@Aria I think everyone knows about that "thing called evidence". That doesn't mean there should be a statute of limitations on rape. Biological evidence can degrade or go missing in a murder and there's no limitation set for prosecution. You murder someone when you're 20 and and it can be proven when you're 60, they can still get your ass. Who is against that?

As a mother of 5, this story breaks my heart. I don't even want to think about anything like this happening to any of my babies! If Jacob were alive today, he'd be 2 years older than me. I'm 40 born in 1980. If his life hadn't of been taken by this sick piece of shit, who knows what kind of life Jacob could have had. It seems like there are just too many stories of children being abducted and murdered during the time period of the 70s and 80s. I know there are many children now who are abducted, but at least now we have the Amber alert system to quickly help bring kids home safely.

 Damien Hollester That makes sense but there are other crimes that do not have a statute of limitations. It makes a lot of sense that lesser crimes like, say, shoplifting "go away" after a while, but sex crimes? No those need to be right up there with murder; especially when there's a child involved. Tbh I think the statute of limitations on sex crimes has more with our "holier than thou" morals and is a way to shame people for being dirty. The speedy trial clause is just a convenient way to justify it; kind of like how people justify discrimination with freedom of religion.
@damienhollester1006
@damienhollester1006 4 жыл бұрын
Mapos Sims: Thanks for the comment. The statute of limitations is required by the constitution speedy trial clause however they're some exceptions. For example the time does not run whenever the fugitive is concealing himself. The time does run when a suspect is known and law enforcement fails to make an arrest during that period of time. The only exceptions to this are murder and fraud. In a fraud case the time begins to run once the crime is discovered. Nevada was the last state to eliminate a limitation for murder. In other words, cops must do whatever is possible to progress the investigation and can't just shelve it and do nothing until years later.

The guards tried getting my dad to kill him... Giving him shanks and all sorts. Luckily my dad didn't. Well, on his last day inside he found out that the guy WAS a pe*o. I understand emotions and thoughts of revenge, I have them too. I'd just like to point out that we should break the chain of violence. Obviously, first of all, we need to educate our society about violence, abuse, what it is, what it cause, what to do when it happens. I just think it's not the answer. It won't get this little boy's life back. Also, we need to spread awareness about pedophilia. In some countries in Europe there are actually ads like "if you as an adult feel sexually attracted to kids, please, seek help" and there's an anonymous line one could call, they have programs, treatments. There is research that shows pedophiles after therapy understand that it's hurting kids, and although they still feel sexual attraction to children, they learnt coping mechanism, and make a concious decision NOT TO ACT on their urge.

@@kathrynrichards2343 you do realize a huge part of the legal system in most western/first world countries is making plea bargains/deals? They made the choice to allow their son’s murderer, who they knew would be facing jail time regardless, not be charged with his murder or kidnapping in exchange for the location for his body. They made this choice so they could have closure, start moving forward, and most importantly, let their son finally Rest In Peace. Thank You for sharing Jacob’s story. As a Minnesotan many of our childhoods changed that night. I was 9 & remember it so very well. That night innocence was lost for all Minnesota children. The feeling of safety in small towns all over my state was taken with that sweet little boy. I remember looking for him everywhere. My cousins were neighbors of the wetterling family & I’ve had the blessing to meet Patty. That woman’s strength & resilience is truly inspiring. She waited 27 years for her little boy to come home. She left the front light on EVERY SINGLE NIGHT FOR 27 YEARS. Resonate on that for a moment. 27 YEARS..What a heartbreaking thought. Patty has become a warrior for other missing & exploited children. She’s used her tragedy to help others. She took her brokenness & made it a blessing for so many. Even though she lived a personal hell daily. I didn’t care what people thought. I never let them spend the night anywhere. Their friends could come over to our house. Now my youngest is the same with my only grandchild. I moved 2300 miles across country to take care of him as soon as he was born. The first 4 years I was with him every day, all day. He in first grade now in a reputable private school. I’m the only caregiver he’s ever had. My daughter works from home. We are still very close. I don’t know how Jacobs parents survived this tragedy.

This one cuts deep for me. Jacob reminds me a lot of my little brother. It's so unfair, that he was in so much pain, that his friends and family had to live with the uncertainty for 27 years only to find out that he died the day he was abducted... I can't even imagine how awful it must've been. Rest in peace. ❤️

Let's not forget that it was the FAMILY'S CHOICE to have this outcome. It's either go to trial with minimal evidence and no body and endure all that pain and heartache again, OR have him show where the body is, but not charge him with murder, yet he still goes to prison for 20 years where he will likely die. The family probably just wants to put this to rest after 27 years. They don't want to relive their nightmare. They don't want to risk an acquittal. This way it is a win/win situation. The guilty party goes to jail so he can't hurt anyone else and the family gets to properly bury Jacob.
@1981lashlarue

+emetatron That is very true and that is the one point that seems to be lost on everyone pontificating with their sanctimonious comments. The family was okay with this decision and wanted it this way to bring closure. Who are we to say otherwise? Even if he does get out of prison he'll be 73 years old so it's likely he's either going to die in prison or not live very long once he is released.

