It's not the presence of the cameras - it's how he was using them. He called to to complain that she was using her phone - not that she was absuing the mother. Apparently, he believes she should sit next to the bed as just stare - unblinking - all through the TWELVE HOUR shift...

I do home health specializing in quadriplegics and paraplegics. Cameras are a must! And if you are doing nothing wrong it doesn’t concern you one bit. These people must be protected, it’s extremely hard to find a good caregiver. I’ve never had a client who wasn’t stolen from in the past. These home health agencies are the worst though, they call in all the time. Not caring that the person is paralyzed and can’t get into chair or anything.

Speaking as a healthcare provider with over 20yrs under my belt, I welcome cameras and I'm very upfront with family members.... your loved one will definitely be taken care of, but I'm going to be on my phone and if it's overnight I'm going to rest my eyes as long as the client is taken care of and resting... if you don't like it I'm not the girl for you but I will not be sneaking around

So you would have us just sit there and stare blankly while the client sleeps for hours at a time, as opposed to sitting next to the client texting or playing on our phone quietly while waiting for them to wake up?

I agree with you completely on this because I'm the same as you and I know that I take very good care of all of the people I see but at the same time too they need to understand that if somebody is sleeping we are OK to be able to look on our phone or play a game or even lightly Close our eyes as long as we're keeping the best Care we can inside of the home. We are not slavesand we're entitled to have some personal time even a regular job gives you breaks and we're right there so nothing can happen

If someone was caring for my elderly parent, or my disabled child, *YOU’RE DAMNED RIGHT* I would have camera surveillance everywhere but the bathroom, or the bedroom if they were live-in caregivers! If you don’t have anything to hide, you shouldn’t be concerned!

I use to work in a rest home as a health care worker in a dementia ward. If you truly love ur job you dont care if there are cameras or not, even if you do home care cos u know there is nothing you will do that's questionable or gona get you in trouble. And having cameras keeps everyone safe ❤

Is the defendant serious? What decade does her mind live in? There are cameras everywhere on almost every job these days. This should be seen as a great comfort and safety measure not only for the precious 95-year-old mother but for the home nurses as well. If you’re doing your job the way you should then there’s no reason to be concerned about cameras.

Exactly. My mother died when I was 21, and my dad 4 years later, but the abuse I've seen recorded is scary. I would 100% have cameras for elderly parents or my children. I've seen bad abuse there too.

He was smart to have the camera's put in. My husband had camera's installed after my MIL developed dementia and we had to get in home care for her. Good thing we did, as one of the caregivers stole some of MILs meds (narcotics) and it was all caught on camera. We also caught MIL assaulting one of her caregivers. (we suspected but the caregiver, a very lovely lady, didn't want to make waves). It goes both ways. We were able to protect both MIL AND her caregiver because of the cameras.

As a person who also works in home care I wouldn't mind working with his mother talk to her clean up and help with medicine understand that some people are tough to work with but having cameras is good for both parties

My daughter pet-sits. In the 2 homes she does the most often, there are at least 5 cameras around the main rooms. There are several cameras around a 70 yr old Amazon parrot- one of them is large and has live feed. We pretend there are no cameras and give a pet report card at the end of the week. That's for PETS, not humans. If you're doing your job, on time, and with care, those cameras protect you, too.

Well, if it cost him work because he had to care for his mother he could. He just didn't have proof of the income missed, which he obviously needed. I would have caregivers sign a contract where they have to give a certain amount of notice too, if I was him, because he could sue for breach of contract (but you need damages).

No, that wasn't the lawsuit. He was suing, in part, for the income HE missed due to her irresponsible and unprofessional behaviour of just not showing. His problem was that he didn't bring proof of the income he missed, which he needed. Had he brought that, he would have won for at least that much.

It's basically a he said she said, because if he was so unhappy with her he wouldn't have rehired her. That spoke volumes. Plus as long as a caregiver isn't abusing or stealing from the client, they will be hired. I've seen this first hand unfortunately, & it's sad.

Because of their attitudes towards caregivers and others put in place to help them. He is gonna eventually have to keep his mom himself.

I used to work in this field and it was horrible. The clients were great but the families were too much. I didn't care about cameras because I had nothing to hide but I worked with one client where in the middle of the night the the cameras in the house would start moving around and that's how I knew the family was up looking at the camera and that was cool too. But then they started moving the cameras every time I moved it was creepy but I was even cool with that. I mean at the end of the day they are protecting a family memeber. One day the daughter called me at 2am and had me walking through the house opening the closet doors to make sure I didn't have visitors hiding in the closets. I had never ever had an issue with being on time and I had never even had someone else drop me off at work. I had the utmost respect for my client's homes. It's their safe haven and it's bad enough they have to have strangers in and out of their home. Then another day the son called and told me I had stayed in the bathroom 6 minutes and asked me why. After that I was done.

