I have a theory but im not a legal expert so i wouldnt know if it holds water but eh... We know Grosskreutz is part of a Communist/Antifa Organization and the FBI was investigating the Riots and i am not sure but i think the Antifas are even deemed a terrorist organization. So perhaps Grosskreutz will not get charged because he cooperated the past year? could it be that the Prosecutor is using Kyle Rittenhouse and everything he (Kyle) testifies as evidence to bury Joshua Ziminski or even some unknown Antifa Organizer who Organized Riots all over the country? in short: could the Prosecutor be doing what he does/did because there is a bigger case in the making against the Riot Organizers or is that not something that happens? it sorta reminds me of back in the 60s and 70s with those left wing terrorist organizations that would kidnap people and bomb places

There's nothing "cut and dry" about the gun charge. The Gun charge literally doesn't apply to hunting rifles in the state of Wisconsin. The statute only applies to short barrel/ cut barrel rifles, not long barrel hunting rifles. Even IF he gets convicted on it, there's no way it stands up to an appeal.

He was on his way to the police. 2) Kyle's shooting of Rosenbaum was a direct reaction to gunshots directly behind him, and Rosenbaum trying to take hold of the firearm as soon as Kyle turned around. 3) Grosskreuz (or however you spell his name. The guy who got his forearm shot) admitted on the stand that at the night in question, He did NOT have context as to what Kyle had done, and attacked him because he believed that Kyle said he was working with police. He didn't try and stop an active shooter, he tried to become a cop killer.

His emotions seemed real and I think the jury will believe him. Plus, this prosecutor is a duche and should be tried himself for prosecutorial misconduct after this trial is concluded.

And here's the law in Wisconsin: a minor can legally carry a long gun (rifle or shotgun) without a permit, but cannot own it until 18. So Rittenhouse carrying a borrowed rifle was fully legal

@@ninjabiatch101 Nope. He did give the guy the money to buy it, but the other guy was the owner, kept it at his house, and Rittenhouse did not have access without his permission. After Rittenhouse turned 18, they were going to transfer ownership of it to Rittenhouse, and Rittenhouse would be able to take it home and keep it there. If he had bought it with the money, then gave it to Rittenhouse and Rittenhouse took it home and controlled it, then there would be a case. But that did not happen in this case.

I have been a “criminal lawyer” for 50 years. 5 years of which I prosecuted about a dozen homicides. As a defense attorney I have argued in our California State Supreme Court to reverse death penalty cases. You are right about that prosecutor. He is terrible. Also defendant solidified his right of self defense. It will be Not Guilty. Never a conviction.

The judge is also horrible he has to still decide if Kyle can be found guilty of unlawful gun possession being only 17 without a hunting permit with adult supervision. Wisconsin law is 18 to own but he must look into it.

I'll never understand while Kyle is attacked for "being there" in a town he has friends, family, employment and visits pretty much every day. Meanwhile, we have rioters even the prosecution admitted were looting, committing arson and assaulting the public getting a free pass because... reasons? That said, this video is a really good account on the situation. It is rare to find a commentary on the situation that focuses on the law and legal procedure rather than politics and raw emotion. @@lisashiplett7659 The only problem is none of you seem to know that he violated the law several times. I know how the system works too and probably been locked up more than Larry, but I also understand the laws and all the stipulations around those laws. I know Kyle is fucked on every count he's facing. You could figure that out just by watching the jury instructions from yesterday. At no point did anyone there including the judge disagree much that there was enough evidence for conviction, they just disagreed on how severe the charges should be, which is why lower but still very serious charges might be added.

Example: A guy breaks into a house and the owner comes at him with a gun, the robber stabs said guy and runs away, that's no self defense because he was or committed a crime leading up to this point. I think he took the case because he had no other choice. I wouldn't be surprised to learn the government is paying him a lot of money to prosecute this case. Otherwise there would be riots in the streets again. I believe if the jury acquits Kyle, there will be riots in the streets again. This was a losing case from the start and they are attempting to make it look like there is a possibility of conviction right up until the last moment. I think at best it is a mistrial and at worst a hung jury. It's a political dog and pony show like everything else these days.

The situation called for defensive action and the police weren't helping the locals, but a kid was willing to provide aid. The interesting note is that his friend loaned him a gun because of how threatening the rioters were and the precaution was necessary it would seem. "He shouldn't have been there" is more "The threat level was so high that a seventeen year old kid was on location with a gun to provide medical aid if needed and to defend himself or others if needed".

Update if anyone didn't see it yet: gun charge was dropped because in the state of Wisconsin, the open carry age is 17 as long as it's not a short barreled rifle. Kyle's rifle was not short barreled, so that charge has now been thrown out.

