She heard him mention it. If you listen carefully he actually told the officers to check the bathroom when they were going in to secure the home. So he went from saying there was no backpack there to telling them to check the bathroom where the backpack was found. She was upset with him because he technically consented to them going to check the bathroom.

If you’re going to speak with officers, there’s no technical mind frame- only literal. “Check the bathroom” is literal. “You want to search my car?” Even if asked in a tone of disbelief/repeated to make sure you heard correctly IS literal. They will take everything in engagement as literal immediately. Even if you “techcnically” said, said things without the intent of providing consent. She knew this. Guilty af Well technically not. Until proven but if it goes to jury we all votin the same.

The police should not have been able to check the trash cans because of how close they were to the house, but finding a bunch of empty purses and wallets in the trash can and her being so pissed off about them going through the trash I think she knew they would find something there. I really believe that she was acting up and being so animated to attempt to distract them from the evidence they were going to find.

Didn’t watch the recap but the original video a while ago, searching trash bins you need no warrant since it’s abandoned property. Searching homes you do need a warrant, and in the video they even say step out we are obtaining a warrant. The victim had a tracker

And as it was said in the video, the police had the right to keep the owner out of the house until they could search it because they were afraid that he would destroy the evidence.

@Revamp The trash cans weren't on the curb ready for trash pickup. It was on the curtlage of the property. Now, curtlage laws very from state to state, and I'm not sure what the curtlage laws are in this case. Considering the trash cans are on the side of the house, it'll be questionable if the search upholds in court, I doubt it.

It is INCREDIBLY easy to fake a GPS signal. There is literally no proof that they didn’t just use an app that lets you put a tag down on someone’s house, Unfortunately this is very easy to do, anyone could do it to you right now. These shows are not about that. What they are about is how the police act when they are in the presence of civilians and their property. The trash cans were on the side of the house and likely part of the curtilage And that means hands off until they get a warrant. They've got the GPS tracking device all they have to do is wait for some judge to rubber stamp a warrant. By opening up the garbage cans now they jeopardize the entire arrest. Which is not good for law-abiding taxpayers.

I don't feel she was freaking out that much as making it clear to the officers that any trespass on their civil rights would not be tolerated. And I think that's fair. The fact she was loud about it, well okay she's probably just a loud person. I don't agree with her personal attacks in the car. But sometimes her freaking out may have avoided her brother from getting beat up and that's always a worry with these cases

She appeared threatening, even when stepped back a bit. I think that putting her in the car was best way to reduce conflict. Audit The Audit messed up on this. She's a third party and has very little right to come so close to cops. Her yelling went beyond free speech. She was too distracting.

@@jmdenison This video didn't show a ton of her behavior, but I've seen other longer videos on this incident and she was pretty out of control at several points. From the extended video it's clear the officers initially detained her when she attempted to enter the house. She wasn't arrested for this, simply detained. Then, while sitting on the step she continued to loudly interrupt the officers as they attempted to talk to the homeowner, that seems like clear verbal interference/obstruction to me. I don't know if that would be able to rise to an actual obstruction charge, but it seems more than enough for the officers to be justified in removing her from the scene while things play out. An additional patrol vehicle arrived and the officer who seemed to be in charge of the scene asked the newly arrived officer to place her in his vehicle. At that point nothing had been mentioned about her being under arrest, it seemed they were simply removing her from the scene so they could complete their jobs. While she was being walked to the patrol car she repeatedly attempted to pull back against the officer and resist him moving her towards the car and then repeatedly was pulling away from him as he attempted to do a brief pat down before placing her in his car. *That* is when it was mentioned she was being placed under arrest for resisting.

I would have to agree. As stated in the video at one point, GPS tags do warrant probable cause, so the trash cans search was a little rushed, but warranted. After the sister was barred entry to the home she was still presenting hostile language both verbally and physically. I agree with the disorderly conduct charge, but she's very lucky that she did not get an obstruction charge.

