In response to he didn’t think the pictures existed, this was before the internet REALLY exploded where companies to take advantage of the internet. If he hadn’t seen the photos online probably just assumed the only people who knew about or had those pictures were him, his friends, and couple of people who didn’t know what they had. Or he may have just forgotten about taking the pictures because it was part of the routine at that point.

This makes honestly no sense as why is it financially at least harder for the one defending themselves then attacking as it’s innocent until proven guilty so if anyone the burden of proof should be on the accuser not the accused if you accuse someone then you have to give proof and solid evidence the accuser should not have to bleed themselves to defend themselves when accusing is not even as close to being as burdensome to the accused

Both sides are burdensome, Billy just doesn't mind blowing his money. In Australia where karl lives he'll like have 80% of his court fees paid by Billy when he wins. In America if you don't have the financial means to hire a lawyer you have the right to a public defender, they aren't the best because they have multiple clients at a time, but its free. And if a case is obviously bullshit or notable in the news you could possibly get a good lawyer pro Bono, or free for the good publicity on their end.

It's $180,000 because Jobst is defending himself from another country. I guarantee you that balloons prices, as every step is immediately complicated just by that simple fact. I'd bet that it'd be half as expensive (still SUPER, OVERLY expensive) if Jobst were living in America. Also, it's cheap for Mitchell because his lawyers who do spurious lawsuits like this often work on a "Pro Bono unless we win" model. Every fee that Jobst has to pay now is deferred for Mitchell until he wins, in which case his lawyer gets paid back before Mitchell gets any money in his account. If the lawyer loses though, Mitchell owes nothing. So while Jobst has had to pay $180,000...Mitchell is basically getting a free lawsuit. It's all up to how far his lawyer wants to push it before he reaches the wrong lawyer that declares him a menace to the Bar and gets the sad excuse for a "lawyer" disbarred.

I live in Brazil and our judicial system works differently from the US. Here whoever filed the lawsuit pays for the taxes that come from the process and in the end the losing party reimburses the winning part the costs the winning party incurred during the lawsuit. If the US system worked like that, people like Mitchell would be completely bankrupt.

A frivolous lawsuit, often means, the accusatory party is defaming the defendant.. Lol. So he may actually be able to counter sue in the court room right then and there, as long as there is enough proof to show that bowel movement knew he had nothing that would stand up in the case. At the end of the day, Karl put himself in this situation. He could have deleted the video and after he gets the court fees back, he is going to make 500k from this. Not including the money from the attention on KZbin I thought if there are no grounds, it gets thrown out before trial? Im not sure what part of the law youre confused about but no thats not how it works in either America or in Australia (where this lawsuit is taking place). You might be thinking about the merits of a case which could get some lawsuits thrown out but not in this case. The situation a lawsuit typically gets thrown out is when they file for the wrong type of lawsuit (a lot of youtube drama revolves around defamation that is misfiled as copyright claims). But this is correctly filed as a defamation case which means they need to go in front of a judge to determine if defamation actually occured. But also, your comment is really gross and uninformed. The only thing to stop this Karl can do after Billy started the lawsuit is settle it out of court or to fight it in court. Deleting the video doesnt just make the case go away. If Billy was willing to settle the case at just deleting the video then that would be their agreement but given what he did to Apollo Legend who settled and deleted the video but still had to pay Billy thousands as part of that settlement. It was Billy's choice to cheat and then sue people that call him out on his cheating. If Karl makes money from it then good; maybe it'll stop Billy from sueing people in the future for just making videos about facts everyone knows are true but are embarrassing for him.
