was COMPLETELY reckless in so many ways.. Before I even get to the RECKLESS homeowner, I want to make something clear.. I have been in the pool service industry for 10 years. I have NEVER set foot on a customer's property after sunset except for 2 times. On BOTH of those instances, I had made contact with the customer via phone, and asked them if they would rather me come the next day, and both of them were fine with me being there past sunset. Once I arrived, I knocked on the door to make them aware that it was me entering their property. These were both urgent time sensitive stops. I refuse to enter a property after dark without making the home owner aware for my own safety. This pool guy was an idiot for going in after dark without making any contact, and I don't know a single person that I have worked with who would disagree. With that said, what the hell is this homeowner thinking? This is the worst way to handle this situation on the planet. Yes, grab your gun JUST IN CASE you have to defend yourself from an ACTUAL threat, but.. THE 4th BASIC rule of gun safety: Know your target and what lies beyond. YOU CAN'T JUST FIRE BLINDLY INTO YOUR YARD BECAUSE YOU SAW A FLASHLIGHT. Especially since you have already called the police and know that they are on their way. This man could have killed a cop trying to search the yard for the very guy they called about, but he fired blindly anyway. This man did not verify any target or threat to life before pulling the trigger, and completely disregarded the safety of the people who may live behind him, and then CONTINUED to fire after being told to stop, STILL WITH NO CONFIRMATION OF AN ACTUAL THREAT BEING PRESENT. The WORST part about all of this is that he has security cameras. You can look and verify who is in the yard even if you are too scared to look physically. This man has a complete lack of safety and discipline, and it makes it all worse that he was a former military member who DEFINITELY was taught better. I hope that the pool guy gets better, but also that he takes this as a reality check and uses his brain in the future. I wouldn't be upset if he loses his job for this poor judgment. I do support castle doctrine laws, but this is ridiculous. Castle doctrines shouldnt absolve reckless endangerment. Basically speaking, Castle doctrines mean that you have a right to defend your home and do not have a "duty to retreat". They cover the right to defend your property against someone who has broken into or is CURRENTLY breaking into your home. I dont know the exact specifics of FL's CD laws, but this incident should not have been allowed to happen UNLESS the pool guy picked the lock to enter the yard (highly doubt that). He was not trying to break in, he did NOT already break in, and there should definitely be something in the law that requires a basic level of competence on the defenders part. If there isnt, then something is wrong. This guy keeps throwing it out there that the homeowner is a vet, like its an excuse, but to me (also a vet), it tells me that he should have known better than to act so carelessly. The way this guy handled this is amature and I wouldnt even have accepted this from even someone who just started learning firearm safety yesterday, because he broke one of only FOUR BASIC rules that are taught at the beginning of every firearms safety class. Someone so experienced as to call themselves a vet should have DEFINITELY known better. As a vet and a firearm owner, I am disappointed in this guy. That's my 2 cents (professionally speaking).

His wife even started not answering the dispatcher because she likely started thinking she could be implicating her husband. I’m all for castle doctrine if someone is trying to break into your house. But to have it cover a homeowner being a coward and allow them to murder someone because of their cowardice, that’s… that’s just insane. It was like 8:58PM when this began. It wasn’t 2AM. If this is allowed, why aren’t there scores of people dying every week in FL due to house doctrine? Surely living in places with a higher population density has more “scary” people being around their living space. Can renters at an apartment just start dumping through their locked front door without them Al even as much looking through the peephole or turning on the light? They have the go-ahead to execute because someone was outside their home when no one was expected? This whole thing just screams coward and the police are backing it because of who the homeowner is and because none of those bullets they can’t find didn’t end up killing anybody. The pool guy showing up is the least insane part of this entire story. From the home owners to this insane press conference by police.

This is absolutely infuriating. The husband has no business with a firearm if he can’t identify what he’s shooting at is actually even a threat!!! His wife had told him continuously to stop shooting and put the gun down but he fired 28 MORE TIMES before he put it down and honestly I think the only reason he did that was because he was out of bullets!! I’m all for defending your home and loved ones but this was just reckless and irresponsible. I just can’t believe he can get away with it, I can understand the first 2 shots but he should be held accountable for firing the next 28 that could have went anywhere and killed innocent people regardless whether it did or not. 😡😡

I work in pest control, I go to people's house, sometimes at night but there are times people don't answer the phone, or the door, I get very nervous something like this happens to me, hits home. My understanding of the law is that somebody needs to be actively trying to enter your house, the screen porch is not really considered entering the house. I didn't see any threat to the husband or wife's safety, one of the first things they teach you in gun safety is know what you're shooting at, make sure that it's a valid threat, and never shoot blindly.

