A little history on this quarry. For many years it was a working quarry, extracting clay for brick and tile productions. It was closed in the late 80's and was left for nature to take back for over a decade. In 1997 an application was made for it to be used as a landfill, the application was denied by the local borough council and the county council only to be given the green light by the then secretary of state John Prescott. The original permissions were for it to be used for inert waste only, although when those permissions ran out it was ok for it to be used for other none hazardous waste. In 2019 RED Industries took over the site from Lafarge. The Owner of RED is a man called Adam Share he is a former convict having been sent to prison for paying someone to tap the phone lines of the EA, local councillors and members of the public. Since 2019 the site has gone from bad to as bad as it could possibly get having recorded the highest amounts of H2S (hydrogen sulphide) ever recorded from any landfill ever. We have taken it to the High Court and we won but the EA appealed so we're now heading to the European Court of Human Rights.

It was a complete civil matter.

100% Correct unfortunately the thuggery of numbers games is why the criminals show up in force - whilst we outnumber then in our thousands to one now, hundreds of thousands to one I'd wager - long term their goose is cooked. In these situations it depends on the cause and the individuals and other extenuating factors such as the presents of children arrests would likely cause alarm and distress to the young ones. Whilst it is true that any and all POLICE need arresting on the spot for their role in crimes against humanity it's hard to practically apply this at present as we are still setting up the correct justice processes that they need to be dragged before - equal justice under the law even for the disgusting creature that is a policy officer.

Q. When is a private ground a part of the highway? A. When Police say it is. Q. When does trespass on private property become a Breach of the Peace? A. When Police say it does. Q. When does flying a drone over anyone become an offence? A. When Police say it does. This is what you get when Police know that they have no powers, but they will happily lie about the offence, fake paperwork and do as they please anyway because they have the blessing of their supervisors and they have a Magistrate on their side that will happily convict on nonsense application of law. Police State service with a smile. If you doubt that, look at Russia where similar Police actions are routine and are seen in our media every day, especially lately.

@@davidhooper1767 "If" and "could". Straight from the Police Lexicon of Intimidatory Phrases. I guess you are a Plod also? BoP in all of its forms are the most commonly mis-used pieces of legislation that Police have to hand. They are also the charges most often dropped by the CPS/PF on the grounds of "not a chance of being convicted" or thrown out of court because of "no case to answer". They form one strand of the Holy Trinity of Police Charges along with Resisting Arrest and Assaulting Police. All rubbish charges commonly applied by Police and used by them to 'solve' a situation at the time, with Plod knowing that the charges will probably not be taken up, but the use of BoP allows them to arrest and always gives them Plausible Deniability that the offence occurred. Charging someone in the hope that one day a charge might stick is corruption and misuse of law or more commonly known to the public as Routine Policing.

@@colinpryor4290 No I'm not plod at all.The case of R v Howell 1982 is a bench mark of breach of the peace. It is often used by cops to try and convince person's engaged in behaviour that may escalate into violence. For instance 2 person's shouting at each other in the street. The cops say do you want to be arrested for breach of the peace? Go home and don't be here when we get back.A citizen can also make an arrest for breach of the peace too.In the video about the stench it's clear the cops want to intimidate the people protesting in anyway they can even about flying the drone that the auditor has.I don't agree with how they took the side of the company and wouldn't allow peaceful non violent protest.I think you have a narrow view on all things legal/ law enforcement. If we had no laws the country would be worse than already is.Knowing your rights is a good thing however even if you arrested falsely it's better not to resist and then take legal action than giving the cops more ammunition by resisting.

"Is this action in the public interest" There is no way IMO that the police should have even been there. The protesters are not thugs, causing a disturbance or being agrovating. If anything the police should have attended after a call from the protesters after being assaulted and criminal damage to their property.😎

The young cocky Liaison officer has shown his true colours in this video. The bearded Liaison officer threatening DJ’s arrest for breach of the peace was bordering the ridiculous, but the very same officer couldn’t even be arsed to speak to the lorry driver for potentially causing criminal damage to peoples clothing (it can be caused either intentionally or recklessly in order to meet the criteria of the offence), and yet criminal damage is a far more serious crime than breach of the peace. DJ has really highlighted either the lies the police are telling people or their complete misunderstanding of the basics of the law they should be upholding.

@@davidhooper1767 Watch the video again and you will see that the fluid being sprayed from the vehicle (how do you know it was just water?) towards the demonstrators was also bouncing off a filthy wet ground so that would meet the criteria of criminal damage whether done intentionally or recklessly (the damage doesn’t have to be permanent). The police were keen to threaten DJ with arrest for apparently aggressively making the driver aware he would take civil action, but they weren’t at all interested in speaking to the lorry driver to ask him to stay back to stop aggravating the situation (which appeared to be the driver’s intention).

Breach of the peace definition: A breach of the peace is defined as “an act done or threatened to be done which either actually harms a person, or in his presence, his property, or is likely to cause such harm being done.” They must release you once the threat of the breach of peace has passed. Police being clueless as usual and carrying out a profession without knowing the law or the application of it. A medical professional will be struck off for the same treatment. Perhaps the police should have a professional register and be able to be struck off from it?