He got a felony for receiving stolen property between $5k - $10k. She got a misdemeanor for receiving stolen property < or equal to $2500 & possession of drug paraphenalia. Stealing cash from somebody's wallet or purse is one thing. But stealing the wallet or purse and discarding it when they are almost _always_ full of bank cards, licenses, documents, sentimental items/photos makes you, in my opinion, an absolute scumbag trash human being. Same goes for if you steal somebody's phone and you wipe the data card and pawn it for $100. The phone was probably worth $1,000 and had TONS of important information and sentimental value on it. No pity from me at all for thieves who steal these items. They deserve whatever sh*t comes their way.

Can’t say I agree with you on this one. In my eyes, the officers did a great job trying to play both sides here. Officer said they were going to secure the residence, and the sister began furiously yelling and charged the officer. He pushes her back and explains again that he is securing the residence. She walks up to him, still yelling, and begins flailing her arms. She is obviously a distraction and interfering with the officers lawful duties.

Actually if you look closely, the cop reports purses in the trash on the radio before he opens the trashcan up. A claim of a stolen backpack and purses STICKING OUT of the trash is definitely gives probable cause to not only search the trash but the whole house

I think the case could be made, just like when a cop can look into your windows and see drugs on a table. if the cop can see the garbage and the bag without opening the lid, then it leads to the investigation.

@@danieldotcom3743 A few things I can easily brush off. 1. Saying you wish or hope something happens to someone, is in fact Not a threat. 2. The cops are not allowed to search a trash can that is located on the side of someones home, without a warrant, which these cops did not have. Which makes that search a crime. 3. When the sister saw the cops, breaking the law, she stopped them. They did not arrest her because she was breaking the law, they kidnapped her because she was calling out their crimes. 4. Even if she "knew what was going on" that doesn't change anything I have said at this point. The cops do not have the legal authority to just choose to ignore the law like they were doing. His or her actual guilt when it comes to the stolen bag, does not change the fact that they have rights, and they were violated. 5. It is not immoral to lash out against your kidnappers, or to wish them harm, it is expected. She was being kidnapped, she was about to be sexually assaulted by government officials/workers, and or raped. She had every single reason to wish the people who were harming her, and about to cause her greater harms, harm. It may be illegal to resist, but it sure as heck is not immoral and it sure as heck should not be illegal if the thing you are resisting is a crime against you. 6. There are processes in place, to protect everyone in these kinds of situations, the cops did not use those processes, they did not get a warrant, they did not follow the law or policy's, they just kidnapped the woman because she was trying to hold them to the law. They chose to break the law, which makes any conviction of theft nearly impossible if he gets a decent lawyer.

This is one instance where I gotta defend the cops. With the trash can full of empty bags and purses, as well as the backpack in the house with the air tag and important documents. It's hard to defend anyone in residence or related to those staying there. The sister clearly knew he was guilty or affiliated and tried to make a scene to bail him out.

Not necessarily. He COULD say that, but if his sister spends a lot of time there, then he couldn't possibly know everything in the house. She could forget stuff there all the time and he wouldn't know it. This is normal, expected, even. And it might be part of why the sister showed up so quickly. Even then, it's unlikely that most people know everything that's in their houses, especially if they have a lot of stuff.

I would think that the fact that the trashcan was so full of stolen property that it raised the lid high enough that the contents could be seen without opening it is relevant. The cop could see many purses, etc. from plain view and since that is unusual and relevant to the question of a bag theft, it gave RAS to begin an investigation.

That has to be one of the most generous C grades ever. A successful prosecution for the threats would have faced a tough challenge, but her words were contemptible & the cops exercised a lot of restraint. Yelling & screaming at the cops while they tried to talk to her brother was interfering with their ability to do their jobs. They could have gathered a search warrant first and secure the residence, the fact that they started already searching the trash enters a gray area, nothing stopped them from going to a judge first to avoid all legal disputes, instead they acted on their own, which then leads to potential 4th amendment violations. So these kinda situations lead to gray areas, which then leads to disputes.

Terrible take. Police have a responsibility to do things legally, not trample peoples' rights. This is absolutely not a case where the end justifies the means. They illegally searched the garbage can and illegally entered the house. Yes, the guy got his bag back, but any charges in this case should be DOA thanks to the officers' crimes.

The trash cans are so close to the curb that a court would probably side with the officers on them being able to search the garbage. Outside of that - securing the home and obtaining a warrant was on the up and up. These two thugs got what they deserved and the victim got his bag back. Justice served.