Yeah, this part is where the video lost me. Why blame him for being a wannabe cop, when the real cops were GONE (told to stand back and watch)? It implies a right for some people to burn down businesses, ruin lives, and endanger a community, which you have no right to try and prevent. The idea that bringing a gun and going there is bad suggests that you have no right to go at all, because people who have gone without protection have gotten severely beaten up by mobs. It's clear that would have happened to Kyle after putting out the fire if he was not armed. The only people who say he has no right to be there, as far as I can see, are a) misinformed about why he was there and what had happened the night before and past riots, b) people who were in favor of the riots doing damage and hate anyone who doesn't stand back and take everything, and c) people who try to appease both sides, even though they see the self-defense, they don't want to upset the passionate leftists.

They see riots as revolution and anyone defending society as white supremacists, vigilantes, militias and fascists. In their world view conservatives have no rights, no legitimacy and no future. Point of clarification, Kyle DID NOT buy the gun. He was under age. He had his friend Dominick Black purchase the gun and keep it at Dominick's house in Wisconsin in a gun safe. He was allowed to shoot it with Dominick when they would go into the woods for target practice. But technically Dominick owned the gun. Also, Kyle never took it across a state line.

I completely agree. I just throw it in there because the other side will always bring up the fact that he wasn’t old enough/shouldn’t have been there as their main point. (As if that means anything, lol… ok he shouldn’t have been there, but that has no bearing on self defense or not, and like you said, _none_ of them should have been there). Its insane how many of these people getting shot and killed are registered sex offenders/woman beaters, convicted of violent crimes and 90+% of the time they are actively fighting the person they are shot by then everyone jumps up and adamantly defends the one shot. he was running away, fell, got jumped and defended himself. the guy who got his arm shot is literally a convicted felon and not legally allowed to own a firearm and yet pulled one out of his waistband to try and literally execute this kid and he wasn't charged with ANYTHING? not even being a felon in possession of a firearm? people are even praising him for what he did. its just sickening to me we have gotten to the point where this kid went to try and help a community he has connections to and had to defend himself and now he is being demonized.

The judge just dismissed the underage gun charge, because according to the actual finer details of Wisconsin gun law, you can actually have a long barreled rifle at 17. The Bicep Guy he shot though, who pointed a gun at him, testified in court that his CCW was expired and he was concealed carrying the gun... so he was the one who was actually illegally possessing a firearm.

It wasn’t expired, it was invalid. Prosecution didn’t wanna say why it was invalid, but it was because he had charges for disorderly conduct and being intoxicated in possession of a firearm.

Carrying a firearm in whatever legal fashion you choose does not implicate your intentions to commit murder. Carrying a firearm is within our rights and carrying while helping people is what 100s of 1000s of people and good police do every day. It is not much unlike a seatbelt. You don't go out expecting or looking to be involved in a vehicle collision. But it's there in case the situation arises where you do need it.

I'm impressed that under such pressure and adrenaline he still managed to stay cool and precisely eliminate only deadly threats. He wasn't shooting blind at everyone. Even when people got within 10 ft and raised their arms he didn't fired. Much respect. I was listening to this trial at work when I could. No, he did not "need to go with it". He is putting the right to self-defense on trial, which is exactly what is wrong with the whole case. No one should have brought this to trial. We have a long way to go to reclaim our basic rights in this country and nothing is more important than your right protect and defend yourself. Without that right you have literally no rights at all.

I agree that the prosecution was never going to get a conviction, but the reality is whether you like it or not, not prosecuting would've lead to more loss of life and more property damage. Perhaps someday we'll be at a point in this country where obvious reality is obvious, but that day isn't today and it's not going to be any day soon.

I think every logical person should come to the realization that a) Yes, Rittenhouse SHOULD not have even been there to begin with, let alone bring an AR-15. b) Yes, Rittenhouse is very unlikeable, but c) That doesn't mean he's guilty, and in fact, he's only guilty of one charge brought up against him (possession of a firearm while underage). I find it appalling that people are trying to use this case to argue the racial disparity in law, yet, Rittenhouse, Rosenbaum, Huber, and Grosskreutz are all white.

100% in the right. Kyle acted only in self defense. You can say “he shouldn’t have been there” but the fact is he was totally in his rights to be there and to do the things he was doing. He wasn’t starting a riot, he wasn’t enticing anyone by rendering aid to people, a few liberals got out of hand and thought they were above the law and they got killed for it. @@ianmoone6562 Not necessarily. It's not self defense to initiate a confrontation then hide behind someone else's violence to justify yours. The bigger question rises from- if the gun was illegal, can he legally use it for self-defense? He attained and carried the gun illegally, so he was committing a crime already before he even started shooting. We had a similar case years ago in NYC where a man carried a gun illegally but then killed in self defense. He was acquitted of the murders but still found guilty of gun related charges. The same should happen here, IMO. But he clearly went there looking for trouble. He's a dumb kid, who thought waving his penis extender around would intimidate people. When having a gun failed to make his power fantasy come true, it ended in disaster. He had no answer for unarmed people that wouldn't be intimidated by a gun, and he certainly didn't have the stones to go down there without one.