I love how the Sherriff immediately starts defending the homeowner for shooting the POOL GUY. How does the POOL GUY get shot in the back if he's "coming into their home"? Homeowner 100% lied and the Sheriff repeated the whole thing. Apparently the second ANYONE steps on your property, you can murder them, no ifs ands or butts. And the Sheriff will defend you publicly with a press conference. Don't even need to touch the door knob or peak in a window. If they had shot the guy in the face, they would have been given a special "You Stood Your Ground in Florida" certificate, with a special quote from the 911 tape: 911 operator: "What are you shooting at?" Homeowner: "I don't know" 911 tells him to stop shooting and he fires ANOTHER 28 rounds blindly. Absolutely YES anyone should be able to defend their home, with up to and including shooting them. But blasting 30 rounds blindly through your windows, when nobody even touched a door or window, BS.

Thank god he survived. The Sheriff seemed to think it's all ok cause no bullets -- onl glass shrapnell hit him. But they could kill him too if had an artery severed or his brain was lacerated.

He should have been charged with reckless endangerment to discharge 30 rifle rounds without even having a target is just plain reckless .He could have hit responding officers, a neighbor, or anybody. If you're going to own a weapon, learn how to use it responsibly.

I doubt very seriously that the homeowner issued any warning, the pool guy would have announced who he was.

That's what I don't understand, if he yelled at the guy, why wouldn't he have said "pool service". It's also wrong to enter late at night when you don't normally do that. I have a pool and I would be paranoid if somebody walked into my backyard after dark without first calling and just saying they're running late. Both parties are wrong here, one is trigger happy and the pool service should have enough common sense to let people know they're off schedule and is it ok if they come into the yard at 9pm.

If Florida law states a screened in area is part of the house like the cop said then they were legal to defend. The pool guy essentially entered the home, at night, not invited, and didn't verbally respond when spoken to. The pool guy brought this on himself

Blinds closed. Did not open his mouth. Fired indiscriminately and could have killed anyone around. But because he's an ex military officer that broke every rule from his training. All you had to do was hold the man at gunpoint and open your mouth. A scared wife doesn't tell her husband to stop shooting when she's in fear for her life.

I think the important takeaway here is that you should always get an experienced pool cleaning business to do your pool cleaning and not some business that does not have its safety protocols in place. Calling before going outside of the normal cleaning schedule is a common sense practice. Who would simply barge in unannounced at 9pm in a private residence to do pool cleaning? Dumb can get you killed and smart keeps you safe. It is as dumb as drinking and driving and that can be fatal too. You need to do your due diligence and figure out if your pool cleaning company has its ducks in the row when it comes to acting sensibly. You have to know the right questions to ask before you hire them and if you get the wrong answers, call another company with the same questions.

100% You do not shoot what you cannot identify. In the heat of the moment you still have to account for things you can’t think of like pool guys, old people with dementia, stupid teenagers, your own family members etc. You can’t just fire in the dark at whatever. This guy needs to have his firearms taken away until he learns the BASICS

They lied and said someone was entering their house. Shooting through closed blinds? Come on. They are very lucky no one was shot and killed. Where did those 30 bullets land? This is what happens when you remove the guardrails of gun ownership.

@@Garrick1983 True but not listening or not hearing a command to leave doesn’t deserve a death sentence. I wouldnt shoot unless there was a violent threat like a weapon shown or an actual break in. Shooting blindly out the door is rediculous. Could have been a drunk a druggie a kid who doesnt deserve death. Panic unloading 30 rounds is ok with you? A round entering a nearby house and killing a child possible? I don't want neighbors like that. Hopefully i don't.

@@Garrick1983 I heard a lot of things in the background with the 911 operator including an AR being charged, I don’t believe I heard anyone yelling “go away, get off my pool deck” or whatever. Did they yell from inside the house? I doubt the pool guy “disregarded” someone telling him to leave. If he had heard that wouldn’t it make sense that he would identify himself as the pool cleaner? Mistake by pool cleaner not to knock on front door and announce his presence but bigger mistake to unload on what was not a threat.

It's so crazy how not ONCE did this sheriff even attempt to defend the pool guy. Not even defend, but he totally failed to detail that side of the story at all. It's as if everything the homeowner said was just taken as fact and they went on their merry way. That man ran as soon as the first shots were fired and they continued for NINETY SECONDS. In no world is that responsible.

Constitutional carry is a thing now’ what you saying to the general public, is that as long as your scared and feel you have little time and can’t make a proper distinction, it okay to indiscriminately discharge weapons; and in such cases as “castle doctrine” there is no such thing as “negligent discharge”. And if the bullet fragments before entering your body; you weren’t “shot” you just got “hit with shrapnel”.😂😂😂 I guess it’s still the Wild West!😅😂

Lives in fear. 41 Concord dr. is a new (2019) home in a GATED Community. Clearly his pool guy has access, because he belongs there. That's the point of a gated community. If you or I lived in a gated community and saw someone in our backyard our first thoughts would be a senile or inebriated neighbor wandered back there. Or, our pool guy is running late (he did hire the pool guy, right? We would reach for the backyard light switch, not the AR.
