​@@AuddreyMarx Not when the case is this publicized. Money only goes so far when media attention is on it. The DA wants Melly in the chair, they are going all-out to get him. Melly's money is only giving him a chance at winning. Money didn't make a detective try to get someone to lie about facts. And money didn't stop Melly from trying to intimidate witnesses while he was in prison.

🤔 Here is what I perceive happened after watching the hearing. Detective knew he did not have jurisdiction to serve the warrant and so the deputy was supposed to be there. The deputy got lost in the building and was late. The detective got ahead of himself, served the warrant and grabbed the lady’s phone out of her hand. Then he told the deputy, who was then out in the hallway, that he had to say he was there when the warrant was served. The deputy said something to the effect of “I can be there if you want me to be”. Boudreau had a fit, told the DA’s they had to disclose it. Bradley dismisses her and refuses to file a Brady notice. Trial happens. Boudreau finds out the notice was never filed and she ain’t having it. So, the other DA files a Brady notice that is about a joke. Boudreau was like ‘Hell no that is not what happened’ and spoke to the defence herself. Then Bradley, in a last ditch effort to save her face, her case and her ass files another Brady notice now throwing the deputy under the bus. She got pulled down into her own shit pile. Her body language and testimony came across as so arrogant. Like ‘you can’t touch me’ vibes. The Good Lord will ALWAYS humble the proud.❤

@plutotech thinking it's OK to lie to prove someone's guilt is a mistaken way of thinking and almost certainly a sign of disregard for others' welfare; the policing system in the US is dynamically flawed and, tragically, one faulty cog can have deep and wide spread impact on lives. In the case referenced in the video, I did not mean the officer unintentionally made a mistake. Rather, this individual's ability to be a police officer is a mistake.

He was out of jurisdiction (I think) that's why the deputy needed to be there. He was trying to wait for the deputy to serve the warrant but she began (fiddling) with her phone so the detective snatched it then told the deputy when he arrives that he needs to say he was there. Bradley did so many questionable things in trial its insane.

Bruce you got it wrong when you said Moretti didn’t need to say anything as far as someone being there when he served the warren. The issue was that Moretti wasn’t in his jurisdiction so some officer should have been present when he served it making it “illegal”. That’s why he asked Deputy Gurel to say that he was present to cover his tracks and actions

Its a formality, the warrant is still a legal order, no reason to throw the whole case out, but the prosecution really should have disclosed what happened. If he was in the state of Florida he had jurisdiction, he just is not employed by that specific department. For instance, if you're a cop in Cincinnati Ohio, you are a peace officer foe the entire state, you just happen to work for Cincinnati police

@@serenity6415 Thats true, but the detective also investigated the case. He didn't enter anything into evidence. Its stupid but it is just a formality. He shouldn't have done it but it isn't "bad enough" of a brady violation to get the case thrown out at all

I know that the state courts state that arrest warrants or any other criminal process issued by the state courts shall be executed or served only by the sheriff or his deputies. If Moretti is BSO, which I believe he is, and the warrant was served in broward county, which I’m honestly not sure, then he could legally serve without a second person there.

When she was giving testimony her behavior was so crazy to me. Either she has Tourette’s (I have a mild form of this so no shade) or she’s deluded herself into thinking whatever she’s done is justified. She’s very unlikeable either way.

My understanding was that the detective wanted the deputy to lie because the detective himself did not have jurisdiction to serve that warrant in the first place, but had the deputy been present it would have been legal.

I think the defense lawyer made a good point about tunnel vision and police wanting to be involved in a 'famous' case. Of all the video that would have been available, the police only used one and let the rest get deleted, they ignored every other possible lead, they 'found new evidence' after 5 years just in time for trial, etc. This whole thing should be thrown out.

they dont know where the murder actually happened, only where the cover up happened. they didn't pull video surveillance from more than half the street cameras and shops the car drove by so for all they know they missed footage of somebody getting in/out of that car or the murder actually happening@@Tired603

@@FIYAFADAT Actually, given the results of the jurors from the previous attempt being heavily in favor of convicting, it's much more likely the new set of jurors all agree that he is guilty. I give him a solid 1-3% chance of getting away with it. They have a ton of evidence favoring him being guilty regardless of who is acting as the lead prosecutor for it.

@@Silverhazey_ I doubt that. I see a hung jury at worst and case being thrown out at best. Evidence of misconduct by the state employees keeps on piling up, some Jurors are gonna have a problem with punishing a man if so much misconduct was involved. It's reasonable to think Melly is guilty in actuality, but the process of convicting him needs to be unbiased to reach that verdict confidently in a court of law.