If anything from the garbage can or walk through of the home was used to apply for the warrant, the whole case should be dead. What else did they have? An Airpod signal isn't probable cause in itself. I've seen police believe someone's missing phone was in a vehicle in a parking lot because the building the owner dropped it in was blocking GPS signal. The cell tower data happened to place the dot on a vehicle outside. The trash cans were clearly right against the house, and there's no rational comparison to be made to cans placed out at the curb for garbage collection.

Despite the legality of their seach of his trash, it's quite possible the reason why the sister was so defensive was because she didn't want the officers discovering the trashed bags of other victims. Her brother has clearly done this to a fair amount of people to have it stacking up in the trash. And the fact she mentioned the bathroom and it sounded like she specifically didn’t want that area searched, tells me she may even be helping him. Or perhaps, she's the mastermind behind everything and her brother is more just a witness and provides a base of operation for her crimes. Either way, the bag was eventually found in the bathroom. So one or both of them are into shady business.

Just because someone may have committed a crime does not mean police get a free pass to violate your rights. This is a precedent you don't want to set as it would get abused. They already abuse peoples rights we dont need them to feel even more free to do so.

Sister was definitely in on it. Trash can full of bags screams a larger operation even if just between the 2 of them. The fact that she was so angry demonstrates she likely was in on it seeing as adults don’t behave that way especially when they aren’t guilty of anything though some people are terrible at controlling their emotions. I think a court would likely find searching the cans as justifiable due to the air tag popping on the house and the fact that they were more or less readily accessible from the side of the house same way a driveway is an invitation for the public to come up and knock on your door etc. Glad the complainant got his stuff back.

I actually think the search of the trash was legal. Those look like city-issued bins, which means they are property of the city. They didn’t search through anything bagged, only opened a lid.

It’s tragic a dedicated law channel doesn’t know the law. Law school 101 - which I took, they teach you trash / recycle bins are excluded from needing a warrant because whatever is in there is abandoned property willingly put in there to be thrown away.

@@revamp8835 It depends on the location. Most of the time, you can search it when it is a certain distance from the home, where it can be collected. It doesn't matter here anyway because the purses were seen before fully opening the bins. They had enough reasonable suspicion.

You also can't claim you smell weed to produce probable cause for a search of someone's home, which the officer also apparently did here. This is some gross misconduct you're willing to defend here. We don't know for certain that either of these people were involved. Perhaps all those items were stolen by a person or persons unknown and that person(s) were using this residence as a dumping ground. The trash can's outside, so anyone in the vicinity could have been responsible. It seems very strange that these two would steal so many items and then 'dump' them in their own trash-can. Best to use the trash-can of that unsuspecting guy a couple of doors over. Maybe his spicy sister gave someone the big-elbow and they want to get even.

He's trying to be unbiased. I don't like how he gives a no grade to a lot of people given the slightest impairment, but he is grading her based on her ability to navigate the police encounter. She knew some of her rights, but didn't tell her brother to just go inside and close the door. He can't give her an F for being a criminal because they're innocent until proven guilty.

That is going far above and beyond her 1st amendment rights, they didn't arrest her until she was literally stopping them from entering the property after the owner had already given permission. The ping alone should be justification enough for law enforcement to at least be able to obtain said item if not to search the home with that goal in mind. I sincerely doubt the accused had nothing to do with the theft considering the trash is filled with purses and wallets. She might be but that's for the court to decide. In reality... we gotta be transparent. If she gets a F for shouting at police and not breaking any rights.... despite being a criminal. Then police can use that logic when you raise your voice in frustration due to a police officer trying to squash your rights. The police conduct was questionable... and remember.. ATA rates things acordance to what happens in the situation.. not the outcome. At that moment the police had NO SOLID EVIDENCE of thefts at arrival. A bin with wallets isn't "SOLID" either.. it's STRONG CIRCUMENSTATIONAL and raises "Reasonable suspect" She probably knew all of it.. but that's not how the law should work. There is another case where an "Airtag" was used to raid an old lady's house with SWAT where she was innocent. The reason being, the airtag was tied to weapons and a stolen car. So SWAT raided the house despite not confirming the weapons or stolen car being there and the AIRTAG had a range of 5 houses.. the old lady was the most "Center" of it. So she gets a C-, cause if we don't give "suspected criminals" the same right as "suspected innocent people" then Police will use it against you to make a false arrest cause "you happen to be like the "suspected criminal" Though I do like to add she is a repeated offender and if someone of the police knew who she was.. then it changes everything.

