Interesting that my wife just had her embassy interview, and they did not even look at the AOS. She got approved for her IR1 visa, then walked out still holding the signed I-864. Now we have the visa in hand, and all they have is the scanned copy of the AOS that was submitted online.

Hello can you please talk about denial in relation to 1) someone with pending asylum, and a falling marriage can he renew work authorization through the asylum when the denial say they hav 33days 2) which office have your case if appeal 3) jurisdictions of fresh reapplication when your case was moved to another field office 4) can a person denied adjust through the E categories after a high degree

Jim, its total income that you use, not adjusted gross income

I had that question! Many lawyers say AGI, but the instructions on the form say “Total Income” for 1040 and AGI for 1040EZ only. Do you know why lawyers are saying AGI?

If I need three good years would that also mean that I would have to be separated from my spouse for 3 tax years until I can file that affidavit of support and get her visa approved ? Sounds crazy considering we have an infant daughter.

Yes don't listen to the lawyers they just try to scare you into it as long as the co-Spencer meets the requirements you will get accepted

Hi Jim, Thank you sooo much for all the videos! One question, please: I filed the I-30 petition last August for my wife, and for the last 3 years, I have made more than enough to be eligible to sponsor my wife. considering that in a couple of months, I have to file the affidavit of support, is it possible for me to leave my current job since I have made enough on my tax return in prior years, or at least leave my job and get a similar paying job somewhere else or I need to stay at my current job to show income stability? Will current employment be checked or they only look at the prior year's tax returns? Thank you!

Hi Jim, Can you do a video on what constitutes dual intent? ex. someone from Canada working in the US on a TN-1 then marries to a US citizen who files a petition for greencard. Since the beneficiary is working already working in the US on a nonimmigrant visa which disallows dual intent, are they going to be denied renewal of the TN-1 if it expires while the greencard petition is in processing? or if the same person is sponsored by a parent who became a greencard holder filing under F2B, would the same issue occur? Also a further question that is related to the video. what if the sponsor does not make money but the beneficiary has high income working in the US on a non immigrant visa? lets say someone on TN or H1B type of visa in a professional field with high income and their US citizen spouse stays home, would the spouse still be able to sponsor?

Hey, i have a question. I have an interview 21 sep, 2021 and my fiancé mailed documents(affidavit of support and form W-2) but I didn’t receive it yet but i have taken prints of that forms photos which my fiancé took before dispatching mail. My question is do embassy will accept it( print photos of affidavit of support)? And he also send me his tax receipts PDF and his property documents as a proof. During my interview i will also mention that once i receive my mail I will mail them as soon as possible.