@@idesel I just don't see a jury taking any of that into account when they see that the shots that killed these two men were fired from inside the car, where Melly was, with his phone GPS data showing him there, etc etc. That's hard to overcome with administrative or misconduct of not turning over things to the defense. Like, does that stuff help the prosecution? Obviously not, but with that evidence laid out again I don't see that outcome. And even if the jury IS indeed hung again and they declare another mistrial, they ABSOLUTELY will continue to keep retrying this case until a verdict is reached guilty or not guilty. This is a double homicide we are talking about, this case isn't being dismissed unlike say, a stupid drug charge on someone. This was the loss of two men's lives.

Was the clothing (truly) inappropriate though? Yeah, she was wearing some form of scoop-neck top under a blazer and showing plenty of her décolletage, but have I seem worse clothing choices? Yes. Would I have mentioned her clothing had I been Bruce? Nope. It seems petty to discuss fashion choice in this context and it took away from Bruce's professional remarks about the merit of this matter.

I'd give both instances a 7 out of 10. Defense attorneys are very observant and sometimes you can draw parallels with context clues.

I’ve been saying since the early trial days that this was not the right prosecutor for this case. She was not prepared for a high publicity case & is way too emotional. She’s not thinking logically. They should have put a high performing lawyer in this case. She’s too sneaky

10:20 He said that because the cop NEEDED the other cop to be there to serve the warrant and collect the phone. The cop that took the phone was out of his discretion. So he told the cop, tell them you were here. So they tried to hide it because they probably couldn’t use the evidence on the phone since it was illegally obtained

I am glad this happened but how did the defense find out that this happened if it was concealed from them? Also I am confused about a statement in a South 6 Florida article that states "The judge also ruled that the state attorney cannot be called to testify about the alleged Brady violation." I thought the attorney was going to be called as a witness??

It’s crazy how bad the prosecutor messed up this trail . It’s an easy clear cut case and she botched it badly. It’s sad really if she was more professional and actually did work , Melly would’ve been easily convicted.

If the judge was aware of this prior to these motions he should have granted the mistrial due to prosecutorial misconduct in the first trial. Been folllowing this case extensively, but ive never seen such unprofessional lawyers

Yeah, and she thought she could avoid it. I’m not going to the hearing and she says I was at deposition. she just didn’t want to show up because she was embarrassed and thought she could get out a way I’m not gonna go. I would have to testify at least that one DA who testified against her has class.

You’ve got a lien cop making evidence if you’ve got a DA fabricating evidence and not handing things over like that to the defense because the defense would’ve gotten them not guilty so she didn’t want to do that she thought she could convict him, but luckily that didn’t happen he got a mistrial. She didn’t see that coming she thought of sensing him to death and being done with it, and going on to her next case she is a scumbag.

Stopped at 10:26 to mention the part that’s not mentioned in your commentary so far is that the officer/detective didn’t have jurisdiction to serve the search warrant for the phone. He didn’t want to wait and that’s why he wanted the other person to say they were present. I think that’s important to note.

So much so that he has their names tatted on his face. Clearly if he did it, he'd have a motive. So having one would go a long way.

Florida seems so corrupt. Have you been seeing Grant King’s podcast on how Florida handled Leo Schofields case? I’m listening to the in depth podcast on it now, Bone Valley. I’d love if y’all would take a look into that. A whole judge in FL quit over that, and I’d love to hear what Bruce thinks about that whole shitshow. Listening to it is making me so mad and really convinces me that FL’s Justice system is extremely corrupt. May as well be a 3rd world country.

Broward County PD is what the LAPD was in the 90's before the sweeping reform. The only difference is that California elects governors and mayors who look out for the people. Florida has had a long line of corrupt right wing extremists as governors so it's no wonder why the justice system in Florida is so corrupt.

Haha, I would be the perfect juror for this case because I have no idea who YWwhatever Melly is, I haven’t watched TV since 2015, and the only time I heard of this case is by watching your channel! (And I still don’t know exactly what the case is about, but I’m not missing an episode of your YT channel, so here I am!) Thank G-d I’m not in their jurisdiction because I’ve done jury duty once when I lived in Cali and vowed never again. Never ever again do I want to sit in judgment of another person 😣

The only time he can talk to anybody is with his lawyers and at court. Bortlen didn’t stop he went right to the hospital and didn’t make any out going calls so who told melly the boys were dead? Also if he did switch cars why was the boy texting him that morning asking him what happened (which was also shown in court) if he went right home like he said he did why would someone from the other car texting you about what happened and why his friends are dead??