@@kotlolish Since there was tracking pin pointing the home, it could be said that this was an active crime in progress, which doesn't require a warrant. No different than if a thief runs into a home. The modifier is the fact that a crime was reported, and a GPS signal pin pointed where the criminal went. No different than a guy on the street pointing to a house and saying "The bad guy went in there!". That's probable cause enough for a warrantless search. On top of that, the police also had other probable cause: The purses/bags sticking out of the trash. Since they are evidence of a potential crime, in plain view, that is probable cause that allows them to search the trash without a warrant.

This feels like a rare miss from ATA. The Cops didn't even use the trash as a reason to enter the home, so fruit from the poisonous tree doesn't apply and ATA spend more of the time talking about why they shouldn't look in the trash then anything else. Also when saying the sister didn't try to enter the home ATA literally showed her trying repeatedly to do so and push at the officers. Seems like pretty textbook interfering with officers trying to do their jobs. I'm no fan of police but this interaction ended with no one hurt, a victims getting their stuff back, and charges for a criminal (pending trail). Seems like a pretty good outcome to me.

Which serves to show the other side of why police need to respect people's rights, because if their basis for the warrant is deemed a violation, all of that evidence is inadmissible and they have no case. Violating rights harasses the innocent and lets the guilty go free. Police should just _never_ do it.

To be honest I think the commentary on this episode was lacking. There are huge parts that ATA glosses over that would definitely impact this case. The admission of guilt, the trash filled with empty purses, and the GPS would be incredibly hard to beat in court and I think would more than meet the criteria for most of what they did. And the sister made all this worse and defiantly should be arrested, if I walked into a random crime scene acting like this I too would be arrested.

AITA showing their bias here. Officers did everything 100% correct and by the book. Not only that but the victim was fully recovered. AITA cares a lot more about the criminals rights which weren't broken in any shape or form rather than the actual victim who got his stuff recovered. I seriously want an answer from AITA how the officers could have done anything in his eyes to get an A+ and still recover the victims property and arrest these criminals. Oh right nothing because of his extreme bias and hatred towards officers doing their job the correct way like they did here.

I watched this whole encounter previously and I think the actions of the officers were entirely justified. I was all set to be on the side of the arrested parties, but nope. They did their jobs appropriately Edit - It wasn’t apparent that the officers “searched” the cans beyond lifting the lid and looking inside. Considering the visibility of the cans from the street and the evidence of the stolen items indicated by the AirTag data, I think this was completely justified

That’s true. I tagged a phone like that knew where it was. It was a whole county over. The cops from where it was stolen said it’s the problem of where it’s at now. And the cops from the city where the phone was pinging said it wasn’t their problem. I got both of them on the phone and they still did nothing. It was in a bad part of town too and the cops still chose to not do anything . What’s worse is the cops said we can’t do anything after i showed them video evidence of it being stolen and the pinging location. I dislike cops.

@@I.____.....__...__ garbage bins are considered trash and discarded, if not within an enclosed place (even if its a screened in porch with a storm door it counts as enclosed.) Then it is fair game. The courts have ruled in almost every case concerning this that . . . well essentially another mans trash is another mans treasure. If a homeless man takes your old shoes out of your garbage can it isnt stealing. You're showing the world you dont want these goods any more and left them in an accessible place. Same thing with cops searching the trash. You have discarded the items and left them out. Regarding your other points of contention. Shed with no locked door? They need a warrant or exigent circumstances (hear screaming, crying, or other form of distress etc from inside is one example thereof) to go in, or the guys permission. The Windows, cant go in them but you can *look* all day long. If contraband is left in (very important term here) "plain view" and the officer can see said item without aid then its valid. This can be pushed to limits like say.... Police believe a diamond necklace that was stolen is in this dresser somewhere, they dont have permission to look through it and the warrant isnt signed yet. They can in the meantime look over, under around it and behind it as long as they don't manipulate it (move it). So short cop A says "hey partner I cannot see on top of this thing can you lift me up?" "Sure" "holy shit theres the necklace sitting on top." They found it with a simple visual search. This can be extended to plain feel as well. "Is that a pistol in ypur pocket or are you just happy to see me?"

