the bias of the reporter is clear. Lets also not forget that they are jailed for 30 years and the molestation defense was tossed out as arguement by the judge in the second trial. So was that fair. I think its good enough for habeas. The menudo victim is very very credible.

It wasn't just SA, José controlled every aspect of their lives. Their parents never raised them to be independent, self-reliant adults--which is a form of abuse in itself. They reached adulthood and realized they were never going to be free. There are parallels here with the Gypsy Rose Blanchard case. And yes, 35 years is enough.

Child sexual abuse is not ok I'm a victim myself from 5 years old till I was 13 I ran away to foster care these two brothers have done there time they have been punished enough they should not be published for being sexually abused they should be released from prison from Queensland Australia ❤

There is ample evidence they were victims of extreme abuse. What they did was wrong, but they were unjustly sentenced.

@@lovehandles2464 They never had to prove their abuse. It is basic fact of American judicial procedure!!! The state must prove your guilt of 1st degree murder. They didn’t the first time which is why they had a hung jury. The second trial the defense was not allowed to bring in materials relating to the abuse for defense by the judges decree.

It's an area of huge interest INTERNATIONALLY .. I'm in Australia and have followed these brothers for years. My daughter especially is incredibly passionate as well regarding their innocence and release. This needs to be reviewed NOW!

Innocence is a little different. Manslaughter should have been the conviction which was 11 tears each so 22 total and they would have been put 22 years ago.

In light of new evidence, Lyle and Erik's case is being reviewed. They have a hearing scheduled for late November. Hopefully they will be released within the next year. 🤞

Host needs to do his research and get his facts straight. Both boys were not living away from home at the time of the murder. It was just Lyle who was away at school, and they had just bought him a new condo for school. Erik was about to go to UCLA and his father said he could not live on campus, and that he was to stay home to be closer to him, likely so he could keep abusing/molesting/raping him. That’s why the brothers did what they in August, before Lyle was supposed to back (away) to school. Erik had gone to Lyle with this news that the abuse was still happening after his father told him he couldn’t leave and was terrified. They were both terrified for what Erik was going to continue to endure. By saying both boys were living out of the home, the host is saying there was no additional threat to them, which is not true and has been widely explained by both brothers. It had everything to do with the father keeping Erik at home and not letting him leave.

@Vinnie Politan The enabler of any type of abuse is just an extension of the abuser. There is still a threat in a way. It could be emotionally the way they were thinking, because the mother knew and she did not stick up for them. She took the father's side every time .

I think if people actually knew the details and the extent of the horrific abuse these guys endured since the age of 6, they wouldn't be opposed to them getting out. The father was a sadistic pedoph*le who not only terrorized his own sons but also abused other children. The brothers have suffered enough. They saved other children from being abused and they should not be locked up forever.

@@zyajones9360 One of them did have his own place. Erik was about to go to college but the dad told him he'd have be home on the weekends. Erik knew the abuse would continue and was devastated. So he told Lyle and he confronted the dad and said he'd tell police about the abuse if he didn't stop and the dad threatened him because he would never let them expose him as an abuser. The dad had threatened them before if they told anyone so obvs they were afraid and thought they were gonna be killed. It's easy to say "just leave" when you don't understand their desperate situation

@@Leanah30 But the question is would the jury still convict. It's hard to predict but if we use the Gypsy Rose case. SHE was still convicted. Even with an abuse defense, the jury said you can't murder your mom.... And one could argue that the only reason she didn't get life in prison, was because it was her boyfriend, not her, that pulled the trigger. And HE did get life sentence. He is still sitting in prison, while she is free for that murder. So even if there is abuse, a jury still has to follow the law, which is that it's illegal to murder people. So since the fact they did murder them is not in dispute, I don't think the jury would have found them "not guilty." They admit they did it. That said, 30 year to life or 25 years to life, would still bring the chance for parole at this point. Which seems a reasonable outcome at this point. They did their time.

@@jgray690 Gypsy's boyfriend didn't murder his abuser, the brothers did, there is a difference. The only reason the brothers got first degree was because the jury couldn't vote for manslaughter on the second trial. It was either first degree (resulting in life sentence or death) or not guilty, that's it. If the judge hadn't excluded the abuse evidence, that would've served as a mitigating factor to reduce it to voluntary manslaughter which means murder committed in the heat of passion or high emotion due to some provocation. No one is saying that murder is ok, of course it's illegal to murder people, but there is a difference between manslaughter and first degree murder. This was a manslaughter case because of extenuating circumstances. If they had gotten manslaughter which carries a prison sentence of 10 - 15 years max, they would have completed their sentence already and be out by now.