Working in home health care, you should not be surprised there's cameras everywhere! It's completely expected. And if you do not see cameras, it's common to assume there's a camera somewhere. So I'm not sure why that would be a problem with the defendant unless she knows she's going to slack off.

Cameras are a great idea to make sure everything is ok. Has been alot of older disabled people who have been abused or just not cared for properly. It's probably reassuring for him to be able to see his mother and see how she's doing. She doesn't like cameras, is she afraid she'll get caught? She just didn't show up, she should get no jobs caring for others. She got caught not doing her job.

Not being rude but there are some health care workers that don't do their job properly. Its not a job everyone can do. Most of my working life I've been a support worker for kids and adults with special needs and looking after the elderly with dementia. I loved my job but you have to look after ur mental health as well cos sometimes it's not an easy job ❤

I worked in 2 different nursing homes as a housekeeper. There were a few CNAs and nurses who got called names,spat on, and basically beat up by residents but I could tell they genuinely cared for their residents regardless of what they went through. I always admired people like yourself who took pride in their job . Thank you ❤

No, he just didn't bring the necessary proof of the income he missed. Had he done that (income he missed due to her no show) he would have won. Most importantly, all potential employers get to see how irresponsible, unprofessional, and selfish she was. She also seems to be a lazy employee if the mother was always dirty with feces. He wasn't spying, he was making sure his mother wasn't being abused. She's not family and EVERYONE should have cameras everywhere when an elder patient or young child is concerned. Plus, there are some jobs that, unless you get hit by a car, you don't take time off last minute. The Defendant sent a text last minute and the other worker had to work 24 hours. The Defendant may have been unhappy with the Plaintiff's remarks, but to just bail and not show up is so wrong. Also: he was upfront about the cameras, he didn't hide them as was insinuated in the outside/crowd questioning.

He was going to lose for no other reason than, an employer can fire you, without notice, at any time. And an employee can quit, without notice, at any time. If you're not in the middle of doing a critical job, you can quit, unless you have a contract that says otherwise.

Every job I've had, I had to sign a contract promising two weeks notice, and they also have to provide two weeks income. I would have had her sign a contract too. He actually would have won from the no show if he was able to prove his missed income, which is why JM asked for it. The defendant's behaviour was irresponsible and incredibly unprofessional. I'm disgusted by it, actually. And I'd call caring for a 95 year old woman pretty critical.

@wvrjl No. Critical means, for example, a heart surgeon walking away in the middle of surgery. Your contract would have been considered "unconscionable" and, therefore, illegal, by the courts UNLESS your employer also had to give a 2 week notice before terminating you. No employer is willing to do that, making it unlikely your contract said what you're saying it said.

Not every elderly person wants to uproot their life. His house might not be well suited to bringing her in (not everyone can afford to sell a home that’s paid off or mostly paid off and buy a new one with this market) or she already has a great medical team taking care of her. My parents would refuse to move, plus a 1 one story home is out of my budget. I’d have to get a townhome and the bedrooms are on the 2nd floor

Personally if I was the judge I would have made her pay. You obviously cannot trust what she says because she thinks the plaintiff using cameras to ensure that his mother is being cared for properly is a bad thing. Only someone who does not want to get caught doing something inappropriate like stealing or not working would make the claim that the cameras were a bad thing

The only reason why people have issues with cameras is because they know that they have to do there job an not sit around just like this female and THOUSANDS of home care people do. They just think they can hang out and not do there job the way they are suppost to

I agree with having cameras. But I also think he is sleazy in other ways. He calls these grown women taking care of his mother 'girls' and he has that vibe of porn producer guy...maybe it's his bad choice of haircuts, or his job but he gives me the creeps.

well used to babysitting while camera was there hey let me tell you it was a plus mom was happy with what she saw on camera protect me and children peace of mind for everyone

Exactly, as long as it's a good employee. Respectful, non-abusive, doesn't neglect, and doesn't steal. I remember when I babysat I NEVER went through their private property. My cousin was not the same (maybe that's why they started calling me instead of her, lol). I did however, have an occasional habit of waking the baby on purpose, just so I could rock her back to sleep, lol.