And had heard about his disappearance as I was bathing my own baby. My friends and myself all personally felt like Jacob was collectively each of our little brother. And my whole family went to help in the search. And I remember breaking down and crying as Patty stood in front of the crowd of people there to help and her thanking us all. I can’t imagine having to carry on after she lost her son. And how tough it was to walk by his room or look in the hamper and seeing his dirty clothes or seeing his dirty sneakers or his toys or favorite ball cap. I always get a cold chill remembering that horrible horrible day. Rip Jacob Minnesota still loves and misses you little bro.

Especially now when DNA evidence is solving so many decades old cold cases, it's time to remove statutes of limitations on all sexual assault crimes. The fact they exist at all is outrageous and insulting in these types of crimes. As for the sentence, don't quote me but I swear 20 years for one count of child pornography is higher than I've seen handed down as the minimum for murder in other states. Remember, the victims (his family) had to agree to it so at least they had some control.

While I agree that it should be removed for crimes, especially sexual assault, involving children, I think it becomes a bit more complicated when adults are involved. I have unfortunately known a lot of people who would be more than willing to turn a drunk 1 night stand from 20 years ago into a cry of rape even though they were equally drunk and therefore equally unable to properly consent. Even if there is no evidence one way or the other, that is enough to absolutely ruin someone's life.

He wasn't charged with the murder because Jacob's family chose to know where his body was buried instead. I don't think people realize how much impact the victims have in the justice system. If the victims/families say no to a plea deal, the prosecutor won't go ahead with it. This isn't the state attorney's decision, it's the family's decision. Judges can reject plea agreements, but then the plea would be withdrawn. I'm not really sure what would happen in this case if that were to happen. Defense could easily argue that they can't use the body/plea as evidence in trial since that was all obtained in a plea agreement. Also, he wasn't formally charged with murder so a judge probably would not have even known at the time of sentencing that he confessed, since judges are supposed to be neutral on all cases.

I'm sure in the beginning it was hard. They probably did fight when it happened, after a few days of realizing he wasn't just going to easily be found in someone's home down the street. But in these situations, you need all the love and support you can get, so holding that resentment in your heart does nothing but give you even more pain to bear. I'm sure the father lives with the painful thought that maybe if he said no this wouldn't have happened, just like how the boys with jacob that night still wonder why the killer took him and not them. it's natural to do that, we all wish we could go back and change things we regret even on minor scale. i think they've just learned not to let the pain tear them apart, because it's enough losing one precious member of the family and they don't need to lose more because they're arguing about regrets and things that cant be fixed anymore.

when my godfather passed, very unexpectedly from a heart attack while driving to the airport, a lot of his family almost took sides. our side, his side, his mother and siblings, for a while really weren't pleased with his wife. partly for how she and her family behaved when he passed (ill spare you the details, but to give you the idea she literally told his mother she didnt have the right to grieve him.) and generally because she didn't treat him the best when he was living and we all knew he was so overworked and who knows if he would be here now if she had just let him relax a little. but, ultimately, it's our side of the family who's handling his death best and not losing ourselves to the grief, because we know how to make light of bad situations and not to dwell on the negative that we can't change when theres so much positive. so, my point is, yes they probably did fight and probably do feel bad, but sometimes you gotta push away the "you shouldve" and "i wish" and instead remember the good things you did together and remember the person not how they left the world but how they made a mark on it.

I doubt it...mostly because that's not something you can get over. He blames himself - I have no doubt - but if she truly blamed him for it, they wouldn't be together.

I live in Annandale Minnesota. Believe me or not I lived on the same street, 5 houses away from Danny heinrick. Me and my best friend used to stop and talk to him he always sat in the front yard reading a news paper in a lawn chair. Now his house is completely burned and destroyed to the ground. I am so lucky to be here today. When cops went through his belongings pictures were found of my schools playground that he took of him taking pictures of kids playing.

I can't help but wonder if the mom was a little bitter toward her husband. My mom was always HUGE on rules like that, and my dad stood by her always. Now that I'm older, I understand why 100% and I'm going to be just as strict with my future kids.

I was wondering the same thing. It has to be eating him alive knowing he overruled her, I can't imagine how he must feel. God, how SHE must feel. Knowing if hey had just stayed home. How the brother must feeling having asked to speak to the dad instead. So many things went wrong but at the end of the day, it's always just one tiny event that leads to a tragedy. Maybe someone just forgot to lock the door one day, and the house got robbed. Or someone let the dog out to poo and the dog got loose and got hit. It can be everyday mundane things that lead to tragedy and it's so hard to try and prevent them without living a life full of paranoia and hyperawareness. I would hope she's not too mad at him and that he's not beating himself up too bad. Nobody can tell the future, that was probably something the kids did often and sometimes things happen and it sucks...it really sucks

I think you are intelligent, amazing and insightful! But I absolutely agree with you. One event has hurt all of them so much. Obviously Jacob went through the most horrific trauma imaginable, but I cannot imagine the pain his loved ones must live with every day. His parents (as you mentioned) his brother, his friends...they are all victims in one way or another. So heartbreaking.
