This makes no sense. What if you took out the loan to save your home or secure your living situation? Wouldn't increasing the child support then add more financial difficulty which could put your living situation in jeopardy? It isn't a windfall. It is a loan that has to be repaid. I am not referencing the couple in the video...only the law as stated by the judge.
@I__Love_Lamp3 жыл бұрын
I was thinking the same thing! Courts would have never found out about this because this type of loan or income isn't reported to Child Support! Now if the other parent was looking for an increase which in Texas is usually reviewed every 3 years then her bank statements and or w2 would have shown an increase for one of those year's! This is why if you are going to do this you wait after the 3 year review and then get the loan😁!

if it's a loan against the policy she does have to pay it back or in the alternative when she is 6 feet under 30K less to the beneficiary. If I go to the bank and take a "loan" of $60,000 this is counted as income?
@TheSobieskiukas3 жыл бұрын
Yes it is. You receive money how do you think it works you get money and that's it? You win a lotto you pay income tax . You get a loan that money is counted as income so it is also taxed.
@victorias52723 жыл бұрын
To me, a loan should not count as income because it has to be paid back. And when you’re paying back a loan, you don’t get credit for that in court to get your child support lowered. Now if she was behind on child support, I’d rule that she has to use that money to catch up. But just as a tool to increase the monthly payment? I can’t get with that.
@sloklubolisen25773 жыл бұрын
Imo increasing child support on the grounds of a loan that has to be payed back is egregious. What about when the loan is payed back? Does the increased child support remain or decrease to what it was before the loan? It’s like putting an additional large interest on the loan, making it much harder to pay back. It’s hard to be on the side of the girl in the video because her character is made out to be dumb as hell, but the idea behind increasing child support because you get money you technically don’t even own is ridiculous.