Psychologist here: Vinnie, Kitty wasn’t just complicit, she molested Llyle as he very credibly recanted at trial. There was not one perpetrator, but two abusing these boys. Regarding complacency, Llyle and Erik found out whenever Llyle confronted his mother on behalf of his brother that indeed she knew they were both being sexually molested and tortured by Jose and not only did she fail to protect them, but she saw them as sexual rivals! Childhood sexual trauma changes the wiring in the brain of its victims, making the 22 & 18 year old brothers more like 12 & 16 in emotional functioning. I could go on and on, but at the end of the day these two deserve to be freed!

Also in testimony I believe it was Erik who said he thought it was mutual about his Mom like he was confused (as he would be if SA) about what was not normal. And I trust it if not just for all of the relatives who believe the brothers and support them.

Court tv needs to interview Cheri Woods , a madam who set up Jose with prostitutes and her telling what Jose did to her “girls”. Also Lyle did Indicate his mother’s sexual conduct towards him.

Vinnie came off so biased and dismissive on this one. First, Lyle was *living in the pool house* while he was out of college and Erik was about to enter college but Jose had told him he would be *living in the family home* while he attended UCLA. So they were very much not out of the house. I also didn't appreciate how he came after the prosecutor as "someone known for setting criminals free". *That's an insane take.* I'm glad the guests, even former prosecutors got him all the way together.

I think in regard to the trial they should maybe get a new one because the abuse should’ve been allowed. But in regard to sentencing.. it wasn’t self defense, in the heat of the moment, it was PREMEDITATED! They made sure they had an alibi… they were adults and could’ve left, they weren’t children still reliant on their parents.

I'm glad these brothers have each other. They can spend hours, years to talk their trauma through and support each other and use their pain to help others. I hope they choose a positive path. There are lots of kids to be saved from monster parents.

But that’s not what Lyle claimed in court, he said that she wasn’t strong enough to k!ll herself and they were doing her a favour so that she could also be free. In another video Lyle said that they loved their mother and that she was also tortured by Josè and had her life ruined. The whole situation is utterly devastating.

Just few years ago there was a case in Russia, where three sisters murdered their sexually abusive father with no guns - stabbing. Girls are in prison I belive, but all evidence shows they did it in self defense and should be freed. Point is - you don't need guns to stop the pain. Guns are wrong in my opinion, but in Menendez case, they would do it anyway to stop their emotional, physical, mental torture.

I believe it was however there was still no “evidence” that could prove the SA beyond hearsay as cause for motive, and therefore precluded as a defence. There was a defence for batter women allowed in California at that time but not for battered men.. isn’t that astounding?

The trial from the 1900s were SO biased, they not only disliked the menendez brothers but they also disliked Leslie (Erik’s lawyer) PERSONALLY which in no way is relevant.

Kitty also sexually abused Lyle. On the trial, Lyle opened up about his mother’s abuse. She was no victim of Jose.. she was doing it to her own son too. Both parents significantly damaged and abused their sons.

Oh man, I am tearing up while watching this. While I was a toddler when the murders happened in 1989 and grew up believing the media spin, that is, until Roy Rosello came forward, thus leading me to look up everything about the trials etc. With a brand new set of eyes - and a background in behavioral science - I am 110% convinced Lyle and Erik Menendez were physically, emotionally and sexually abused by Jose and Kitty throughout their lives. Also, as the daughter of a narcissistic mother, the brothers' testimony - esp. Lyle's - about Kitty's emotional abuse, in particular, really struck a chord with me. These guys have done more time than they ever deserved and need to be set free!!!.

The mother, it was said, sexualized them too, but worst of all, to have had the traumas these two had from the father most of their entire lives, and the mother doesn’t do anything, in fact, emotionally makes it worse with physical and emotional abandonment and abuse, providing 0 protection, should be considered in the whole picture of their mentality.

This is not new evidence - the boys had spoken of this letter which was sent to their cousin (if I remember correctly) and the cousin verified it - and there were sexual abuse allegations made by other family members - why did they imprison them in the first place 💔

PS….the mother had a gun and bragged how she intended to “ kill” something. As she openly made them hear they were not loved or wanted in lieu of giving up a career. Wow, how do you not see how deep this goes with her and how they could get to the point they did?

I rarely disagree with you. But this time I have to. Kitty was also a threat. When children are raised in an environment where they are being sexually abused, physically abused, mentally abused, emotionally abused, and just abused in every way, by both parents they are both a threat. Kitty being a woman makes no difference. She sex trafficked those boys to their Dad. Prevented visitors etc from going near the the rooms where they were enclosed with their “Dad” taking showers and being rped. She apparently touched them and had them stand naked and exposed herself in front of them as well as the serious threats of harm, and extreme mental/emotional abuse. To a victim there are no lines there, they are one unit of abuse. There is no way out. There is nothing you can do. The logic is irrational because sure it’s impossible to raise children that way and they be capable of normal function. If I get a puppy and abuse and torture that puppy its whole life, as adult it mauls me one day. That’s a logical result of my own actions.