It can be argued that her attempted entry to the home could be interfering with official duties. They had RAS with the air tag and the trash can full of wallets and purses. As they were their for investigative purposes for stolen property, it’s doubtful a court would consider the search of the trash a fourth amendment violation.

California vs. Greenwood--decided by the Supreme Court--says "a person does not have a reasonable expectation of privacy in their trash. No you don't. Any "government agency" can just call up crApple and demand that location information and crApple will happily give it up without a fight, or they might even just charge money for it. A warrant is required, except for when crApple doesn't care/would rather "play nice" with the "government". Yeah crApple advertises themselves to be so good with privacy, but the truth of what they do is the opposite. Gurgle does the same thing too.

It's not a useful as people think. Notice how the guy said it was jumping between houses. Most of the time a GPS gives an area where the tracked object is, not a precise location. People think the center of that area is the location, but it's not. I worked for a cell phone company for 10 years and and had to explain this hundreds of times to both customers and police. If the trash hadn't been full of incriminating evidence or if that evidence had been in trash bags, or if the cops hadn't checked the trash at all, they'd never have been able to get a warrant from that GPS alone because it didn't specifically show the tracker as being in that house.

They use BLE (bluetooth low energy) to connect to other people's crApple devices (even ones that are "turned off" (yes, crApple devices continue running in "airtag" mode even when "turned off", this is the crApple Mesh Network)) and triangulate (BLE can measure direction and distance) their position based on those other devices that do have their own precise position recorded. So in this case this guy's airtag was using his own crApple phone and even the perp's crApple phone (if he had one) to determine and report its location. The more crApple devices close by the more accurate the position is.

@@runeheadah And how do the Apple devices locate themselves and therefore the Airtag? GPS. Airtags have an accuracy of 800 feet outdoors. GPS is usually more accurate than that, but the Airtag is using GPS secondhand. When the tag is inside a house and the phone is outside, the phone might not even be getting the bluetooth signal at all. You're right that the brother's own phone might have been the one locating the Airtag, because it's entirely possible it was the only one in range due to the bag being inside a bathroom. Which means the location would be based entirely on the GPS of that one device, with the inaccuracy problems I described.

The brother was 100% a thief and this may not yet be cofirmed but I believe the sister is in on this scam that he is running. All the empty wallets and purses in the trash bins don't look good for them.

@@williamkelley1971 I can agree with you on that, however with the service member telling police the bag contained military information and it showing up on the locator at the individuals house I believe that is enough evidence for “probable cause” and to at least check the trash bins. But, the situation could’ve gone a different direction if the sister hadn’t have shown up and acted the way that she did

@@JMHall1117 it did not show up at his house. It showed up in the general area. They tell the sister in the beginning they’re going to check the other houses as well, so they’re not even locked in with him as the suspect.

She needed to be arrested, interfering with an investigation just to start; also Disturbing the peace, and borderline domestic violence. Running her mouth, yelling and calling them names didn't help either. She should have been rated a D for her conduct, she escalated the situation and got herself arrested.

so gps pinged the house, the trash was filled with discarded purses/bags, and they ended up finding the backpack in the house. So they did take that shit and i hope that guy got all his documentation back. They should also look to see if any of those bags had identifying material in it to see it they were also stolen. Seeing as the initial cause for the cops being caused was a stolen bag i could see the follow up on investigating everything they found in that trash can. its wild how she's acting like the cops cops are just targeting her brothers place for no reason despite being told about the situation. Someone could argue she was covering for him and/or had knowledge of the missing gear or knowledge of the other discarded property in the trash, hence her defensiveness.

I was able to find the case online, ended up in federal courts because of the military ID’s etc, ended up with 151 months and 5 years supervision afterwards. Can you say oops 😂😂😂😂
